    I was proud that Jinapor realised there is room to file against the Fomina mp 😂. Cos I was wondering why nobody has done that😂. You cannot file under a party if u havent joined the party.

    There is no confusion. The seat should be declared the vacant because they are "seeking to remain in parliament" as an independent candidate. Every parliamentarian seeking to remain in parliament files with the EC for the next election either with the same party, or a different party or as independent. With the same party, no wahala. Any other arrangement, seat Yaamutu. To the extent that they have filed with EC under a different arrangement from what got them into parliament. Seat is Vacant. ARTICLE 97 (1)g - A member of Parliament shall vacate his seat in Parliament- if he leaves the party of which he was a member at the time of his election to Parliament to join another party or seeks to remain in Parliament as an independent member
