  • matapos ang mahigit 4 na buwan na emergency/unpaid leave, hindi padin ako terminated. kaya pinag reresign ako ngayon.

    Dre ano ba ang nangyari sa inyo? Diba kung ikaw ang umalis, e di resignation yun? At kung tinanggal ka naman, terminate naman tawag dun. Hindi naman ata complicated maintindihan yun. Yung mga benefits na binabanggit mo e by law yun para may equal rights for both parties. Pero kung hindi ka na pumasok since September at hindi ka nagpaalam e Absence without Leave (AWOL) yun, tama lang na mag resign ka dated September.

    I vowed when I was young I would never accept EI so long as I'm able to find work. I always found side jobs like washing dishes or security guard at night while looking for a Permanent job. I believe EI should be for people in dire situations (single parent with kids) and difficulty finding work (uneducated or disabled with less skills). I never wanted to take advantage of taxpayers hard earned money. That was my thinking and I carried that with me all the way to retirement.

    Instead of thinking of loopholes in labor or other laws, focus on being gainfully employed, being a good employee and advancing on your career.
    Being “wais” has its limits and frankly nakakahiya in some situations.

      Tama ka jan @krissylopez37. Instead of focusing on how he can land a better job than what he abandoned, he’s focused on getting that EI benefits instead. Not thinking that if he gets terminated with a cause, his EI can be denied. At pangit pa record nya. He shld be thankful he’s given a chance a graceful exit after his 4months vacay. The company can see his “emergency leave” reason/excuse, for going home again just after 1-2 months ago when he had his 3wks vacay. He’s thinking he is entitled. “wais move ba ang ganyan?”. 😓

    Kung pinagre-resign ka eh di ibig sabihin eh employed ka pa. Saka ka na mag-resign Dre, siguraduhin mo muna na may kapalit kang trabaho na may benefits. Malaking bagay yung Security of Tenure at Employee Benefits. Kapalan mo mukha mo at pumasok ka ulit hanggang ikaw yung mismong ready na mag-resign o i-Terminate ka nga nila. Mas malaki pa ang makukuha mo at takot ang mga kumpanya sa Illegal Termination kung mag-kaso ka sa kanila pero wag mong paabutin sa "Termination due to abandonment". Wag pairalin ang pride at di naman nakakain yun maliban kung "pride chicken". Pag nag-resign ka na walang kapalit na trabaho eh talo ka...

    Resignation is better than termination on your records. It’s harder to find a job if you are terminated. You really don’t have a fight because you did abandon your job. You can’t make any excuses because all they have to do is watch you vlogs from the time you
    left Canada and went to the Philippines. There was even a vlog while you were there and you were bad mouthing your company. I was going to say something but, I thought it’s a waste of time since you left them already. You can bad mouth them in private but not on social media. You’re lucky that they are giving you a chance to keep your records clean by asking you to resign. You were a hard worker and maybe they were thinking about that too. Just humble yourself and accept the consequences of your actions and learn from it. Reminder too that your future employer might call them for reference. Good luck on your next journey and praying that God will give you the wisdom and guidance to any decisions you make for your family. Take care.

    Praying for your aircanada application sana you'll be accepted. Better to resign than be terminated, regardless of the reason. Or stick to them, that is if your still welcome to their company. Kasi four months ka din here sa Pilipinas.

    I worked in HR for over 10 years in Ontario (keep in mind in the Learning and Development Department, but still in HR). In QC, if they are asking you for a letter of resignation, they have most likely missed giving your notice of termination. If they didn't provide you this notice, you may be entitled to some severance. Not 100% sure, but from looking at QC laws, you may be entitled to 2 weeks of severance (Indemnity in QC).

      In Ontario, the laws are much more different. Job abandonment is considered a terminable offense and does not qualify for EI or any form of severance. You will only qualify for severance in the scenario you cannot work due to health or was laid off (due to no fault of yours).

      @@Thejazzerc sa case nya nag leave lang sya for 2 weeks then umuwe sa pinas almost 6 months doon nag stay, kung ako company nyan AWOL na yan hahaha panget ng work record mo dre kahit gano kpa matagal nag serve sa company kung ganyan ginawa mo bad shot ka, mabuti pa nga binibigyan ka ng resignation option

    Talk to a labor lawyer Dre. If ng pa alam ka for your indefinite leave of absence, i think its not a ground for termination. If ako sa yo, ask the management that you are willing to go back, if you are really willinf and please tell them the exact reasons of your absence. For sure they will take you back. Magaling naman kang empleyado. Good luck sa yo Dre.

    Dre almost all comments makes sense and are all legit kaya at the end of day your the one making decisions. I think you should get advice from a counselor or whoever is qualified because this might affect your applying for a new job as they might require a reference.

    Dre silent viewer mo ako for almost 2 years now. I admire your videos kasi I was aspiring to go to Canada din. Just like you OFW din ako and naiintindihan ko ung hirap ng buhay bilang isang OFW. However, with your current situation, I think you're on the wrong side, not to mention you are putting the company in a compromise position. Just have the decency and dignity to accept your fate due to the not so wise decision when you left your post and abondoned your responsilities since Sept. Just my 2 cents dre, just exit the company with dignity. Just keep your head down in this instance, hindi ka naman nilalamangan ng previous company mo.

      @@ricevelasquez Ma-abilidad ka dre, hanga ako sayo sa dun. madali kang maka adopt ng bagong skills kahit walang formal training. Tuloy mo lang kung ano man ang plano mo ngayon na nakabalik kana sa Canada. Hindi masamang mangrap dre, tanggapin mo man at hindi maraming pupuna sayo kase isina publiko mo ung bahagi ng buhay mo. Kunin mo ung mga positibo na comment na makakatulong sayo at itapon mo ung mga basurang comment. Basura nila yon na pilit na ibinabato sayo. At the end of the day buhay mo yan anuman ang maging resulta nang desisyon mo ikaw lang din naman ang makikinabang. Napansin ko kasi medyo naapektuhan (correct me if I'm wrong) kana sa mga negative comments kaya mo pinapalagan na. Again dre, basura nila yon huwag mo pulutin.     Just want to clarify dre...do you file emergency leave before ka umalis nung September? If not...that means AWOL ka...ung cnabi sau na file resignation as of that date you left is just for courtesy lng at the same time favor din sa kanila (that is they won't pay you anything like termination pay etc & at the same time no bad record for your employment history)...likewise if they terminate you for abandonment, bad record un sau & wla ka rin makukuha ni isang kusing...dapat you documented everything before you left...prame laban ka ngaung bumalik kna...pwede kang baligtarin ng employer mo lalo na kung wlang Union yang company na pinasukan mo...I think it's better to consult a person expert in LABOR LAWS...wag padalos-dalos sa ung final decision...advise lng po😊

    Sa play-time na 1:34, binanggit ni Rommel na merong exchange of e-mails about him taking a “special leave” for whatever reason. A company will not go out of their way to give a common employee a favor, in a way that the said employee can get benefits from the company if they can get away with it. If the employer is asking a resignation letter from Rommel that means they have a weak reason to terminate without benefits. Sa hirap ng paghanap ng magandang trabaho, lalo pa malapit sa bahay mo, if you have a choice KEEP YOUR JOB ROMMEL. Untill you find something BETTER 😊

    dre if u still want to work with them just do it and if not best way is to be honest with what u need to do. just be grateful with the opportunity and dont focus with the money that ur going to get coz u also affect their operation so to speak due to ur absence as part of their daily work force that they need that is why u were hired 5 yrs ago.

    Sa US same thing if you get terminated or fired i am sure you will not get unemployment benefit but if you get layoff from work due to a valid reason then you qualify for benefits

    Better talk to them directly and tell them directly the situation you are in, wag kang matakot magtanong at itanong bakit need mo i date ng resignation date mo nung umalis ka, Let them clarify that para yan din gamitin mo evidence if may lapses sila if meron man kayong hindi pagkakaintindihan, itanong mo nalang din lahat including un used vacation leaves etc... kasi kung makikipag patintero ka kung ano iniisip nila baka matalo ka sa patintero at lugi ka,
    Wag kang matakot mag tanong sa HR nila.. tutal sabi mo 5 years ka na sa kanila walang rason at matakot or mahiya ka magtanong...

    Dre depende sa termination code na ibbigay sayo ng employer mo at may tinatawag na termination "with cause or without cause " pag ginamit ng employer mo ung with cause wala ka makukuha sa e.i, pwede ka mag e.i kung sabihin ng employer mo laid off ka or shortage of work etc. Pero kung gamitin nya no show ka sa work tingin ko hindi ka makakapag e.i (sa tingin ko lang) better to call service canada. Sa employer mo naman kung gamitin nya ung with cause wala ka rin makukuha sa kanya pero depende sa employer Dre. Sana makatulong

    Dre eto ang advise ko siguro final, just start fresh and when you left for Pinas you never thought about EI, para kasing maraming pagkukulang on your side i am not discouraging you, my only worry is what if the company your applying for like Air Canada ask for reference. Kaya just ask a good reference letter from your employer and start fresh forget EI kikitahin mo rin iyang pera

    I understand what you mean.. I live here in Montreal for 20 years, I think Kaya ka nila pina pag resign dahil ayaw nila mag bayad sayo. Pero kng layoff ka or terminated pwede k mag apply for EI, iyon eh kng ayaw mo pa mag work or your still looking for a job. The best thing to do is mag resign ka n lng, don’t expect n I te terminate ka nila. They are smart people they don’t want to spend more money na hindi sila nag be benefit, And it’s all up to you if you still want to apply for EI. But you will not be getting more on EI. God bless

    6:37 I believe your employer is trying to save you from a disgraceful exit. That’s very noble of them to do so considering the situation. If they’re offering you a chance to resign, and you don’t feel like coming back, then the decent thing to do is, give them the resignation letter, and exit with nobility. It’s a good investment of action for your next employer who may ask for reference.
    PS. I could be wrong but quitting or justified termination from a job will hurt your chances of getting unemployment benefits.

    Dre baka kaya ka pinagre-resign ay ayaw ka nilang i- terminate for cause. Iniisip pa rin nila siguro what is best for you. Kasi kung hired ka pa rin di sana tinawagan ka na nila to work. Pag termination for cause at proven naman eh hindi ka makakapag EI. Mag kaka bad record ka pa. Also true na pag nag resign ka di ka din makaka EI. I am making these comments based on the Employment Standards of BC. Hindi ko sure kung ano an sabi dyan sa QC. Take this with a grain of salt. Regards and keep vlogging! Shout out naman 🙂

    Kung na terminate ka, sasabihin ng kumpanya mo na nag AWOL ka, 2 weeks lang ang pa alam mo, 6 months kang nawala gMasama yun para Sa susunod mong aaplayan na trabaho. Kung naterminate ka na hindi mo kasalanan, halimbawa; Wala ka ng Gagawin or nalulugi ang kumpanya o nagbabawas ng trabahador, ayon pwede kang mag EI. Ang advise ko Sa iyo, huwag mo ng isipin pa ang maging “wise guy” dahil Sa dami ng mga nakapanood Sa iyo dahil diyan Sa EI na yan, sigurado ako ,marami kang mga bashers diyan, isusumbong ka sa gobyerno. Payong kapatid, magaling at masipag ka naman marami pang trabaho Sa iyo ay naghihintay.

    wag masyadong sigurista dre! better pa ren ang resign kesa terminated, kase pag nagapply ka ulit ng work kahit saan kapa then may nakita sila sa record mo na terminated meaning pa ren non bad at madami kang demands sa company kaya ka tinanggal nakikipaglaban ka sa company whick is not good, hinde magandang impression yon sa kahit na anong company na aaplayan mo, anong gusto mo bad impression ka sa mga aaplayan mo o hahabulin mo yung kakarampot na compensation na makukuha mo sa terminated situation mo? kaya dre makinig ka sa nakakaraming opinyon mas better ang resignation kesa bad referrence sa resume mo na terminated ka sa work mo before, HR assistant ako before at kami ang namimili ng mga resumes na iiscreen for interview pag nakita ko agad sa resume mo na may terminated history ka no questions ask di ko na pipiliin yung resume mo sa pool ng mga nagaaply, sobrang daming mas deserve sayo na malinis ang record kesa may history ka ng termination, sa way of thinking kase ng HR mareklamo ka or may poor attittude sa work performance kaya sa umpisa palang di na agad pipiliin yung resume mo ganun yun Dre kaya mas okay p ren ang resignation, pera lang yan wag mo hangarin yun kesa sa pumangit ang work history mo. wag mo masamain dre charge to experience yan kung tutuusin nga naman AWOL kana talaga pero resignation pa ren ang kinoconsider sayo para same kayo na win win situation, pareho kayo may benefit ng company, wag mo na hangarin yung termination charge panget ang reputataion ng termination mas okay p ren ang resignation.

    Mr Rice, if ur not yet terminated, just go back to work, more $$$. stop messing with your mind if u can get EI or not. Case to case basis if eligible ka & entitled ka for that EI benefits. Suerte ka if dika pa terminated up to this time & their giving you a chance to resign. If not u might be considered AWOL dhil halos 4mos ka nka-vacay sa pinas. Resign ka nalang after u have found your dream job na hindi mahirap, malaki kita, maganda benefits including unlimited vacation leave anytime.

    Dre, Sa pag file ng EI pag na Terminate ka with "cause" or at your own fault like nag awol ka, nakipag away or dis-subordination hindi ka basta -basta qualified sa employment insurance kasi pag nag file ka e-explain mo bakit ka nawalan ng work at pwede nila e disapproved ang application mo, pero pag lay off dahil humina ang business need nila magbawas ng tao madali ma approved sa EI.

    Dre !!! mag resign ka n lang, both ways are good , 5 years is nothing. If u ask for compensation, atleast pag nag resign k pwede k p maka hingi ng reference s kanila pag nag apply k ng ibang work , it's against the law and HR to say bad things about you by company., 18 years n s company and how many times n ako mag quit or resign but still in company, good luck

    Dre Resign na lang cguro. Para at least if may bagonka apply at hingan ng reference eh meron ka iprovide. Pero siempre depende sa relationship nio ng employer mo. Kung terminated kasi, may ground b sila para iterminate ka?

    Sir sa tingin ko dahil maganda siguro yung record mo sa kanila. Binibigyan ka ng important yan kaya ka pinareresign ka. Kasi pangit yung naterminate ka. Wag mong pagisipan nang masama yung company mo. Ginusto mo naman na magbakasyon ng matagal di ba. Hindi worth yung konting halaga na iniisip mo. Payo lang sir.

    Dre ang pagkakaalam ko pag nag file ka nang leave of absence , hindi ka pweding alisin kaya ka nila pinag reresign. Dahil pwedi mo silang balikan pag inalis ka na naka leave of absence ka.     Mr Rice, The question is, after your two weeks emergency leave (?) are you still on approved leave of absence? If not u can be considered AWOL. Your company can justify their decision if ever. Iyang pag ask nila syo to resign is giving you a chance to have a good exit at reference for your next job. Kahit saan ka mag apply they will verify your 5yrs work experience. Think about it.

    Dre...dito sa US, if your company has pension plan, 5 years of service, vested ka na...materminate ka man o you resigned, sa yo na yun. doon naman sa which is better Terminate o resign..since you said na mas malaki makukuha mo and you're willng to take the risk eh magpa terminate ka na lang. If they will terminate you, most probable na reason will be AWOL . Ang bad side eh, If malalaman ng company na pag-aaplayan mo, it will not look good, regardless if valid yung reason mo other than Medical reasons. AWOL is a sign of irresponsibility. Although dito sa US, Companies can't divulge the reason/s why you were terminated but in your case, dahil may vlog ka, they won't even have to ask your former company....if they do an extensive background check - like sa transportation company especially sa airlines....malalaman nila ang reason unless na idelete mo yung mga videos...lol. Honest opinion, just resign...wag kang masilaw sa makukuha mo...if you decide getting terminated, it will bite you later on in life...good luck

    Dito ang Law sa US pag gusto nila na mag resignka dahil wala na silang obligasyon sa iyo sa mga benefit na makukuha mo ag wala silang obligasyon na i share sa Insurance pero pag nag terminate sila ng tao may obligasyon o share sila na babayaran sa insurance i am not sure how many percentage may be 60/50 or 50/50 kausapin mo ang Co. mo kung puwede ka pa ng bumalik kung sinabi na hindi na consult a lawyer to your situation

    For formality nlng yun. Mag resign ka nlng. Iniwan mo sila sa ere na walang paalam tpos mag expect ka pa ng benefits. Instead na iterminate ka nila binigyan ka nalng nila ng chance to resign for your good exit. Mas pangit pakinggan kung naterminate ka kesa yung nag resigned ka.

    Wag ka mag resign let them terminate you. Kasi di ka makaka pag EI pag mag resign ka. Antayin mo na terminate ka para maka apply ka ng EI. Kasi ako na terminate last year July.

    Paano ka magiging entitled kung hindi ka nman talaga tineterminate dahil maayos ka nman magtrabaho? Ikaw ang nagdecide na tumigil magwork at nagpaalam ka pa ata na magbakasyon ka lang.
