    Hi Atty Suarez, I watched your youtube video regarding extrajudicial settlement. It was informative. I have a question though... I have a property which the TCT is named after my parents, and myself. The TCT is with the bank and is ready for release but since my father passed away, they are requiring us to provide an extrajudicial settlement.
    Questions:
    1. Is the extra judicial settlement still necessary even if my mother is still alive and is listed in the TCT same as myself?
    2. If we are to transfer the title to myself and my spouse, meaning we will remove my mother from the TCT with her consent, what should be our process/approach to settle it?
    BTW, I have 2 siblings and there is no problem with them since the property is owned by me.

    Respectful clarify if one of the heirs, who is also an administrator in the executed EJS, can sell his portion to one of the heirs (co heir/s) utilizing the executed EJS as basis for the absolute sale.     Thank you po Atty. for this very informative video. Meron po sana ako katanungan tungkol po sa extrajudicial settlement among heirs (mga anak). Wala pong titulo ang naiwan na property. Tax declaration lang po na nakapangalan sa decedent (magasawa). Matagal na pong hindi nagagamit ang property dahil wala pa pong ginagawang partion or settlement. Kailangan pa po bang magapply muna ng land title ang mga heirs at maipangalan sa kanila? Many thanks.

    Nice information Atty. What if the farm lot has just one name (only to husband) and is deceased, so need ng Extrajudicial settlement with absolute sale na kasama ang wife and children sa document na eto? So hindi na pala kailangan isalin sa pangalan ng mga heirs ang titulo basta may EJS with absolute sale pwede ng ibenta sa third party/buyer ang land property? Thanks po Atty.

Since you have mentioned sa EJS with Absolute Sale kung ibebenta sa THIRD PARTY. Yung definition po ba ng THIRD PARTY must comply or not necessarily since bibilhin ng compulsory heir?

    if one of the heirs is intentionally excluded in the EJS, for the reason that he already died before the estate tax of his parent is filed and paid, can the BIR discover such action. The intention is to avoid another estate tax event considering that the heir is single and no heir of his own, and no one will go after his share of the estate. The supposedly heir died in 2021, eight (8) years after his parent died. The plan is to name his other remaining siblings and his surviving parent (mother) as heirs in the EJS. We plan to file the estate tax of the parent before the expiration of the amnesty.
    Are the heirs mentioned in the EJS require to submit a copy of their birth certificates (sons & daughters) and mariage certificate (espouse) as part of submittals to the BIR to prove their relationship with the deceased?

    Good Evening po Atty, may amnesty rin po ba at walang penalty ang Deed of Assumption of Morgage ( House and lot) na hindi nabayaran ang capital gain stock sa loob ng 20 years ? Kc hindi po namin alam na may babayaran palang capital gains , kc hindi sinabi sa amin ng first owner ng bahay at lupa na dapat pala ay mgbayad ng capital gain stock...
    At hanngang ngayon ay nagbabayad pa rin kami sa PAGIBIG ng monthly amortization dahil nakamorgage pa...

    Attorney, ask lang po, ano po ang pagkakaiba ng extra judicial settlement among heirs sa extra judicial settlement of estate, o pareho lang ito.
    Using extra judicial settlement among heirs pwede bang gamitin ito for publication.
    Nakabili po kasi ako ng lupa, ginamit namin deed of sale which is dapat extra judicial (nag provide naman si seller ng extra judicial settlement among heirs asawa at 1anak). Sa deed of sale hindi po naka pirma ang anak.
    Ano po ang dapat namin iprovide as supporting document, dahil hindi naka pirma ang anak nya sa deed of sale. Please advice po. Thank you

    Atty salamat po sa info. May tanong po ako. Yong lupa na tinitirahan po namin ng mahigit 40yrs na po ay binigay ng may ari sa lolo thru verbal agreement lang po. Trabahador po yong lolo sa kanila. At na lugi na po ang negosyo. Kami na po ang ngbabayad ng buwis po. Pano po namin pa titulohan po tong lupa na to atty? Nasa 300 sq.mts lang po. Paghahatian ng mga kapatid ng lolo ko po sana. Within municipal area at na zoning na po to. Ang naka pangalan parin sa lote ay yong may ari na namatay na po. May mga anak po sya pero sabi wala na din silang interest sa lupa na yon at naibigay na din sa lolo ko po daw. Ano po advice nyo dito atty? Extra judicial settlement po bah?     Magandang Araw po ask lang po.     Attorney pwede po manghingi ng advice regarding sa lote na nabili ko almost 20yrs. ago, ngayon po tinayuan ko po ng bahay na hindi pa rin na transfer sa pangalan ko hanggang sa namatay na ung nkapangalan sa titulo, ngayon po binebenta ko na po ang house and lot paano po ba dapat gawin para matransfer ung titulo..maraming salamat po

    My dad US citizen not by birth married to my mom in the Philippines. He divorced my mom and remarried in US. He bought a property in Cavite and put on the title that he was married to my stepmom. He passed away last Dec 2017 and he left a will leaving the property to my step mom. From what I understand the last will is not valid since he was legally married to my mom in the Philippines. Does my mom have the rights to the property in the Philippines even though the title is under my dad and stepmom name?

    Atty. Tanong ko lang kung extra judicial with partition. Ano ba ang subject na babayaran sa BIR 6% of d total taxable estate + donation tax + 1.5% doc. Stamp. May babayaran pa ba na iba sa BIR maliban dun? kc may siningil clang 7850.00 pra daw sa certification at doc. Stamp, hiningan ko ng recibo naka indicate n daw sa cert. At ung doc. Stamp attach n nila
    Tama po ba ung siningil nila?
