    The relative importance of any one factor will vary according to the case in hand and the type of dealing in question.

    The concept of fair usage exists within UK copyright law; commonly referred to as fair dealing, or free use and fair practice. It’s a framework designed to allow the lawful use or reproduction of work without having to seek permission from the copyright owner(s) or creator(s) or infringing their interest.
    Fair dealing law is not only applicable to text-based works; it applies to musical, dramatic, artistic, literary and typographical works too. However, it does not cover the copyright of printed music.
    As an exception to British copyright law, fair dealing is governed by Sections 29 and 30 of the Copyright, Designs and Patents Act 1988, which outlines three instance where fair dealing is a legitimate defence:
    * If the use is for the purposes of research or private study;
    * If it is used for the purposes of criticism, review or quotation;
    * Where it is utilised for the purposes of reporting current events (this does not apply to photographs)
    A statutory definition for fair dealing does not exist; it will always be a matter of fact, degree and interpretation in every fair dealing case. Nor is there a percentage or quantitative measure to determine fair dealing. The Intellectual Property Office lists the key factors used to determine the validity of whether a particular dealing with a work is fair as follows:
    * Has the use of the work impacted negatively on the market for the original work? If the creator or owner has lost potential revenue through the re-use of their work, it is not likely to be fair.
    * Was it reasonable and necessary to use the amount of work that was taken?
    The Copyright, Designs and Patents Act 1988 also outlines the potential fair dealing defences that permit the use of copyright works without permission from the author(s) or creator(s) under UK copyright law.

      I've never heard of some of them but, is it any wonder why people thought they were American? After all they are singing in an American accent, I've always found it odd, just sing with your accent like Paolo Nutini for example.

      @@alimetodista3459 I think its cause it all comes from America and then the first big british artists (those early 60s bands etc) all basically copied them. Some of them even started just doing direct covers too so i think it just stuck. Some artists you can tell though as time went on. Cheers

    Great list 🎉 I knew most of these, especially the older artists. I always thought Carl Douglas was German (like Milli Vanilli and Bony M) so I learnt something today

      Born in Trinidad but moved to Britain as a young kid and definitely has dual citizenship. But i think a lot of people thought he was American anyway lol. Thanks for watching

    I think oasis and Blur should be here. Initially Americans assumed they were also American, and blurs first big break in America was a mock grunge song but Americans didn’t get the jokes and played it to death. They assumed a grunge song had to be American

      Oh yeah most do, thats always been my theory on why british actors can find american accents easier than the reverse...they start singing along to songs in an american accent as kids! That must subconsciously stick. Cheers

      Apparently it is simply because British Accents do not suit singing so British singers tend to modify their pronunciation whilst singing and people perceive this as sounding american

    So ok as much as the artists in this were British they didn’t all sing the songs first. Red red wine is from the 60 Neil diamond song. Blinded by the light (good version) but is by Bruce Springsteen. I’m sure the was one more

    Most of these artists are already known to be British.
    That being said, I always thought Tom Jones, Joe Cocker and Amy Winehouse were American.

      This is about when they would have first had an international hit on the radio etc, people would have been surprised to initially find out they were British. In terms of the list you gave there, Duran Duran was maybe a bit of a stretch but the rest definitely would have shocked people. Cheers

    Probably british don´t know. Richie is a british artist who lived in Brazil for decades. He was a succesfull singer here in the 80s. He used to sing in portuguese.

    Most still have that drift of when we’re imitating an American accent, I think it is pretty obvious even if one did not initially know where the artist is from. Not all, but most have the accent down well-can’t say the same for my friends and I 😂 we sound like idiots when we try our American accents. Nice video, added a few songs to my playlist, too.

    My mum was friends with Mark Morrison (return of the Mack singer )when they were young in Leicester England, surprisingly most people in Leicester don’t even know he’s from here and also assume he’s American lol

      If you define people as 'Americans who never look out of their own Window' then maybe your video title works.

      Someone else said that lol i dont know if thats fair but it could be mostly americans who would have initially assumed a lot of these were american when they were first initially big on the radio etc, which is what i meant with this. Cause obviously most artists sing in an american accent and often an american style really. Cheers

    Player is a bit of a stretch. Only one of the members was a Brit. Most Black UK artists until more recent times born in the Caribbean or Africa and were part of the mass emigration to Blighty in the 1950s and 60s. Joan Armatrading (St. Kitts & Nevis)... Eddy Grant (Guyana) ... Carl Douglas and Errol Brown (Jamaica)... to name a few.
    It's hard to pinpoint what to call The Bee Gees. They were kids when they relocated from Isle of Man to Australia and were only there about ten years when they returned to the UK to begin their recording career. They said they "felt" Australian, but many of my Aussie friends insist they're Poms. Olivia Newton-John also relocated to her native Britain to begin her international career. Both were always included on those various "British Gold" compilation LPs of the 70s and they're rarely included on the many "Greatest Aussie Acts of the 70s" videos we see on UA-cam.
    So, do Australians consider either to be dinky-di Aussies?

      Also Whitesnake's lead singer David Coverdale is English, but the rest of the band aren't British technically, mostly American
      Bananarama had an Irish member Siobhan Fahey who was also in Shakespeare's sister.

    Great list! You could probably narrow it down a bit taking out such as The Police, Billy Idol, Eurythmics and Amy Winehouse and a few others
    But very few made me go “Come on. Who doesn’t know that?”
    Some were absolute shockers like Hot Chocolate, Ace, Average White Band.
    Funny. 30 Rock did a live show where Jenna played Dusty Springfield and she played her with a Kentucky accent “Howdy Yall I’m Dusty Springfield!”
    For the west coast version of the live show….someone must have told the actress that Dusty was British.

      Yup. Bonnie Tyler, Shirley Bassey and Tom Jones are Welsh (as are Super Furry Animals). Average White Band, Nazareth, Annie Lennox, Middle of the Road, Pilot, Bay City Rollers, Big Country, Simple Minds, and many others from Scotland.

      Possibly, i think you can hear it a bit in Tears For Fears accent when singing, both Roland and Curt. And with the Spice Girls they blew up so quickly they were doing interviews around the world straight away lol even if you couldnt tell from the singing itself etc. Thanks for watching

    Sade is Nigerian. Eddy Grant is Guyanese. Carl Douglas is Jamaican. Billy Ocean Trinidad.

      They all have british citizenship and consider themselves british too though, spending all (or the vast majority) of their lives in Britain. Tt cant just be about overall heritage either if you see what i mean. Thanks for watching

      Sade was the name of the band. The singer's mother was white English and the rest of the band were all English.

      Sade is British, through and through. Her father was Nigerian. She grew up in Essex. Eddy Grant is British and was brought up in the UK, as was Billy Ocean.

      Billy Ocean lives in Neasden, a few miles away from me. Electric Avenue one of Eddy Grant's songs is about a street in Brixton.
      We Brits come from everywhere by our relatives and ancestors.

      Just any artist who has British as (or part of) their nationality basically. For example Billy Ocean was born in Trinidad but moved to England as a kid and is a British national. Cheers

      I thought the Bedingfields were from New Zealand,that Katrina's from the US but not the Waves and that the Nightcrawlers were from continenal Europe. I remember thinking John Waite was American and being surprised to find out he was British. I knew all the rest of these were British or part-British with other nationalities,yes like the Bee Gees,Eddy Grant and Billy Ocean.
