In 1974 the procedural law (CrPC) was changed but the substantial law (IPC) was remain unchanged the courts were using this principle or way, because it's easy to use procedural law which explain the old substantial law But now the situation has been changed both the law has been replaced, if we think we can trial the old substantial law (IPC) with the new BNSS than it's get difficult to run the trial because the BNSS made out with the BNS sections ,the procedure giver in new BNSS is for BNSS not for IPC
As per ISSUE 2 which law is applicable CrPC or BNSS? If the offence is committed on or before 30 June n FIR register on or after 1 July then the FIR will register under CrPC or BNSS?
If crime occurred before 1st july and trial is still not be started becoz quashing petition was applied and it takes time and trial will start after 1st July then punishment will be decided by bnss or crpc ?? And trial process will be started by bnss or crpc plz make that two different things clear
