    If someone came up with a hammer to an officer and decided to strike something he was holding, they would shot before they even lifted the hammer. If they weren't shot, they definitely would have been arrested.

    I guess it has to be a head mounted camera for an assault to have occurred? Strike the officer in their badge and see what happens. But officer, "I was only striking your badge / shirt / gun, not you!"

      +10thAngel It is not a crime. Police officers are allowed to work security for additional pay while off duty so long as they are authorized to do so by their department. Police officers regularly work security at grocery stores, movie theaters, malls, carnivals, etc.

      I do not believe they are allowed to do so in their officer uniform including the badge, as that makes them out to represent the police force and the state, just like moonlighting in the military,it's completely allowed if you get approved,but you cannot do so in uniform

Obviously the cop is not scanning his surroundings like he was taught in the academy ( I went through the academy and graduated). The cop is incorrect about the law. The hammer guy committed--at the very least--battery when he struck your camera with a hammer. Any first year law student knows this. Under Section 784.03, Florida Statutes, “there need not be an actual touching of the victim’s person in order for a battery to occur, but only a touching of something intimately connected with the victim’s body.” Clark v. State, 746 So.2d 1237, 1240 (Fla. 1st DCA 1999).

    Officers shouldn't be allowed to operate in the capacity of law enforcement while being employed as a private security guard. It makes for a clear conflict of interest considering that most officers will never willingly arrest another police officer that breaks the law unless they are clearly ordered to by a superior officer.

    Giving a phony name address and birthdate in Florida is a felony. The batter is a felony because it was in malicious forethought. The real problem is that Florida has little in the way of citizen's arrest laws.
    If I was the cameraman I would have told the officer I am making a felony citizen's arrest...there is some allowance for such in Florida but the rules are sketchy.

    Get and read a copy of C.P.D.'s off duty employment policy. I would bet that it says that all police enforcement actions are solely the responsibility of the officer. The off duty employer cannot influence the decision of the officer and to due so would void the contract. If C.P.D.'s policy doesn't say something like that then the city needs to stop off duty employment.

    ACCORDING TO THE UNITED STATES LAW, HAMMER GUY MUST BE CHARGE WITH ATTEMPTED ASSAULT, HENCE, HE CAME AT YOU WITH THE INTENT TO HURT YOU. SINCE HE HIT YOUR CAMERA, YOU CAN CHARGE HIM FOR THE DAMAGE OF THE CAMERA. YOU CAN ALSO CHARGE HIM AND THE COP FOR TRYING TO DESTROY THE VIDEO EVIDENCE. THEY CANNOT STOP YOU FROM FILMING IN THE UNITED STATES. GO TO YOUR POLICE DEPARTMENT AND TELL THEM WHAT HAPPENED. FIND A LAWYER TOO AND FIGHT THEM WITH THE LAW. • @maverick4220
    @maverick4220 5 років тому +1

    Does it not come under Aggravated assault? Aggravated assault involves more serious actions, such as an assault that is committed with the intent to cause a serious bodily injury, or an assault that is committed with a deadly weapon such as a firearm.Aggravated assault is typically classified as a felony offence.

  • @vatodad
    @vatodad 6 років тому +1

    This is ridiculous. An officer can arrest for a felony that was not committed in his presence. That is true irregardless of the videotape. Given the content of the videotape it's not just aggravated assault as he made threats to your life that is actually a assault with a dangerous weapon at the very least and more practically assault with a deadly weapon. Both of which are felonies and our arrest of all crimes at that point in time. The only time they hesitate is if there is a need to gather additional evidence. That is certainly not the case here as the evidence is quite clear that you were in a public right-of-way at the time of the attack. The fact that you struck the cameras are relevant because he made the threat on your life or on your person. This officer should be reprimanded at the very least and actually should be fired as he is certainly acting as an agent for Scientology and not an objective police officer. What a mess! Clearwater has been taken over by an evil called and you have clear evidence of that. This needs to be taken immediately to the mayor, the city council, the chief of police, and the State Attorney General. All of those different people and or organizations should be deeply concerned about what is transpiring with the police department. Given the controversial stance of the Scientology church and the fact that they're at war with the city of Clearwater, the city has dew claws to deny any police officer the option of working for Scientology off duty. Any time such employment can cause conflict with their activities as a police officer, the city has the right and actually the obligation to stop the employment. This is actually an easy one. If you look at the other video where the guy with the pizza shop refuses to serve a person after a Scientology guard goes in the restaurant and tells the owner to not serve him and this person who I assume is an SP contacts the police were standing right next door oh, the police do absolutely nothing. There's no question but this these officers are not being objective. It's a disgrace. Clearwater has always had a bad reputation and I'm talking about the last 30 years. It seems like it's just getting worse.

  • @yvettetubberville944
    @yvettetubberville944 5 років тому +1

    Can you believe this video. This is such a blatant miscarriage of justice and seems to be a conflict of interest to be involved with any other job where he is supposed to protect and serve. Now the officer has placed himself on the wrong side of his oath and is protecting the aggressor because he accepted a paying job outside of his sworn oath to be a protector. Hence, conflict of interest. Also that man that came up to the gentlemen with the camera had no right to strike man because he was filming, he had no expectation of privacy on a public street or sidewalk. And my comment to the cop is do your fucking job, choose a side, oh yeah, I guess he did right. If I was his boss I would tell that dick, hope the money was worth it, I can’t trust your judgement to uphold your oath, pack your shit, get gone.....

    If somebody’s charging me with a hammer I will do everything in my power to defend myself. I usually carry a Taser and I have police grade pepper spray. The Camera is an extension of your body. He hits the camera he is committing battery. I would take the video to the police department and swear out a warrant on the guy.

    You were holding the camera in your hand. It would be like "saying I wasn't striking at his face. I was striking his glasses".

    File a PRIVATE PERSON ARREST. you can press the charges, don’t leave it up to the lazy one sided cops. NO! anything on your person is a part of you.

    Compromising police officers by "hiring" them for off-duty $ecurity is the same trick drug dealers use at their legit business -- what cop who's doubling his income will turn on his part-time employer?

    So Clearwater PD works for and obeys Scientology not the citizens. You have a constitutional right to video on a public sidewalk. WTF is wrong with these cops.

    In situations like that you can take it to the state police.
