    It's not cool how the judge shut the plaintiff down and said oh it's an exterminator when he already said he didn't use an exterminator. She cut him off and didn't let him say anything else. I honestly don't think it was down to him and if that company is worth their salt they should offer to replace it at no cost to the plaintiff.

      5:45 When she asked him if he used an exterminator he hesitated to answer, which means he’s lying. If someone asked you in court if you eat dog poop, would you hesitate to answer, no you wouldn’t, you would immediately say no without thinking.

      She cut him off because his continued begging without substance and his obligation of proof in order to win, it would been a fruitless waste of time no matter how bad he wanted to keep talking.

    That's so weird. I'm 65 and have had alot of different carpets. I've cleaned my carpet, sprayed bug spray and used bug bombs, and washed my walls. I've never had carpet change color or become discolored like that.

      i think he tried to clean the carpet in the living room and every carpet cleaning product that i have ever seen has a notice on it that says : TEST IN A SMALL AREA OF THE CARPET BEFORE USE TO MAKE SURE THERE IS NO DISCOLORATION !

      Really depends on the carpet fibre . A nylon will bleach while a ppe will not

      @@marleonetti7 true but if he cleaned the whole carpet then I would expect the discoloration throughout the whole room.
      I too had many different styles of carpet (I'm 62) and never see anything like this. I have used many carpet cleaners also without no changes. Only issues when red koolaid was spilt. I had to replace that area. I believe it may be from pest control formula since it was just around the baseboards.

      @@viper278 he may have only cleaned in the areas where he thought it needed it and then later he noticed the discoloration from the cleaning chemical . his bedroom did not have any discoloration so if it was a defect then his bedroom would have had some of it too and it did not .

    I'm a professional house cleaner. The only way that a chemical will change colors of the carpet, is if it's a bleaching agent or something that's meant for the inside of ovens and grills for cleaning. No regular all purpose cleaner or window cleaner or dusting agent will turn the colors. It is most likely wear and tear, but with that carpet being as new as it is it should not happen that quick. I definitely think that it is a manufacturer defect

      What type of defect would affect just the top and only along the edges of the walls at certain places, but not others? Something selectively happened to those sections, after the carpet was installed.

      If it was manufacturing defect it would of been all carpet(not lines as if machine went through it) and also not just on the top of carpet. I have had my cleaning business. There are chemicals that can do it if person have no clue how to use them. Or uses to much of it. 😉

    When people have their homes exterminated, they exterminate the *ENTIRE* home, not just one room. Otherwise, you’d essentially just be chasing bugs from one room, to another.

      Are used to live in an apartment complex where the exterminator will exterminate along the edge of the entrance, but never go fully into the apartment. It’s to prevent bugs from getting in. It’s possible that’s what happened with this guy

      I think where he lost this is when she asked does he use an exterminator and he hesitates no one hesitates from something simple like that. but he didn't hesitate when it was about cleaning.

      Even if she liked him she needed actual evidence. Even if she let him talk he can’t make evidence magically appear. I think it was a legit issue but I think they both are telling the truth. I’m confused why he is buying carpet for an apartment tho. Is he the owner or does he rent? Rentals the tenant doesn’t buy the carpet so that part confuses me. But let’s say he is renting, I know my complex has exterminators come and if you sign up for the day they come every month or bimonthly, whatever it is, they can come in even if you’re not there. I’m thinking the complex might’ve exterminated his unit and he didn’t know or he didn’t want to tell the judge but I don’t think he’s a liar so I’m leaning towards the first theory. Now if he finds out they did exterminate his unit I think he can bring the charges against the rental owner since they did the damage. The landlord would then be able to sue the exterminator. Or the tenant could sue the exterminator but I wonder if he’d be allowed since he isn’t involved in the contract and isn’t the property owner. My entire thought process is hypothetical but that’s where my mind went during this case.

      Hey may not necessarily be ‘lying’, he may just be blaming the wrong source: he may have hired a professional upholstery/carpet cleaner, or a fumigator, or a housekeeper, or even perhaps his condo/property manager hired someone or used a product that’s caused it. As the defendants pointed out, if it was a matter of defect it would be consistent throughout the pile, not only at the edges and only topical. Personally I suspect a bluing agent used to clean the baseboards.

    I think purple is the base colour for beige and bled through.
    If the exterminator caused the problem, he should be sued. I don't think the plaintiff did anything wrong. That's my opinion and I'm sticking to it 🙂🤣

      @@NJgateway well the fact that it did not change color in the bedroom but it did change color in the living room ( where most of the foot traffic is ) tells me that he tried to clean the living room area but failed to test the product first to make sure it would not cause discoloration .

      @@marleonetti7 that's dumb, it would be happening everywhere if he did that, and why would he need to get brand new carpets clean? it's clearly a manufactures error. I don't think you know what you're talking about, you hear something and parrot it without any thought, if that was the case the entire carpet would be discolored, not those areas. I see you commenting this a lot of places, but you're not thinking critically, he even hesitated about the exterminator question, indicating to me that he did have an exterminator there, and that probably caused it, either that or it was a poor dye job and it faded over time. cleaning doesn't even make sense here

    You ever see these guys install carpet? They roll it out face down in the driveway, on the street, etc. and cut it to the approximate size and then bring it into the room. I think it picked up something during the install then sunlight, heat, humidity, whatever started reacting to the carpet fiber. I think the judge got it wrong this time. Poor guy shouldn't have to foot the bill on this one.

      It would of had purple when they installed, right? It did not. Plus it looks like there are lines from either carpet cleaner or sprayer. Test chemicals on carpet before using it.

      Yes. When I had my carpet installed, they had it literally laying in the street to cut it. My husband had to stop me from cursing them out, lol.

    It's all a scam! I once purchase Pergo flooring for this carpet outlet store and had it professionally installed in my kitchen. About 3 weeks later it started chipping at the seams throughout the whole kitchen. So basically when you walk on it the movement will chip the lip of the Pargo. We contacted the store and told them what is happening to the flooring. They reached out to the manufacturer because of the lifetime warranty. The manufacturer said it's not covered under warranty because the installers are NOT certified to install their product. WTF!!! This is a true story!
    The outlet store said there was nothing they can do about it.
    My contractor was pissed and offer to purchase all new product (somewhere else) and install it for free.
    My wife and I said no! We purchased the product from the outlet store and your crew did a great job installing it. We did buy new product and the GC installed it for free. When we threaten to take the outlet store to court that when they offer me half my money back. We went back and forth but at the end of the day, we got a full refund.

      Good for you!!!! NEVER take no for an answer when it comes down to stuff like this. They're always hoping people will leave with their tails tucked between their legs and leave it the problem alone and forget about it. Always, always, always keep fighting when you know you've been wronged. I can't believe JM ruled the way she did.

    I usually agree with Judge Milian BUT NOT this time around....She was completely wrong and NEVER gave this plaintiff a chance to plead his case....

      She gave him a chance. He didn't provide a reason (because no one knows for sure what happened). But he bears the burden of proof of showing that, more likely than not, the cause is a defect in the carpet. He couldn't show that---his only theory is that if there is a problem, it must be their fault. Problem with the carpet does not automatically equal the retailer's problem---it's not the defendant's burden to prove that they were not at fault, if he couldn't make his initial case.

      I think he simply hesitated to process the question. Like.. “exterminator?” In his head. Then impatient judge assumed his hesitation was a lie. Instead she should’ve followed up with the question of whether or not his apt was in fact exterminated. She rushes to judgement sometimes.

    Carpet manufacturers always deny it is their product, They blame the owner or the installer, and the installer blames the manufacturer. The consumer always loses.

    Environmental moisture can cause areas on a brand new beige carpet to turn purple. Since the discoloration appeared by the door & along the walls, the on-line carpet folks say to pull up the carpet & caulk the open areas between the floor & walls and recommend that homeowners replace the weather seal around the door. That might fix the problem; however, I didn't go into depth about how to fix the color change. There are a few options; but imo, I believe the judge should have awarded the plaintiff the replacement cost. He didn't do anything wrong and the manufacturer can write the replacement off as a loss on his business taxes. I did give the plaintiff the benefit of the doubt and believed him when he said he hadn't exterminated or had the carpet cleaned. I believe he's simply a hard working, honest man who wanted the carpet he bought to look nice. 🙂
    Anyway. I hope that helps anyone who may live in a humid area. Currently, I'm in the desert; so, extreme heat & sand are the bane of my existence 😁

    The defendants are so full of blaming someone else. They know the quality of the carpet was terrible and should not have discolored at all. Has nothing to do with carpet cleaners. I have sprayed bug spray and flea powder on carpets, and they never discolored even cheap carpet.

    Flooring manufacturers have access to labs to research discolorations in carpet fibers or stains in vinyl floor coverings and should've provided that report for the defendants in court.

      @Vic X I think they did. Sadly these episodes on the tubes (YT) are edited and spliced even more so than the originals aired on television. If you look up a particular episode with the names you can usually find out all the details, including what were omitted on what we see here.

    I Installed Carpet for 25 years Carpet Doesn't Change Colors lol. He Must of Spilled Something or Sprayed Something and it got on the Carpet.
    That Can happen from the manufacturer when it comes off the Dye Line. but then it would of been a'lot more Evident. and it would of not Passed Inspection. before Pricing Released the Carpet. A'lot of Reasons but Carpet Doesn't Change Colors by itself. Nope !

    The fact that he hesitated when she asked if he had his house exterminated says everything also when she kept saying I think it was extermination he wasn't denying it in any way, he would have to go after the extermination company unless he signed some type of a contract that protects them from any damage when spraying.

    Why did he hesitate when JM asked about bug removal? They went to Harvey's segment and never addressed it.
    I have read some comments suggesting there are no cleaners that would cause this issue, he could have made a homemade recipe for spot removal, plenty of them online.
    You have to be careful what you use where, just because it's possibly better for the environment, doesn't mean it is for your carpets, fabric etc.

    My first thought was bug spray by an exterminator. The plaintiff seemed to try and evade that topic each time the judge asked him about it. Good carpet still should not change colors regardless. Perhaps this was cheaper material.
    I feel sorry for the plaintiff in a way, but thems the breaks I guess.

    I’ve messed up carpets with wrong cleaners and stuff. I’m not careful or smart with carpets. The only colors I’ve managed to cause are more of a yellow/white/tan kinda thing from a bathroom cleaner. Purple is something interesting. I don’t know what to blame there… if it’s just around the walls then i wouldn’t think it’s just the carpet. I could see maybe sunlight or something but that takes a long time and I don’t think beige would turn purple, it would probably get lighter. The only thing I can really think of is something got on it that reacted with the chemicals in the carpet or some purple chemical got on the carpets and he tried to clean it but it didn’t work. Either way, sucks to be that guy

      @@SilverSergeant Are you sure? I saw a brochure from Jupiter Carpets that specifically said not to be used on earth. Apparently one of Jupiter's moons where they make the carpet has a dust particulate that will turn carpet purple when installed in an environment that has greater than 70% nitrogen.

    It sucks that the plaintiff didn't win. But, it is because he couldn't prove that the defendants did something wrong. I think that carpet was either stored wrong or manufactured with a covering on the carpet roll that over time became discolored. Tough since I don't think anyone knowingly did wrong here.

    "Whatever makes the customer happy"...what a load of crock. If that were the case, they wouldn't be there. Idk if there was an extermination or cleaning...or if the material is defective. But I feel bad because carpet installation is not cheap. Hopefully they can and will help him.

    His carpet is likely browning in those areas.
    Browning - Browning is caused by fibres or carpet backings that contain cellulosic fibres. The browning isn’t noticeable at first and most people tend to notice it after their carpet has been the subject of a professional carpet cleaning. The only way to remove browning from your carpet is to treat your carpet with acetic acid.

    That carpet deodorizing stuff, but I don’t get why it would only be near the edges?

      I do too, especially since the discoloration was only around the edges. Not only that, the plaintiff hesitated when asked the question as to whether he used an exterminator.

      @@bjohnson1149 I think he hesitated because it just occurred to him that maybe his apartment complex sent in an exterminator without telling him.
      It is an apartment; not a house, and apartment complexes spray for bugs. He said he doesn't have bugs, but that may be because his apartment complex regularly sprays to keep them out.
      Regardless, if any kind of spray (other than straight bleach) changes the carpet color, that's some cheap crappy carpet.

    I don't agree with her ruling on this one. If it was from extermination it would have been everywhere. Why would a exterminator just spay one part!?! They would spray everywhere so the bugs won't run to the non exterminated part!! This is a manufacturing problem and he should of gotten his money back.

    I wish the plaintiff had some kind of evidence to help his case. I don’t think it was caused by anything he did or anything in his apartment. I’m thinking maybe the wrapping that was on the carpet before installation may’ve had something on it. Or that the manufacturer’s dye job was bad, which probably means the discoloration will get worse over time.
    Exterminator spray doesn’t make sense because residue from previous treatments would’ve caused the fibers to turn color from the bottom, not just the top…

      Another point on the exterminator theory- carpets would be turning colors all over the world and that would be a well known problem.

      i think he tried to clean the carpet in the living room ( where there is more foot traffic from guests ) and every carpet cleaning product that i have ever seen has a notice on it that says : TEST IN A SMALL AREA OF THE CARPET BEFORE USE TO MAKE SURE THERE IS NO DISCOLORATION !

Do you have tenants contracting you for installations? If so, do you get permission from the landlord before doing taking the job?

    Whatever it is...the reason it's purplish is because of oxidation and or water. So it could still come from the bottom just changed when it hit the natural moisture or oxygen with in the walls of his place. That's my theory anyway.

    Maybe the carpet was in storage for a long time and was exposed to the elements or sun. Maybe the carpet warehouse used an exterminator and carpet got messed up.🤷🏽‍♀️

    My thought was... what if it was something from when they installed it. The tools they used, for example or the nails and its just now reacting oddly....? The only thing that I know that changes white things from white to purple though is too much bleach (soak a paper towel in bleach water and it will come off with a purple color).
    So my though was... what if they used those tools to stretch the carpet and had cleaned them with bleach or something..? IDK... its just odd. People don't usually clean their living-rooms with bleach.. Bathrooms? Yes. Livingroom? No.

      Some people would clean with bleach. You have no clue how people are. 😬 nails most likely would of not done then purple color-more like brown. Plus there are no nails on middle of the room how the lines were on the picture.🤷🏼‍♀️ most likely it is chemical. Where chemical came from-who knows.
