    Owner's would rather deal with Air-B-n-B or leave it empty than risk 6-9 months of a squatter refusing to leave, while they are on the hook for untold damage beyond their deposit.

      Landlords would rather charge luxury short term rental prices rather than actually having to be a real landlord... wake up.A landlord is not in the hotel business. But a tech start-up duped greedy, entitled ppl into beleieving they were. I used to live in Vancouver, I lived this reality.

      I would not blame landlords to Airbnb their properties. As soon as a tenant gets in your house, they think the house belongs to them instantly. Landlord and tenant board penalized landlords if they do a minor wrong but the tenants don't pay rent and they destroy your properties cause they have to move, and yet the tenants have rights 😅😅😅 jokers at LTB.These tenants have more rights than the owners who paid over a million for their properties and have to pay mortgage and bills monthly.Some tenants are nightmare nightmares.

    squatters have more rights in Canada than the home owners...laws have to change, like so many other laws that cater to criminals, frauds and scammers

    I was a Landord once,,, NEVER AGAIN because the government has stacked the cards against the HOME OWNER who pays the mortgage...

      Rental laws and the tenant board are run by Doug Ford, not Trudeau. The housing situation is also Doug Ford’s responsibility, but Trudeau is being forced to step in because of inaction by the province.

      definitely. the government knows how backed up and how biased residential tenancy boards are in BC and Ontario. Yet, governments don't care about the property owner class and cater to the mass renters because that's where they get their votes from. they only care about ripping property owners off through taxation on everything. it's better to just invest somewhere else than to have freeloading tenants with no consequences to damage properties and government stand idly by

      Exactly. And if you don't pay the bank comes after you. Yet the tenant can get away Scott free without paying the rent for who knows how long before you can legally evict them. And if they choose to damage the property, you'll never get your money back.

      @@on2thenextthing and if the landlord has a mortgage, a damage to the credit score if the payments are not on time. The bank takes the place back and damage the credit score. Never be a landlord. It's best to just rent it out short term or just leave it empty, using it for a hobby that makes money (baking, furniture repair) is better

      Yes! I have heard of several landlords saying that short term rentals are preferable to long term because, when there is an issue with LTR tenants the dispute cannot be resolved legally in a reasonable amount of time.

    I saw a video on a similar situation where the owner waited for them to leave, went in, put all their stuff on the front lawn and changed the locks on the doors. It worked!!!

    I was a landlord for a while. I can assure you that on average my experience was worse than most, but Im sure theres worse. I once asked a guy that owns 4 well known coffee shops named after a hockey player some cursory questions. He said he could have a much nicer life just taking his millions and plunking his wealth into the stock market. Why is it that renters think you own the place outright, every dime is sheer profit, then tell you your taking the food right out of their kids mouths on rent day while the smell of pot lingers in my house? Never again.

    1:32 🤦‍♀️ Not being able to get a meeting with the board *IS* the issue. For some reason 'Tenant Boards' seem to think that they can either sweep it under the rug; the issue will resolve themselves, or it isn't hurting anyone when a tenant refuses to comply with a *legal* order. I feel for this fellow as he has done nothing wrong and while he waits for the justice system to play catch-up, his home is being trashed (most likely) by disgruntled tenants. So WRONG. 🤨

    This is happening quite a bit. There was another tenant in Hamilton,Ont who refused to move out. The buyers finally got them out by moving onto the front lawn.

    And this is why landlords are turning more to airbnb's and away from long-term rentals because the tenant rules are so slanted towards renters it's almost as if the landlords have no rights even though they are footing the bill for repairs maintenance taxes etc

    The Ontario government dictates that all disputes be handled through the LTB and then doesn’t adequately staff it. There would no rental shortage functioned properly .

    Yup happened to me. Sold at high time and lost $180,000 in marketing going down. They just didn’t want to move out because rents had gone up. Very selfish of the Tenants.

      Not paying rent or not moving out after it was sold is a crime . The cops do it all the time for non rent in the city. Street campers living for free in the streets. They are removed ..... Living in someone's home for free like a little 🐁 🪤. Refused to move is a crime after the notice was issued.

      @@helenaavelar8342, not paying rent is grounds for eviction, but there's no mention of the tenants not paying rent. Legally they have a right to a fair hearing at the Landlord Tenant Board before being evicted. It's not a crime to wait for the hearing.

    If you think this is bad, there was a case where a tenant and owner lived in the same home. The house was split into 2 units. During the dispute the tenant filed a protective order and this resulted in the homeowner/landlord having to move out in order to be some distance from the tennent as per the order.
    Just let that sink in everyone that is renting to room mates!

    Tenants are fully protected in Canada, and landlords are not, that's why all the landlords love Airbnb, because there are no such headaches. The laws should be there to protect both sides.

      No not true years ago I almost lost my spot for one late , here in Quebec you would get a Bailiff letter and have 10 days to move or your stuff goes to storage. One Co-op couple got evicted recently . If you get evicted there , you are a bad tenant or in Low income housing

      The ruling takes too long. It's a 6 month wait for hearing. Tenant lives for free but owner continues to pay property tax, insurance, and possibly a mortgage. The housing market is not a free market under this government

    So as a reporter, the questions you should have asked and aired the answers to were: was there a lease in place? Or was it month to month? Did the new buyers sign off on having tenants? Or were they notified that the house was tenant-occupied before they purchased? Etc.

      Doesn't matter in Ontario if they have a lease or are month to month. Tenants can overstay (month to month) and make it very difficult to get them to vacate.

      Rental to pay for the expenses and eventually pay off the mortgage & use for retirement or grow the equity but bad idea in Ontario as the law in housing has swung too far in the tenants directions.

    don't rent it out. it's better to leave the suite empty than to go through all the troubles, especially true if you're in BC and Ontario. let commercial property management companies and real estate developers deal with tenants. enjoy your own space with a home gym or hobby train set instead.

      ​@@RosemaryAmey I agree! This is the proper process as per the LTB. When someone buys a house that is tenant occupied, they assume those tenants. They're welcome to issue an N12 to those tenants, but they'll still need to deal with a hearing at the LTB. Rent prices are ridiculous nowadays. If I had to leave the house I'm in, my family would be homeless because we can't afford the current market rent. It's just the way it is.

    Tenants got more than 2 months notice PLUS 10,000$ offer in cash from landlord to move, and moving truck! They're practically secured financially for half a year! Yet they still refuse to leave?
    That's clearly one landlord less to help against rental crisis.

    I purchased a small bungalow 5 years ago. I had searched in small town Ontario. "long time tenant would prefer to remain" Rental income is $1,000. Rent is paid on time. Yes, fine and dandy but I want to live in that house and have no interest in a tenant.
    Don't even look at a house that is tenanted. Ignore, walk past. You'll be buying problems. I paid more, but it's mine, no tenants.

    Why not give limited time contracts to tenants ? If you have a legally binding contract for 2 years, tenants will have no legal right to overstay that time period !

    That is just plain stupid. If a renters does not pay rent they should have 30 days to get out. No exceptions.

      @@shauncameron8390, if the new owners want to move in they can get the LTB to evict the tenants. However, the tenants have the right to a fair hearing, which will be delayed by the LTB backlog.

    The broken & incompetent laws allow bad tenants to take advantage of owners, in many other countries the police would get involve to enforce the laws and protect the citizens. Really shameful situation.

    New owner can move into their purchased house any time , even if the tenant does not move out. Both parties can live in the same house

    They didn't give much information about the current tenant. If the tenant has a lease, you can issue as many n4s as you want. You can't get them out until their lease ends. Also the new owners have to issue the n4 as they become the new land lord. The seller can issue an n4 on the new owners behalf if they are no longer on a lease and going month to month but only then will I agree, yes tenants can become a real pain in the ass if they request a hearing with the ltb

      It does not matter. Tenants have more rights and know how to milk the system, especially the professional ones. Sad state of affairs in Ontario.

      @@adanam6377 It does matter because if its a fresh lease agreement, then 100% it needs to be honored. Those laws are in place for these exact reasons. However if the lease is up, then yea tenants can milk the system because the wait lists are way to long right now with the LTB, exactly what I said above.

    There was ppl here who wouldnt leave the house across the street for almost 2 yrs. Owner couldnt sell.

    Tenants are likely the have not's, or have little.
    They may need to find a place to move into, that might be the main issue. Moving trucks aren't hard to find.

    IF YOU HAVE LEGAL POSSESSION OF THE RENTAL PROPERTY AND THE TENANT IS LIVING THERE ILLEGALLY - PULL THE HYDRO METER OFF!
    If as the owner you are paying the hydro then ask your hydro company to pull the meter. It is your right to do so.

      Legally, the tenants have a right to a hearing at the Landlord and Tenant Board, wlhich will decide if they will be evicgted.

      @@RosemaryAmey this hearing won't be held until spring. That is months of accumulated costs for the landlord and the family that has purchased the home.
      These tenants are saying they were not given enough notice to move. Did they not see the for sale sign on their front lawn for maybe a few months before the closing date? They must have allowed for showings as well.
      Legally speaking, this law is ridiculously in favor of the tenant and completely unfair to the home owner.

    That happened to me as a Landlord, but market went down $200,000, so l lost a lot of money and the buyers ended up not able to move in.

    If you want to know why rent is so high, look no further than legislation designed to protect tenants. Who in his right mind would choose to be a landlord? Lawmakers need to understand how well-meaning legislation can be a huge part of the problem.

    He may have followed the rules but they have the right to a hearing, they aren't squatters- this is the system. Once they get a hearing he will be able to have the sheriff remove them.

    If and when a tenant can no longer legally reside in the rental property then the new owners can ask the hydro company to pull the electric meter. The tenants will then leave asap. They can not live without hydro.

    This house sold for $1,160,000 back in August but now can't close. It doesn't even have a garage lol. These are the risks of selling a tenanted property. Boomer should have filed an n11 and paid the tenants to leave. Vacated properties have higher value so they would have made up for it and would have closed by now with a million in the bank. Ah well.

    Unfortunetly this will happend more and more in the future. The housing speculation and growing price of rent will create a crisis and it will affect everybody. We as a country will have to ask ourself a simple question. What is a priority? Profit or the right to have a place to stay?
