The person wasn't a "squatter" It was a renter that the home owner was trying to self-evict. The tenant came home to find they had been locked out of a property they leased, so they broke the lock off, which is 100% legal for them to do. This lady doesn't live at this house, she is the legal owner but not the legal detainer of the property. If the tenant had broken into this home and was an unlawful detainer, they would have been arrested. This is what comes with renting/leasing properties, If you rent or lease a property and you want the person out, you have to evict them if they do not leave wilfully. Those laws are in place to protect renters and leasers from bad landlords. And yes, It sucks when you rent/lease a property to someone and they don't pay their rent or they're destroying the place and you have to wait for a court order to evict them. That is EXACTLY why it's becoming harder and harder for people to qualify to rent or lease property. Most property owners now want you to have a credit and background check.

They were enacted to protect real people that were being victimized by greedy slumlords in the 70s and 80s , it was in almost every major city across the country, which is why so many states adopted these laws, it takes a lot of legislative work to amend the laws rather than remove them so politicians have been putting it off for years to change them bc of it, and removing them would be a step backward in landlord responsibilities and standards that we all are used to now

Okay well here is another for you I live outside of Atlanta I have a neighbor who comes onto my property get into my crawl space and enter my home and take control of my camera he had done a lot of damage on my property to my 3 cars but when I put a sign to my garbage can calling him out of his name guess who got arrested 8 days in jail for aggravated staking.
There are people who for a fee will remove those squatters. One way they do it is by moving in as another squatter and being absolutely impossible to live with.

The rules are skewed in favor of tenants/residents because landlords have a history of operating unscrupulous, a common issue in all industries is people behaving in a way which requires intervention.
Fortunately, the actual criminal in this case was arrested for her crimes while her victim was not arrested. The facts are very simple. First, this landlord previously called the police on her tenant and accused her of squatting. The police, at that time, issued a citation for squatting to the tenant which legally requires that they provide documentation, within 3 days, that they are renters and not squatting or they would be automatically arrested. This is a tough on squatting law since this means that those who have no proof that they aren't squatting will be arrested. But, if the person is able to provide documentation, to the issuing law enforcement agency, that they are tenants then the matter is automatically transferred to the Courts and a court hearing is held within 7 days to determine if the documentation proves that the person isn't a squatter. In this case, it was referred to the Court. Second, the Judge in that case found that the documentation provided proved that the tenant was actually a tenant and not a squatter therefore legal eviction would be necessary to get her out of the apartment since arrest for criminal squatting would be inappropriate for a tenant. This same judge then treated the case like it was which is an eviction and the Judge informed both parties that the judge was finding in favor of the landlord and would be evicting the tenant. The landlord was having none of that though and decided she's not going to wait for a judge to finalize the eviction and have the Sheriffs/Constables execute the eviction instead she decided: 1. To break into her tenants home and change the locks 2. The tenant then returns and had to force her way into a home she still had legal possession of 3. The landlord returns with a man and they force their way into the home while the tenant was harm and start removing her personal property 4. The landlord threatens to get her gun and kill the tenant if she didn't leave immediately 5. The landlord calls the police (on herself because she's dumb) 6. The police arrive and contact the court to ask them if the landlord had a writ of eviction and they told officers she didn't and the tenant still had legal possession 7. The tenant then shows the officers video of the landlord threatening to murder her if she didn't immediately leave 8. The officers then arrested the CRIMINAL for criminal trespassing and making terroristic threats The real criminal in this case is the one who would threaten to or kill a tenant who availed themselves of "due process of law" even though the landlord was actually winning. It is not the person who respects the Rule of Law and who actually avails themselves of the Rule of Law. It's not the tenant, who may be wrong even if they believe they are right, who appeals an eviction. It is the landlord who thinks they can break into someone's home, change the locks and then force their way into the home while the tenant is home and threaten to murder them if they don't leave immediately. Apparently, this landlord believed that she was the JUDGE, JURY AND EXECUTIONER and that actual judges aren't a judge, actual jurors aren't a jury and that Sheriff's aren't the actual executioners of a legal eviction. It's her. She is the smartest person on the face of the planet and if a tenant doesn't leave until the Rule of Law makes her then she will threaten to or actually kill the tenant who dared to defy THE ONE TRUE JUDGE, JURY AND EXECUTIONER OF WHO LIVES IN HER KINGDOM CALLED EARTH.
Yes, you are correct. Tenants have more rights than the actual home owner. They can tear up your property, break the lease, and not pay, without any accountability.
From what I saw in other posts she had been living there when the previous lease was in effect which makes her a resident so requires the eviction process.
We just went thru this. My sons mother passed in July. He inherited the house. The day after she passed we went to the house only to find one of her ex boyfriends was sleeping in the basement. We called the cops. The guy told the cops he had permission to stay there and they said they couldn't kick him out. This happened on July 18th, 2024, we JUST got him out less than two weeks ago. It took months and over $6,000 in legal fees. He trashed the house. Bashed up the walls, ripped copper pipes out, cut wires... we are forced to sell the house now. My son is 20. I was going to fix it up for him, but that's no longer a possibility. This is a huge problem. I can't understand why in the hell this is allowed or who in the hell allowed it, but homeowners are getting stuck, and the courts and the cops and everyone knows it's bs. I'm only 40s into the video so idk where this happened yet. I just heard the first bit and snapped. I feel so sorry for this lady. God bless you and good luck

That was happening here in NYS.They even had some type of agreement called “Cash for Keys.” The understanding was that if the squatters promised not to destroy the property once they DO vacate….the landlords would pay the squatters.The landlord goes in to inspect the property….if everything looks okay…the squatters turn over the keys and the landlord turns over the cash…right there on the spot.🙄Smdh. This is actually really simple. The “squatter” is clearly a criminal who unlawfully entered and damaged the property (b & e). The officer also committed several crimes including false arrest, kidnapping, and deprivation of rights under color of law. Both should be arrested and charged for their crimes.

This is an excellent point. I do not know the real story but if this accused squatter was already there, you have to go through the eviction process by law. Some of these squatters have experience in squatter's rights even though they are low life in my opinion they gone through the process many times. It is common for a squatter to move in with a family member and stay after the lease is up. You wish these squatters would work on getting a job and building a career instead of learning tricks to be a squatter.

Something not right about that story because earlier this year, GA passed laws making it super easy to evict squatters. As a landlord, I was super excited to see the law passing because its been a long time coming. GA passed the Squatter Reform Act, House bill 1017, this year. The bill states “Offenders will receive a citation requiring them to provide authorization of consent within three days. Failure to do so will result in arrest for criminal trespass. If documentation is provided, a hearing will be heard in Magistrate Court within seven days to determine if the documents have merit. False swearing and the submission of improper or fraudulent documentation will lead to felony arrest, removal and the squatter will be subject to additional fines to cover damages, back rent based on the property’s fair market value and up to a year in jail.” I know she said the judge isn’t following the law, so she should contact her reps and the state’s AG. She muddied the waters by trying to do this without the police. While I understand her frustration, because I would be infuriated, she has to follow the law, even if the trespasser doesn’t. Also, voting these judges out would be a great idea. News Nation should have acted like a real news organization and contacted the judge for comment. Also, you should have recited the law for the viewers because they don’t know there is a judicial process for removing squatters.

Yes, she was arrested for making "terroristic threats" because she was on video threatening to kill the tenant unless she leaves immediately and for criminal trespass because she did not have legal possession of the home. Under Georgia law, criminal trespass is defined as when someone "intentionally damages any property of another without consent of that other person and the damage thereto is $500.00 or less or knowingly and maliciously interferes with the possession or use of the property of another person without consent of that person." In short, she was arrested for "knowingly and maliciously" interfering "with the possession" and "use" of "property of another person without consent of that person." In short, she changed the locks to prevent her tenant, who still had legal possession< from possessing and using her property. She was arrested for terroristic threats because Georgia law defines it as "A person commits the offense of a terroristic threat when he or she threatens to: (A) Commit any crime of violence...With the purpose of terrorizing another..." The reason she was arrested for this is because she is on video threatening to kill her tenant, who had yet to be legally evicted, unless the tenant voluntarily left immediately. The choice was "leave now or die" and that makes it a terroristic threat. A person who was availing themselves of "due process of law" may be quick to stop opposing someone in a Court of Law if they are told "keep fighting me in court and I will end your life." This is why she was arrested, not because she was attempting to remove a squatter. In Georgia is is very easy to remove a squatter because the law allows police to arrest someone who is unable to provide documentation, in the form of a rental lease or rent payments, within 3 days of being issued a citation for squatting. This is something that also happened in this case, prior to this incident, because the landlord had called the police on the tenant previously and they had issued her a citation for squatting but she was able to provide such documentation and it was then automatically transferred to a Court to determine if she was a squatter or tenant and the Judge ruled that she was not squatting but a tenant and than it proceeded to treat it like a normal eviction case and she was going to be evicted. This landlord even knew that the Judge was going to be finalizing the eviction as soon as they were able to and that she had won the eviction so there was no need to go and commit the crimes of criminal trespass and terroristic threats. The police don't have a choice in arresting someone who is on video essentially saying "you leave or you die." In this case, they had contacted the Court and had been told that the tenant still had legal possession and the eviction was in the process of being finalized but hadn't yet. It was just a matter of time before she was out but now she is still going to be out but there are going to be criminal and civil consequences for the landlord as well. Three things will likely happen in short order: 1. The tenant will be evicted since the landlord had won the eviction (there was a temporary stay, automatically issued by a bankruptcy court, but the landlord should have asked for it to be lifted since bankruptcy judges almost always lift such stays since rental homes don't normally affect a bankruptcy case since it's not property owned by the petitioner). 2. The landlord will be convicted of making terroristic threats and criminal trespassing because you can't commit crimes and get away with it even if you believe you are right 3. The landlord will lose a civil case filed by the tenant for actual damages and punitive damages for an illegal eviction taking the form of "leave or die."

From what I remember, its a law from hundreds of years ago when settlers or others traveled away from their home for too long or died before coming back. It gave others the right to claim the home. This was not a case of a squatter. It's a very simple case and the landlord is a liar and mentally unstable person. Here are the facts: 1. The landlord had previously called the police on her tenant and accused her tenant of being a squatter 2. At that time, the police issued the tenant a citation for squatting which gave the tenant the legal 3 days to provide documentation of being a tenant or be arrested 3. The tenant was able to provide this documentation within those 3 days and the matter was then automatically referred to the Courts 4. A Judge then reviewed the tenants documentation to determine if she is a squatter or a tenant 5. The Judge finds that the documentation proves that the tenant is not a squatter but a tenant 6. The same judge then treats the case like the eviction it was and the Judge finds in the landlords favor (yeah the landlord was winning) 7. The landlord, being a narcissistic sociopath, decides she's not going to wait for the judge to finalize the writ of eviction and give her legal possession 8. She precedes to break into her tenants home and illegally change the locks on her tenant 9. The tenant returns to find herself locked out so she forces entry into her home 10. The landlord returns with a man while the tenant is home and they force their way into the tenants home 11. They then start to remove the tenants personal property and the landlord threatens to get her gun and kill the tenant if she doesn't leave immediately 12. The landlord calls the police (because she doesn't understand she can't commit crimes and have them side with her) on herself 13. The police arrive and reach out to the Court to find out if the landlord has a legal writ of eviction and legal possession of the property 14. The court informed the officers that she does not and the tenant still has a legal right to live there until the eviction is finalized and Sheriffs/Constables execute it 15. The tenant then shows the officers the video of the landlord threatening to commit homicide 16. At this point, the police have no choice but to not arrest the legal tenant who had the right to be there but to instead: 17. Arrest the sociopathic landlord who engaged in criminal trespassing and made terroristic threats against a tenant All while she was actually winning in Court. She just had to threaten to (or potentially actually do) kill someone because that person dared to avail themselves of "due process of law." This landlord was not arrested for trying to remove a squatter instead she was arrested for: THREATENING TO KILL A TENANT TO INTIMIDATE THEM INTO MOVING ILLEGALLY CHANGING THE LOCKS ON A TENANT This is why she was arrested for making terroristic threats and criminal trespass. Officers aren't going to arrest someone who a Court found was NOT a squatter but was a tenant and that a Court was in the process of legally evicting because that tenant wasn't breaking any laws. The person breaking the laws was the person who thinks she can go around committing trespassing and making terroristic threats in a civil dispute she was actually winning. I'm literally dealing with this situation right now, however I'm not the homeowner of the property. The house across the street from me is filled with homeless people due to the homeowner being deceased. There isn't power in the house and I don't believe there's water. We've called the police and nothing was done-they told us neighbors to call code enforcement. Code enforcement says they can't access the gate that they keep locked. The trash and different people all day and night makes me very uncomfortable. We've been trying to figure out what bank has the mortgage but it's so difficult. The same judge then reviewed the dispute as an eviction and informed both parties that the judge would be issuing a legal eviction in favor of the landlord 7. The landlord, being a narcissistic sociopath, decided she didn't want to wait for the judge to finalize the eviction 8. The landlord then proceeded to break into her tenants home and changed the locks 9. The tenant returns, finds herself locked out and force entry into a home she had legal possession of 10. She then proceeded to tell the tenant that she would get her gun and murder the tenant if the tenant didn't leave 12. The officers then have no other choice but to arrest the landlord for criminal trespassing and making terroristic threats What should have happened after # 6 was "judge finalizes eviction" and the Court Sheriff's or Constables would serve the eviction on the tenant and if the tenant did not voluntarily leave then officers of the law would forcibly remove her and/or arrest her for criminal trespassing since legal possession had been then been granted to the landlord. That didn't happen because a woman decided she wanted to threaten to murder people in a civil dispute that she was actually winning. Smart move on her part! Haha. You are about to get your TENANT, who you falsely believe is a squatter, removed from your house but you just can't wait for the Judge to get that done and you decide you are going to threaten to or actually kill a tenant because you are upset that she had the right to "due process of law." Your situation is very different because you are likely dealing with actual squatters and if you were able to get a hold of the owners those people would likely be out in a very quick manner, depending on your state. In Georgia where this happened, it would be three days since Georgia law gives alleged squatters 3 days to prove that they are tenants and not squatters before arresting them. Fortunately, this case is a reason why that's necessary since this landlord falsely accused her tenant of being a squatter and her tenant was able to prove that she was actually a tenant and then she then decided death threats were the way to go. The only criminal in the situation covered by this video is the landlord who engages in an illegal eviction by: 1) illegally changing the locks on her tenant, and 2) making terroristic threats to intimidate her tenant into moving I hope you get your situation resolved but don't think this mentally unstable landlord is similar to what you are dealing with. You are dealing with actual squatters and we need to get tough with squatters (like Georgia has done) but at the same time we can't allow mentally unstable property owners to threaten to kill actual tenants or falsely accuse their tenants of squatting to get them arrested.

Squatters are just there, against their rights, with nowhere else to go.

The person wasn't a "squatter" It was a renter that the home owner was trying to self-evict. The tenant came home to find they had been locked out of a property they leased, so they broke the lock off, which is 100% legal for them to do.
This lady doesn't live at this house, she is the legal owner but not the legal detainer of the property. If the tenant had broken into this home and was an unlawful detainer, they would have been arrested.
This is what comes with renting/leasing properties, If you rent or lease a property and you want the person out, you have to evict them if they do not leave wilfully. Those laws are in place to protect renters and leasers from bad landlords. And yes, It sucks when you rent/lease a property to someone and they don't pay their rent or they're destroying the place and you have to wait for a court order to evict them. That is EXACTLY why it's becoming harder and harder for people to qualify to rent or lease property. Most property owners now want you to have a credit and background check.

They were enacted to protect real people that were being victimized by greedy slumlords in the 70s and 80s , it was in almost every major city across the country, which is why so many states adopted these laws, it takes a lot of legislative work to amend the laws rather than remove them so politicians have been putting it off for years to change them bc of it, and removing them would be a step backward in landlord responsibilities and standards that we all are used to now

Okay well here is another for you I live outside of Atlanta I have a neighbor who comes onto my property get into my crawl space and enter my home and take control of my camera he had done a lot of damage on my property to my 3 cars but when I put a sign to my garbage can calling him out of his name guess who got arrested 8 days in jail for aggravated staking.

There are people who for a fee will remove those squatters. One way they do it is by moving in as another squatter and being absolutely impossible to live with.

This is the problem with our Justice system. Criminals have more rights than the victims nowadays.
Fortunately, the actual criminal in this case was arrested for her crimes while her victim was not arrested. The facts are very simple. First, this landlord previously called the police on her tenant and accused her of squatting. The police, at that time, issued a citation for squatting to the tenant which legally requires that they provide documentation, within 3 days, that they are renters and not squatting or they would be automatically arrested. This is a tough on squatting law since this means that those who have no proof that they aren't squatting will be arrested. But, if the person is able to provide documentation, to the issuing law enforcement agency, that they are tenants then the matter is automatically transferred to the Courts and a court hearing is held within 7 days to determine if the documentation proves that the person isn't a squatter. In this case, it was referred to the Court.
Second, the Judge in that case found that the documentation provided proved that the tenant was actually a tenant and not a squatter therefore legal eviction would be necessary to get her out of the apartment since arrest for criminal squatting would be inappropriate for a tenant. This same judge then treated the case like it was which is an eviction and the Judge informed both parties that the judge was finding in favor of the landlord and would be evicting the tenant. The landlord was having none of that though and decided she's not going to wait for a judge to finalize the eviction and have the Sheriffs/Constables execute the eviction instead she decided:
1. To break into her tenants home and change the locks
2. The tenant then returns and had to force her way into a home she still had legal possession of
3. The landlord returns with a man and they force their way into the home while the tenant was harm and start removing her personal property
4. The landlord threatens to get her gun and kill the tenant if she didn't leave immediately
5. The landlord calls the police (on herself because she's dumb)
6. The police arrive and contact the court to ask them if the landlord had a writ of eviction and they told officers she didn't and the tenant still had legal possession
7. The tenant then shows the officers video of the landlord threatening to murder her if she didn't immediately leave
8. The officers then arrested the CRIMINAL for criminal trespassing and making terroristic threats
The real criminal in this case is the one who would threaten to or kill a tenant who availed themselves of "due process of law" even though the landlord was actually winning. It is not the person who respects the Rule of Law and who actually avails themselves of the Rule of Law. It's not the tenant, who may be wrong even if they believe they are right, who appeals an eviction. It is the landlord who thinks they can break into someone's home, change the locks and then force their way into the home while the tenant is home and threaten to murder them if they don't leave immediately.
Apparently, this landlord believed that she was the JUDGE, JURY AND EXECUTIONER and that actual judges aren't a judge, actual jurors aren't a jury and that Sheriff's aren't the actual executioners of a legal eviction. It's her. She is the smartest person on the face of the planet and if a tenant doesn't leave until the Rule of Law makes her then she will threaten to or actually kill the tenant who dared to defy THE ONE TRUE JUDGE, JURY AND EXECUTIONER OF WHO LIVES IN HER KINGDOM CALLED EARTH.

We just went thru this. My sons mother passed in July. He inherited the house. The day after she passed we went to the house only to find one of her ex boyfriends was sleeping in the basement. We called the cops. The guy told the cops he had permission to stay there and they said they couldn't kick him out. This happened on July 18th, 2024, we JUST got him out less than two weeks ago. It took months and over $6,000 in legal fees. He trashed the house. Bashed up the walls, ripped copper pipes out, cut wires... we are forced to sell the house now. My son is 20. I was going to fix it up for him, but that's no longer a possibility. This is a huge problem. I can't understand why in the hell this is allowed or who in the hell allowed it, but homeowners are getting stuck, and the courts and the cops and everyone knows it's bs. I'm only 40s into the video so idk where this happened yet. I just heard the first bit and snapped. I feel so sorry for this lady. God bless you and good luck

This is an excellent point. I do not know the real story but if this accused squatter was already there, you have to go through the eviction process by law. Some of these squatters have experience in squatter's rights even though they are low life in my opinion they gone through the process many times. It is common for a squatter to move in with a family member and stay after the lease is up. You wish these squatters would work on getting a job and building a career instead of learning tricks to be a squatter.

As a landlord, I was super excited to see the law passing because its been a long time coming. Yeah this was a rental property she owned, not her home that she lived in. She changed the locks on a renter to force them out and separate them from their belongings too.

GA passed the Squatter Reform Act, House bill 1017, this year. The bill states “Offenders will receive a citation requiring them to provide authorization of consent within three days. Failure to do so will result in arrest for criminal trespass. If documentation is provided, a hearing will be heard in Magistrate Court within seven days to determine if the documents have merit. False swearing and the submission of improper or fraudulent documentation will lead to felony arrest, removal and the squatter will be subject to additional fines to cover damages, back rent based on the property’s fair market value and up to a year in jail.”
I know she said the judge isn’t following the law, so she should contact her reps and the state’s AG. She muddied the waters by trying to do this without the police. While I understand her frustration, because I would be infuriated, she has to follow the law, even if the trespasser doesn’t. Also, voting these judges out would be a great idea.

Yes, she was arrested for making "terroristic threats" because she was on video threatening to kill the tenant unless she leaves immediately and for criminal trespass because she did not have legal possession of the home. Under Georgia law, criminal trespass is defined as when someone "intentionally damages any property of another without consent of that other person and the damage thereto is $500.00 or less or knowingly and maliciously interferes with the possession or use of the property of another person without consent of that person."
In short, she was arrested for "knowingly and maliciously" interfering "with the possession" and "use" of "property of another person without consent of that person." In short, she changed the locks to prevent her tenant, who still had legal possession< from possessing and using her property. She was arrested for terroristic threats because Georgia law defines it as "A person commits the offense of a terroristic threat when he or she threatens to: (A) Commit any crime of violence...With the purpose of terrorizing another..." The reason she was arrested for this is because she is on video threatening to kill her tenant, who had yet to be legally evicted, unless the tenant voluntarily left immediately. The choice was "leave now or die" and that makes it a terroristic threat. A person who was availing themselves of "due process of law" may be quick to stop opposing someone in a Court of Law if they are told "keep fighting me in court and I will end your life."
This is why she was arrested, not because she was attempting to remove a squatter. In Georgia is is very easy to remove a squatter because the law allows police to arrest someone who is unable to provide documentation, in the form of a rental lease or rent payments, within 3 days of being issued a citation for squatting. This is something that also happened in this case, prior to this incident, because the landlord had called the police on the tenant previously and they had issued her a citation for squatting but she was able to provide such documentation and it was then automatically transferred to a Court to determine if she was a squatter or tenant and the Judge ruled that she was not squatting but a tenant and than it proceeded to treat it like a normal eviction case and she was going to be evicted. This landlord even knew that the Judge was going to be finalizing the eviction as soon as they were able to and that she had won the eviction so there was no need to go and commit the crimes of criminal trespass and terroristic threats.
The police don't have a choice in arresting someone who is on video essentially saying "you leave or you die." In this case, they had contacted the Court and had been told that the tenant still had legal possession and the eviction was in the process of being finalized but hadn't yet. It was just a matter of time before she was out but now she is still going to be out but there are going to be criminal and civil consequences for the landlord as well. Three things will likely happen in short order:
1. The tenant will be evicted since the landlord had won the eviction (there was a temporary stay, automatically issued by a bankruptcy court, but the landlord should have asked for it to be lifted since bankruptcy judges almost always lift such stays since rental homes don't normally affect a bankruptcy case since it's not property owned by the petitioner).
2. The landlord will be convicted of making terroristic threats and criminal trespassing because you can't commit crimes and get away with it even if you believe you are right
3. The landlord will lose a civil case filed by the tenant for actual damages and punitive damages for an illegal eviction taking the form of "leave or die."
If an immigrant comes in this country illegally and we give them free housing, America is outraged. But if someone squats in your home that you're paying for, no one does anything about changing squatters laws. How can America be an "all powerful" nation when citizens can't get the justice they deserve? 🤦🏾♂️

This is piss-poor reporting. WHAT were the charges against the owner? "I don't know why I was arrested" isn't an answer.
WHY is a judge involved? For a criminal case against the homeowner, or a civil case against the squatter? Is the owner trying to evict? This report is ridiculous.

From what I remember, its a law from hundreds of years ago when settlers or others traveled away from their home for too long or died before coming back. It gave others the right to claim the home. Something like that. That may have worked then but times have drastically changed. I can’t for the life of me understand why this law hasn’t been thrown out. Like decades ago.

This was not a case of a squatter. It's a very simple case and the landlord is a liar and mentally unstable person. Here are the facts:
1. The landlord had previously called the police on her tenant and accused her tenant of being a squatter
2. At that time, the police issued the tenant a citation for squatting which gave the tenant the legal 3 days to provide documentation of being a tenant or be arrested
3. The tenant was able to provide this documentation within those 3 days and the matter was then automatically referred to the Courts
4. A Judge then reviewed the tenants documentation to determine if she is a squatter or a tenant
5. The Judge finds that the documentation proves that the tenant is not a squatter but a tenant
6. The same judge then treats the case like the eviction it was and the Judge finds in the landlords favor (yeah the landlord was winning)
7. The landlord, being a narcissistic sociopath, decides she's not going to wait for the judge to finalize the writ of eviction and give her legal possession
8. She precedes to break into her tenants home and illegally change the locks on her tenant
9. The tenant returns to find herself locked out so she forces entry into her home
10. The landlord returns with a man while the tenant is home and they force their way into the tenants home
11. They then start to remove the tenants personal property and the landlord threatens to get her gun and kill the tenant if she doesn't leave immediately
12. The landlord calls the police (because she doesn't understand she can't commit crimes and have them side with her) on herself
13. The police arrive and reach out to the Court to find out if the landlord has a legal writ of eviction and legal possession of the property
14. The court informed the officers that she does not and the tenant still has a legal right to live there until the eviction is finalized and Sheriffs/Constables execute it
15. The tenant then shows the officers the video of the landlord threatening to commit homicide
16. At this point, the police have no choice but to not arrest the legal tenant who had the right to be there but to instead:
17. Arrest the sociopathic landlord who engaged in criminal trespassing and made terroristic threats against a tenant
All while she was actually winning in Court. She just had to threaten to (or potentially actually do) kill someone because that person dared to avail themselves of "due process of law." This landlord was not arrested for trying to remove a squatter instead she was arrested for:
THREATENING TO KILL A TENANT TO INTIMIDATE THEM INTO MOVING
ILLEGALLY CHANGING THE LOCKS ON A TENANT
This is why she was arrested for making terroristic threats and criminal trespass. Officers aren't going to arrest someone who a Court found was NOT a squatter but was a tenant and that a Court was in the process of legally evicting because that tenant wasn't breaking any laws. The person breaking the laws was the person who thinks she can go around committing trespassing and making terroristic threats in a civil dispute she was actually winning. Maybe if the landlord was losing the case then a death threat might make sense but she wasn't. She was actually winning. Now she is probably going to be losing the CRIMINAL CASE against her and a civil case against her asking for damages and punitive damages because she tried to illegally evict a threaten by threatening to murder them if they didn't leave without a court order given to them by peace officers.

I'm literally dealing with this situation right now, however I'm not the homeowner of the property. The house across the street from me is filled with homeless people due to the homeowner being deceased. There isn't power in the house and I don't believe there's water. We've called the police and nothing was done-they told us neighbors to call code enforcement. Code enforcement says they can't access the gate that they keep locked. The trash and different people all day and night makes me very uncomfortable. We've been trying to figure out what bank has the mortgage but it's so difficult. This is disgusting and such an injustice. How can this be ok!!

Because that is what "this situation" was. The landlord is not telling the truth about the situation. What happened is:
1. The landlord called the police previously and accused her tenant of being a squatter
2. The police responded to that earlier call and issued the tenant a citation for squatting
3. The tenant was able to provide the required documentation that she was a tenant within the 3 days allocated by law
4. Being able to provide this documentation prevented her mandatory arrest for unlawful squatting after those 3 days had elapsed
5. This pushed the matter into the Courts and a judge found that the tenant was not a squatter but was actually a tenant and the documentation was evidence of this
6. The same judge then reviewed the dispute as an eviction and informed both parties that the judge would be issuing a legal eviction in favor of the landlord
7. The landlord, being a narcissistic sociopath, decided she didn't want to wait for the judge to finalize the eviction
8. The landlord then proceeded to break into her tenants home and changed the locks

What should have happened after # 6 was "judge finalizes eviction" and the Court Sheriff's or Constables would serve the eviction on the tenant and if the tenant did not voluntarily leave then officers of the law would forcibly remove her and/or arrest her for criminal trespassing since legal possession had been then been granted to the landlord. That didn't happen because a woman decided she wanted to threaten to murder people in a civil dispute that she was actually winning. Smart move on her part! Haha. You are about to get your TENANT, who you falsely believe is a squatter, removed from your house but you just can't wait for the Judge to get that done and you decide you are going to threaten to or actually kill a tenant because you are upset that she had the right to "due process of law."
Your situation is very different because you are likely dealing with actual squatters and if you were able to get a hold of the owners those people would likely be out in a very quick manner, depending on your state. In Georgia where this happened, it would be three days since Georgia law gives alleged squatters 3 days to prove that they are tenants and not squatters before arresting them. Fortunately, this case is a reason why that's necessary since this landlord falsely accused her tenant of being a squatter and her tenant was able to prove that she was actually a tenant and then she then decided death threats were the way to go. The only criminal in the situation covered by this video is the landlord who engages in an illegal eviction by:
1) illegally changing the locks on her tenant, and
2) making terroristic threats to intimidate her tenant into moving
I hope you get your situation resolved but don't think this mentally unstable landlord is similar to what you are dealing with. You are dealing with actual squatters and we need to get tough with squatters (like Georgia has done) but at the same time we can't allow mentally unstable property owners to threaten to kill actual tenants or falsely accuse their tenants of squatting to get them arrested.
These squatters had to trespass, break into the home, etc, broke so many laws before getting into the home, why wasn't the squatters arrested?!

PEOPLE!! This news network needs to stop with their twisted word salad BS! The person wasn't a "squatter" It was a renter that the home owner was trying to self-evict. The tenant came home to find they had been locked out of a property they leased, so they broke the lock off, which is 100% legal for them to do.
This lady doesn't live at this house, she is the legal owner but not the legal detainer of the property. If the tenant had broken into this home and was an unlawful detainer, they would have been arrested.
This is what comes with renting/leasing properties, If you rent or lease a property and you want the person out, you have to evict them if they do not leave wilfully. Those laws are in place to protect renters and leasers from bad landlords. And yes, It sucks when you rent/lease a property to someone and they don't pay their rent or they're destroying the place and you have to wait for a court order to evict them. That is EXACTLY why it's becoming harder and harder for people to qualify to rent or lease property. Most property owners now want you to have a credit and background check.

That same situation is happening in Spain too. Homeowners can get arrested if they try to remove a squatter.
