I have been curious to know whether WIBA is mandated for independent contractors my take is that WIBA applies to employees under employee-employer relationship. But my question is what if you as an employer don't extend this to them and they get injured while on duty what is the legal implications
Good Question: Our reading of the WIBA suggests that this is a mandatory requirement with a penalty for non-compliance (See Sec 7 of WIBA. 2007) This also means that your employee can sue you for being injured at work and be entitled to compensation. As rightly put; employers are mandated to provide WIBA for their employees. Employers are however not required to provide WIBA for independent contractors (and in some instances casual employees that do not work in the core business)
