The principles of Qiyas and Estehsan evolved by Imam Abu Haneefa, when they are applied in conjunction with the Quran, the Sunnah, and Ijmah, provide the intellectual tools that can be used to develop a minority Fiqh (al Fiqh al Akhliyya) which has yet to emerge in the Islamic world despite the fact that more than three hundred million Muslims live as religious minorities in India, China, Russia, South Africa, Europe, Australia, and North America.
