  • The plaintiff parked his truck at the defendant’s furniture store, and a car overloaded with merchandise smacked into his vehicle, so the plaintiff is suing. The defendant claims the plaintiff parked in an active loading zone instead of the designated parking area, so the defendant doesn’t believe he owes anything.

    The guy at the end saying the plaintiff was lucky and it was close, obviously wasn't paying attention. You can't hit a car that you know is there and say it was parked illegally as a defense. The law doesn't work like that.

      I have seen many cases like this but car accidents. Was the accident done be a car illegally parked or a driver driving negligently. If he parked on the road and there was a sign, plaintiff would of lost. He assumed the risk by parking there. There is a sign for a reason. They take illegal parking on a street different than on a private parking lot. At the same time the Plaintiff picks up and drops off furniture there. He has the right to park there because he is doing business there. This all changed when the store saw the estimate.

      @@georgebenevidesyou’re wrong. Even if it were illegally parked on a road with a sign, the plaintiff still would have won. A car parked illegally deserves a ticket and to be towed. That’s the law. It does not deserve to be damaged by other negligent drivers or workers etc. The correct, legal procedure to deal with an illegally parked car is to have it towed, not drive into it 🤦‍♂️

      So, what happens if you park next to a fire hydrant and the fire department smashes your windows to get the hose to the hydrant during the fire? Do you sue the fire department? No. You eat the costs because you parked illegally. This case is different because there was negligence on both sides .. it should be 75% fault of plaintiff and 25% fault of company

      defendant is the kind of guy that thinks that if u park illegally then he can do whatever he wants to your vehicle while it is parked there . i have known some homeowners and neighbors who would do things to a vehicle if it was parked in front of their home or parked in a space that they preferred . people like this need to get sued so they learn that they cannot do whatever they please to a parked vehicle .

    The Plaintiff wasn't illegally parked. The store that he was picking his stuff up from gave him the parking pass so the other business could see he could park there. So not illegally parked. The only excuse would be that he blocked their bay and he didn't do that. The bays were separate and distinct. The other company just didn't like that they didn't have full use of the loading area period.

    The defendant was a little too confident and acting "cocky" with the judge. The employees "assumed the risk" when they continued their job, even though the car was still there. The plaintiff even went through the trouble of getting a second cheaper estimate, and that's what he sued for, showing he wasn't trying to be greedy. Wish, however, he brought a letter from the store he was picking up furniture from saying he had permission to be there, that was his whole defense.

      I can think of one case but it may not apply everywhere.
      A friend was coming up to a stop light when the light changed, his front tires were over the line. A lady making a left turn hit his front end. Though she could clearly see him, the court deemed the accident his fault for being stopped over the line.

He was definitely a internet lawyer who thought google was sufficient enough to win his case 🤣 and the YT entitlement reared its pale ugly head even more when he lost the case and still felt in his delusional mind that he shouldve won AFTER hearing what we all heard as facts & “NORMAL” circumstances.     I'm confused.....how can he be illegally parked if he was conducting business with the store that has the same right to use the loading dock? He may have been inconsiderate but he was conducting business.

      He must be *actively* loading or unloading to be legal. The other guys are still liable for the mistake but they had every right to call for a tow and let the driver foot the bill.

As far as we know it is not specifically marked out as different dock spaces to be used individually of each other (in which case the defendant would have absolutely no claim to the area the guy was parked in). Therefore it is a group dock space and they share the space by whoever needs it at the time. That doesn’t mean one party can park while not using it.
      Drivers are not supposed to park in loading spaces. They are supposed to park in a normal spot then move to loading when the order is ready. It’s not hard. But way too many people have a “I’m special and that doesn’t apply to me” mentality (especially when they think they will only be there for “2 minutes”). I see this far too often in my area even by people parking in fire lane for the grocery store because “they are special and only going to do one thing”. It doesn’t matter. The entitled attitude needs to end and everyone needs to obey the rules and not make excuses.

    Even if a car is parked in the middle of the road...like literally in the middle of the road parked and you hit the car you COULD still be liable. Just because someone is parked illegally doesnt give you the right to hit the car

    I'm antisocial and avoid 99% of the population (by staying at home with UA-cam for company). Once again, PC reminds me that I'm making the right decision. Imagine standing in line at the grocery store and the defendant is behind you, attempting to engage you in conversation. He's 100% creepy and potentially dangerous! He looks like he pays women, but then he claims that he did nothing wrong because she was offering an illegal service!

    If it’s a business with no parking signs they should know a tow truck company who could’ve gotten there in the hour the man was parked. Tow it. They were mad the man parked and was in their way, kept working and damaged it. Defendant thought he was smarter than the Judge and I think Doug at the end agreed with the defendant by his remarks to both of them.

    So would the defendant accept he was responsible if the plaintiff had been sitting in his car? The accident happened regardless and the defendant is responsible. Tow companies get sued, and lose, all the time for damaging cars they tow that are illegally parked. The tow is perfectly legal, damaging the car isn't. This really isn't any different than that.

    I have to take the defendants side here a little bit. The plaintiff was parked illegally. Is the defendant just supposed to stop what he’s doing and wait for almost an hour till he comes back? I get it, that they’re supposed to see him, but, they should’ve at least split the repair cost.

    I deal with that daily! People park in the 20-minute loading zone for over the allotted time and when they get citations they get upset and I always get the same stories. I was dropping off, I was only here for a few minutes, or my favorite. I never got a ticket in the past. My reserve parking stall is next to the loading zone, and when I pull in, if there's a car in my stall. I will locate the owner and tell them not to park there. 80% of the time I will get the, how am I supposed to know this is your parking stall. I point at the sign that their car is parked facing, which says RESERVER 24 HOURS DO NOT PARK.
    I agree with the defendant, but he should've issued a ticket or had that car towed.

      @@SamuelGBerman if you listened carefully the defendant gave a time stamp of how long the vehicle was there. A vehicle shouldn’t be in a loading dock that long, should just be there to load and unload then move to a regular parking spot until time for a next delivery to load up.
      Also he’s a delivery guy for a furniture company, not for the defendant’s company. They just share the same loading area

      What you would do is totally irrelevant to what the law actually is 🤦‍♂️ If you were a judge, you would have to rule the exact same way Judge Milian did, because that’s the law. An illegally parked car should be ticketed and towed, not damaged and have to pay for the repairs someone else caused 🤦‍♂️

    Split the cost is the fair thing to do take some responsibility for leaving your car where it should t be what are they supposed to do stop working for an hour while they wait for a tow truck and lose possibly $1000’s of dollars.     The Plaintiff had a parking permit to park at the loading dock to load up his furniture from the store after purchase. Defendant is a loser all the way.

    So question. Years ago I had a guy who was going to a party across the street from my house park his truck in my yard without my consent. He got drunk at the party and passed out, so next morning the truck is still there. So, if being a Saturday, I decide to mow my lawn, and a rock flies up from the lawn mower into his truck and cracks his windshield, am I responsible to fix it?

      I would think if you see it's there and continue to do something that damages it, yes. You should have the person remove it if they do not, then have it towed out of your way. The defendant should have had the car towed if it was in an illegal spot.

      @@stephenhiggs5224regardless of what you think is right or fair, you have to obey the law or you pay the consequences, as already pointed out by others. Have the car towed. If you damage it, you are responsible. That’s the law

    What if I kid was running back there and the cart ran over and killed the kid . The cart a car or a dog if you are not in control of it and there’s damage it’s ur fault.
    Plus’s what if the cart hit his truck when he was there loading currently

      He wasn't illegally parked. He was in a loading zone, which was shared with the other store he was unloading stuff to.

      I'm going to have to be a minority on this verdict, I disagree with it . JM dropped the ball , she could at bare minimum hold each of them 50/50 at fault. Me personally, I would have ruled for the defendant...illegally parked NUFF SAID!!!😕

    The plaintiff parked where he shouldn't have. Period. Is everything supposed to come to a halt because of him? He was irresponsible. He took his chances. He shouldn't have gotten a dime.

      I'm confused, I thought he said he was picking something up from the other store that shares the loading dock. I don't think that's "illegal" parking.

      Except that’s not the law 🤦‍♂️ Parking illegally does not entitle other people to damage the car. The correct legal procedure would be to have the illegally parked car ticketed and towed 🤦‍♂️
