One of the Attorneys, who sounds like an older man, is not familiar with Zoom calls has a kitten filter turned on and didn’t know how to turn it off. The Attorney explained that his Assistants daughter had been on his computer and had apparently left the filter on. He at some point tells the Judge and the other Attorney that he was prepared to go forward with the Zoom hearing with the filter and says “I am not a cat”. The blood relatives are always sought out as fosters, even if they are not licensed to foster. If the relative can't complete the training, the training will be waived. If all blood relatives for whatever reason refuse to take the kids, then a relative without blood relations will be sought. The Minnesota system will always, always give kids to family, and those _are_ referred to as foster parents. Nick's dad is noted as speaking in the Juvenile hearing, but not listed as being present. That means he's probably the unknown foster parent.

The family members are still considered foster parents for all legal purposes. They're given the same compensation as any foster parent would. It's not just a Minnesota thing either. That's the way it is everywhere. We were foster parents to my husband's great-nephew. We still had to report to and get permission from CPS for everything. Once a child is the ward of the state, no matter who they live with, they're always a ward of the state until returned to the parents or officially adopted. Age of consent in Minnesota only applies to those that are within 3 years of the 16 year old, that are also at the age of consent, outside of Romeo and Juliet situations where they are a little further apart but started dating while attending high school together. An adult aprils age cannot legally sleep with a 16 year old. The law in Minnesota is actually very similar to the law in my own state.
Not allowing CPS into the bedroom is a huge red flag. It's worse than it already is. My theory: Nick IS going to insinuate that the coke is Kayla's, but NOT because he wants her to take the fall. He's going to blame her and instruct her to blame him. In theory, neither get charged because both provide reasonable doubt to the coke's ownership.
@@TabbyTimeOut Why? It makes sense, and it's the only reasonable approach if they're going to fight the charges and it doesn't get tossed on a 4th amendment technicality. To charge someone with possession, you have to prove beyond a reasonable doubt that THAT person had possession. If all parties blame each other, and can create reasonable doubt regarding their own involvement, they might be able to avoid charges.
The Prosecutor will be questioning witnesses. Arron knows the situation also April will be fully deposed and she will face charges if caught lying to the court. Kayla and Nick cannot be compelled to testify against each other because they are married. Now that Arron and April are divorced they can be compelled to testify against each other. They have Arron, April, the 5 kids and the Nanny that we know of who have first hand knowledge of what was going on in the house. They will also do DNA testing and finger print on the drug paraphernalia. They should be able to establish who was using the drugs and who they belonged to with all that!

There are at least 2 witnesses (Aaron and April, possibly the children) and incriminating video against Nick (powdered nose on livestream). There are other witnesses towards his and Kayla's change in behavior that indicate long term usage (church and community members). Aaron supposedly also has incriminating text messages. Plus the concept of joint ownership, ie they both possess it. All in all, in what world would an average person buy that it's not the property of either of them?

The blood relatives are always sought out as fosters, even if they are not licensed to foster. The Minnesota system will help the blood relatives complete the foster training while already homing the kids with the relative. If the relative can't complete the training, the training will be waived. If all blood relatives for whatever reason refuse to take the kids, then a relative without blood relations will be sought.
The Minnesota system will always, always give kids to family, and those _are_ referred to as foster parents. Nick's dad is noted as speaking in the Juvenile hearing, but not listed as being present. That means he's probably the unknown foster parent.
@@TabbyTimeOut I'm tired of explaining this. Children are placed with relatives if it's possible. As in one will take them. They are still wards of the state and under the supervision of CPS. The family members are still considered foster parents for all legal purposes. They're given the same compensation as any foster parent would. It's not just a Minnesota thing either. That's the way it is everywhere. We were foster parents to my husband's great-nephew. We still had to report to and get permission from CPS for everything. Once a child is the ward of the state, no matter who they live with, they're always a ward of the state until returned to the parents or officially adopted.
Edit: My husband's great-nephew was taken custody of in Canada and was still placed with us in Arkansas because we were the family member willing to take him. That's the length they go through to place them with family if one will take them. It did take 2 years, but not because of CPS. He was a member of a Native tribe and I had to be able to prove my Native heritage for them to allow him to be placed with us. His mother was part and his father was part and they require any children to be placed with Natives. I was the only member, other than his mother, that is. The tribe had to approve and then we were adopted into the tribe in a ceremony. I wasn't officially a member of any tribe, so they adopted me to get around their requirements.

My theory: Nick IS going to insinuate that the coke is Kayla's, but NOT because he wants her to take the fall. He's going to blame her and instruct her to blame him. The strategy is for each of them to provide enough reasonable doubt that it was theirs; he says it's hers, she says it's his. In theory, neither get charged because both provide reasonable doubt to the coke's ownership.
That's a pretty dumb theory.

To charge someone with possession, you have to prove beyond a reasonable doubt that THAT person had possession. If all parties blame each other, and can create reasonable doubt regarding their own involvement, they might be able to avoid charges.
The Prosecutor will be questioning witnesses. Arron knows the situation also April will be fully deposed and she will face charges if caught lying to the court. Kayla and Nick cannot be compelled to testify against each other because they are married. Now that Arron and April are divorced they can be compelled to testify against each other. They have Arron, April, the 5 kids and the Nanny that we know of who have first hand knowledge of what was going on in the house. They will also do DNA testing and finger print on the drug paraphernalia. They should be able to establish who was using the drugs and who they belonged to with all that!

There are at least 2 witnesses (Aaron and April, possibly the children) and incriminating video against Nick (powdered nose on livestream). There are other witnesses towards his and Kayla's change in behavior that indicate long term usage (church and community members). Aaron supposedly also has incriminating text messages. Plus the concept of joint ownership, ie they both possess it.

I'd bet this is Nick's idea. Do you have any idea how often that's been tried? Almost every single time. It's never worked. Both usually end up convicted. How is he going to get past fingerprints and the evidence on his streams? It's as brilliant as hanging anything on the warrant being tossed. Edit: Possession is who owns the property. If it's in your car that's in your name, you're in possession no matter who put it there. You're legally responsible for what's on/in your property.
