  • Darrell Brooks returned to the courtroom against his wishes, where discussions about jury instructions in his trial for the Waukesha Christmas parade deaths resumed. Brooks complained that he doesn't understand the legal issues and that the judge is being biased by continuing with proceedings despite his confusion. The judge noted that Brooks has made many comprehensive legal arguments that show he knows exactly what is going on.

    It's so abundantly clear his entire strategy is "behave like such an asshole I bait the judge into snapping and get a mistrial." I'm glad it didn't work. Kudos to that judge.

      I don't think he had one particular strategy. Like a obstinate child, he jumps from point to point and then gets fixated on one. In the back of his mind he things the sovereign citizen nonsense will get him off. You can see his face when the guilty verdict comes in. He had real hope of being acquitted.

      Surprise! It took then three hours to convict him. I bet it took 30 min but they chatted and had one last free lunch just to make it look better.

      The judge handled Brooks' constant provocations masterfully.
      When she did take the bait, she'd explain to him, like a kindergarten teacher to a misbehaving toddler, exactly what he'd done and how that was hurtful/disruptive. By explicitly calling out his bad behaviour rather than responding in kind, she foiled his attempts to play the victim.

      I don't believe it was his strategy to behave like an asshole in an attempt to bait the judge and get a mistrial. I don't think he is intelligent enough to come up with that strategy, or any strategy at all for that matter in regards to the trial. I believe his behavior was merely to stall and interrupt as much as possible. I am sure as a child whenever he wasn't getting his way he would throw these type of tantrums until he got his way. Whoever he would argue with (his mom, his grandmother, a teacher, a girlfriend) would simply give up because it wasn't worth the fight. This trial, however, was worth the fight to Judge Darow.

      The judge understands what she is doing even if the defendant does not. Her patience is going to bury him in the review of this trial on appeal. I guarantee that a higher court judge will mention her patience with the defendant as a plus in her handling of this trial and her decisions against him.

      Chief Judge Dorow held his hand right across that finish line lmao and Prosecutor Opper kicked his butt up on the winners podium! First place, off to jail with you forever and amen.

He was out and free in the world, visiting his brainwashed girlfriend whom was in a battered womens shelter... Owing child support and not registering as an offender. He was free. It took all of this for him to discover that he shouldve tried to be some crappy lawyer in real life. Now he has no life, at all.
      Like the Judge said lol " The hopes and dreams your mom, and grandma had for you... All of that is gone."

      It's a common semantic trick SC do. They think saying yes to "do you understand" means that you "stand under" the authority of the person asking the question. That's why he says he doesn't understand.

    He stated what his ultimate belief and issue is: “you can’t make me do anything.” He’s still trying to control everything and he’s getting desperate. I am curious if he genuinely thinks that his “consent” is required by law.

      I have listened to him quite a bit during all of this. He seems to have latched onto something he has read and thinks he is on control of the situation. His arguments are childish and his behavior is as well. This judge has the patience of Job to put up with it however I also believe she is wise as someone else has mentioned for allowing this to be televised and going well above and beyond to give this man every opportunity to take full advantage of his rights both as a defendant and as counsel . He will appeal that he had no idea what was going on in the courtroom .

      I mean, he “saved” himself a couple days of delays. He was still going back to a jail cell every night of the trial. Even if he magically got a mistrial, he wouldn’t be free. He’d be in lockup until the next trial.

Given the clear danger of DB to the community, however, we may expect he will never again taste freedom or liberty, and much less social normality.       He has never been fully punished for the wrongs he committed.
      Since his mother let him get away with being a total reprobate as a youngster it should have been done by juvenile court. It’s crazy that someone this evil has slipped through the cracks of decency and been allowed to spend more than 20 years being a criminal.
      Spending the rest of his life incarcerated is the best thing for the public. It’s a shame that it will cost taxpayers millions of dollars for him to live. It’s too bad they don’t have the death penalty.

      You cannot permanently waive counsel see Faretta v. California… it only applies to the current proceeding. The Judge has to do an inquiry at each proceeding if he still waives counsel. A mistrial could occur if he invokes his right to counsel and he does not have an attorney present. Unfortunately double jeopardy would be in effect because the jury was already sworn.

      Isn’t faretta a force counsel/ competency to self rep case? He can’t invoke right to counsel until a jury verdict or another end to proceedings. On appeal him might bring these issue to light Ito of a fair trial. I am not sure what’s meant by invokes the right to counsel and has to have one present to avoid a mistrial.

      @@hbotes5646 The Court abused its discretion by failing to provide "standby" counsel..... That is why he is able to act like this because the judge realized she royally messed up by putting her feelings in this. All he has to do is invoke his right to counsel and this case unfortunately would be declared a mistrial and barred by double jeopardy because of the Judges "bad faith" conduct. He can invoke his right to counsel at anytime. If he had "standby counsel" the trial would be able to proceed.... since hi was removed it would abruptly halt the trial. All defendants are ENTITLED to a fair trial and effective assistance of counsel. All attorneys are licensed by the "BAR" and has ethical duties.... they cannot be appointed in the middle of a trial with no preparation and would substantially violate his due process rights.

      Absolutely true. However Dawn Woods in a few ways put the bus on top of DB. While criticizing the government.
      She said he had not held a job more than one day.
      She said as a child, he was medicated.
      She said 'once someone becomes an adult, refuses to keep a job and carry insurance on themselves, take care of their own health, the government doesn't care.'
      'The governor needs to intervene and care about the mentally ill people.'
      That's admitting he is a bum and it's the government at fault for not giving him drugs.

      It's not that he doesn't understand. To say that he "understands" it is to admit that he stands under the court's authority, which is why he says things like "I'm aware" or "it's clear to me".       @@juniordixie9489 hell nah! The judge is very intelligent that's why she allowed and afforded every opportunity that a typical attorney wouldn't have had. Obviously, I am not an attorney but I don't think she made any mistakes. An appeal can only happen if it's determined by the appellate judge that some law or procedure wasn't applied properly or equally by the trial judge. This is why he made several objections on the record, all of which were over ruled by the trial judge. The only mistake she might of made was allowing this fool to represent himself in the first place but it's his right to do so. He's dangerous but not educated in case law and procedures. However, he's clearly insane and if there's a good enough attorney that is willing to take on the case, it may be possible for him to get a lesser charge on appeal, say murder 3. I doubt he planned this or that it was his intent to kill anyone.
      But see these are things an experienced attorney would have argued during the trial.

      @@fasteddy44642 I was not saying that at all, I feel a male judge would have been better. He treated this woman judge as he treated woman all his life. Yes she could let him ramble on a bit but not for 50 mins. Sue Opper even told her you are in control of this court room not Mr. Brooks. And when she repeated herself 25 or more times there was no need, 5 times maybe but not 25 times or more in different ways. He is not capable of comprehending the Law so yes she should have done what she needed to do but not to this extent and she still would have prevented a mistrial.
      But the way I am a court reporter so I have seen a lot in 30 years and no I never will get scammed .
