Yo cada vez me siento menos patriota, me da vergüenza que después de tanto años sigan riéndose en nuestras caras y tengamos que soportar pésimas jornadas laborales, contratos de trabajo al 30%, media jornada o 1/5 de jornada por un salario minino interprofesional, la educación cada vez se privatiza mas, Tener una carrera universitaria, máster e idiomas y tengas que servir copas en Benidorm,.... Es mejor hacer un referendum y dejarnos independizar que mantener una parte de la población que no quiere formar parte del estado en contra de su voluntad. Eso acaba repercutiendo en la legitimidad de la ley del estado en dicho territorio (y puede extenderses a otros del mismo estado).

And also to show the deep connection between the judiciary and the legislative and executive powers that calls into question the independence of it. I will try to source as much as possible. The governing body of the spanish judiciary is the General Council of the Judiciary (CGPJ) There are two pieces of legislation relevant to the composition and election of the CGPJ. Spanish Constitution Article 122: www.congreso.es/portal/page/portal/Congreso/Congreso/Hist_Normas/Norm/const_espa_texto_ingles_0.pdf Organic law 2/2001:noticias.juridicas.com/base_datos/Admin/lo2-2001.html These establish it as such: Article 122 Spanish Constitution -Composed of 20 members plus the President of the Supreme Court who are appointed for 5 years. -Twelve of these will be judges and magistrates of all judicial categories, in the terms established by the organic law -Four at the proposal of the Congress of Deputies, and four at the proposal of the Senate, elected in both cases by a majority of three fifths of its members -The above will be chosen from lawyers and other jurists, all of them with recognized competence and with more than fifteen years of practice in their profession. Organic law 2/2001 Establishes a fairly complex and pointless election process for the twelve judges and magistrates 1. Candidates will be presented, up to a maximum 36, by professional associations of Judges and Magistrates or by a number of judges representing at least 2% of all those who are in active service. There's a complex proportional system limiting the number of proposals that each proposing group can propose but we don't care about that. The only part we care about is that the way the candidates are chosen is left up to the groups which means hand picking. 2. Among the thirty-six candidates nominated, six members will be elected first by the House of Representatives by a majority of three fifths of their respective members, and once these six members have been elected, the Senate will elect the other six of the thirty candidates left by the same majority. 3. Additionally: -To be heard by the Government prior to the appointment of the State Attorney General. -Very limited power over competences of the constitutional organs. -Controls the training, destination, promotion and acts as administrative and disciplinary body for judges and magistrates. -To exercise the high inspection of Courts, as well as the supervision and coordination of the ordinary inspection activity of the Presidents and Governing Chambers of the Courts. -Provide instructions to the governing bodies of Courts and Tribunals on matters within their jurisdiction, as well as resolving appeals that are filed against any agreements in these bodies. -Publish all sentences -To regulate the structure and operation of the Judicial School, as well as to appoint its Director and its teachers. -Regulate the structure and functioning of the Judicial Documentation Center, as well as appoint its Director and the rest of its staff. -Appoint the Vice-President of the Supreme Court, the Promoter of Disciplinary Action and the Head of the Court Inspection. -Appoint the Director of the Technical Office of the General Council of the Judiciary. -To regulate and to call the competition of entrance in the Body of Lawyers of the General Council of the Judicial Power. -Elaborate and execute its own budget, in the terms foreseen in this Organic Law. -Receive complaints from citizens in matters related to the Justice administration. -A bunch of busywork that isn't relevant So we have a governing body that is appointed by the legislative power which has an almost absolute hold on how the judiciary behaves with no attempts to keep it independent since the members are appointed every electoral cycle. To back this up I'll compare which party was in power to the presidency of the Supreme Court/CGPJ: -Federico Carlos Sainz de Robles y Rodríguez (1980-1985) UCD until 82 then PSOE -Antonio Hernández Gil (1985-1990) PSOE -Pascual Sala Sánchez (1990-1996) PSOE First irregularity due to GAL case and governmental corruption. Later became the president of the Constitutional Court. -Francisco Javier Delgado Barrio (1996-2001) PP A conservative, he considered it a priority to strengthen the independence of the Judiciary, to speed up the functioning of the Administration of Justice and was concerned about the increased discretionality of the government for reasons of public safety. -Francisco José Hernando Santiago (2001-2008) PP until 2004 then PSOE Massive irregularity caused by political conflict, appointed as the sole candidate proposed so he was appointed with a lower requirement than the 3/5ths stated by the law, during the PSOE government he constantly acted with political motivations declaring the Constitutional Tribunal to be overreaching and calling into question the constitutionality of many parliamentary proposals with unrequested reports two cases stand out, the catalan estatute and gay marriage both part of the PP campaign. He was also outspokenly oppossed to Catalan culture and Catalan language. As of 2011 he's back as a magistrate. -Carlos Dívar Blanco (2008- 2012) PSOE During his time the Council was divided in two along political lines, in the end he had to present his resignation after a long line of accusations due to a use of public funds to pay for luxurious vacations. -Gonzalo Moliner Tamborero (2012-2013) PP An oddball, politically progessive he quickly made a lot of enemies by being okay with abortion and believing that the judiciary should be directly subjected to Parliament as opposed to PPs proposal which would go back to the 85 system in which the judges appointed a big part of the CGPJ leading to a supposed conservative bias. -Carlos Lesmes Serrano (2013-) PP Part of the earlier PP government he's a deeply religious conservative and has little experience compared to the rest of candidates, he's described by those close to him as "ideological but technically minded". Currently he is the only prosecutor in the Council.

Rather to the contrary, its own configuration (being composed of judges and lawyers fully chosen by the political authorities) presented a potential threat to judicial independence." "GRECO’s report recommended in the paragraph relating to the judges in Spain the following: to analyse the legislative framework governing the General Council of the Judiciary and its impact on the actual and perceived independence; to envisage in law objective criteria and assessment rules for appointments to senior positions in the judiciary. The Spanish authorities have not yet submitted to GRECO the measures taken to implement these recommendations. The Organic Law No. 7/2015 of 21 July 2015, in force since 1 October 2015, contained elements which would also appear to be contrary to judicial independence. The so-called reform provided a new way in which the President of the General Council of the Judiciary could give obligatory proposals to the Council, thereby weakening its nature and functions as a guarantor of judicial independence. The reform also had negative consequences for the workload of judges" I believe I've made my case on this one at least. Now let's move on to the judiciary proper, we'll deal with the Constitutional Court and Supreme Court. Spanish Constitution Article 123: www.congreso.es/portal/page/portal/Congreso/Congreso/Hist_Normas/Norm/const_espa_texto_ingles_0.pdf The constitution establishes the Supreme Court as such: 1. The Supreme Court, with jurisdiction over the whole of Spain, is the highest judicial body in all branches of justice, except with regard to provisions concerning constitutional guarantees. 2. The President of the Supreme Court shall be appointed by the King, on the General Council of the Judicial Powers’ proposal in the manner to be laid down by the law. To go further into it we have to go through multiple pieces of legislation. The Supreme Court will be composed of five main chambers: -First Chamber, Civil matters -Second Chamber, Penal matters -Third Chamber, Litigation-administrative -Fourth Chamber, Social matters -Fifth Chamber, Military Additionally there are four other special chambers: Court of Jurisdiction (LOPJ, art. 38) Jurisdiction Conflict Chamber (LOPJ, art. 39) Competition Conflict Chamber (LOPJ, art. 42) Special Chamber of Article 61 LOPJ Each chamber will have a president and an amount of magistrates according to what the law determines for each chamber. Now to sum it up quickly without spending an eternity on it we'll quickly skip to the relevant part. Article 57 establishes the functions of the second chamber of particular interest are section 2 and 3: 2º. Of the investigation and prosecution of the cases against the President of the Government, Presidents of the Congress and of the Senate, President of the Supreme Court and of the General Council of the Judicial Power, President of the Constitutional Court, members of the Government, Deputies and Senators, Speakers(members) of the General Council of the Judicial Power, Judges of the Constitutional Court and Supreme Court, Presidents of the National Court and any of its Chambers and Superior Courts of Justice, State Attorney General, Room Prosecutors of the Supreme Court, President and Counselors of the Court of Accounts, President and Councilors of the Council of State and Ombudsman, as well as of the causes that, if appropriate, determine the Statutes of Autonomy. 3º. Of the investigation and prosecution of the cases against Magistrates of the National Court or of a Superior Court of Justice. Additionally the constitution also establishes in article 71.3 the following: In criminal proceedings brought against Members of Congress and Senators, the competent court shall be the Penal Chamber of the Supreme Court. Keep in mind that 71.2 also says: During the period of their mandate, the Deputies and Senators shall also enjoy immunity and may only be detained in case of flagrant crime. They can not be indicted or prosecuted without the prior authorization of the respective Chamber For the way the magistrates and presidents are appointed we have to go back to the CGPJ "The proposal for appointment (by the king) by a majority of three-fifths of: -The President of the Supreme Court and magistrates of the Supreme Court." Thus we are left with a problematic situation, the government elects the members of the CGPJ, they at the same time appoint the magistrated and judges. Thus the magistrates and judges of the second chamber of the Supreme Court are indirectly appointed by the government, these being the ones that will be in charge of any case against them this leading to not only a politicization of the system but a complete inutilization of it when it comes to checks and balances. Now let's move on to the Constitutional Court Spanish Constitution articles 159 to 165: noticias.juridicas.com/base_datos/Admin/constitucion.t9.html#a159 Organic Law 2/1979: noticias.juridicas.com/base_datos/Admin/lo2-1979.t1.html#a2 Article 159 establishes it as such: 1. The Constitutional Court consists of 12 members appointed by the King; of them, four at the proposal of Congress by a majority of three fifths of its members; four at the proposal of the Senate, with the same majority; two at the proposal of the Government, and two at the proposal of the General Council of the Judicial Power. 2. The members of the Constitutional Court shall be appointed between magistrates and prosecutors, university professors, public officials and lawyers, all of them jurists of recognized competence with more than fifteen years of professional practice. 3. The members of the Constitutional Court shall be appointed for a period of nine years and shall be renewed by thirds every three years. 4. Membership of the Constitutional Court is incompatible with any representative mandate; with political or administrative positions; with the performance of managerial functions in a political party or in a union and with the employment at the service of the same; with the exercise of judicial and fiscal careers, and with any professional or commercial activity. 5. The members of the Constitutional Court shall be independent and immovable in the exercise of their mandate. Well with what we know by now I think you should be able to see the issues already, it is being proposed in parts by what is essentially the same organization meaning that is is a fully political body by nature, no matter what 5. says it is simply impossible for a body that is appointed by the political bodies to not be politically minded. To that we have to add the way it is renewed, 1/3 every 3 years, meaning that after 6 years there'll be a majority that can push anything they wish to. Considering that governments tend to change every 8 years you can see how this is a big issue I am sure. The functions of the Constitutional Court are as follows and are established in the constitution and organic law(which expands them massively). It will rule on the following: a) Appeal and the issue of unconstitutionality against laws, normative provisions or acts with force of law. b) Appeal for violation of the rights and public freedoms listed in Article 53, 2 of the Constitution. c) The constitutional conflicts of competence between the State and the Autonomous Communities or between them. d) Conflicts between the constitutional organs of the State. d) bis Conflicts in defense of local autonomy. e) The declaration on the constitutionality of the International Treaties. e) bis Preliminary control of unconstitutionality in the case provided for in article seventy-nine of this Law. (Organic Law 12/2015 in which it can now rule changes or projects of estatutes of autonomy unconstitutional) f) The challenges provided for in number 2 of article 161 of the Constitution. g) Verification of the appointments of the Judges of the Constitutional Court, to judge whether they meet the requirements required by the Constitution and this Law. h) The other matters attributed to it by the Constitution and Organic Laws.

Es mejor hacer un referendum y dejarnos independizar que mantener una parte de la población que no quiere formar parte del estado en contra de su voluntad. Eso acaba repercutiendo en la legitimidad de la ley del estado en dicho territorio (y puede extenderses a otros del mismo estado).

The purpose of this post is to present how the Judiciary in Spain is structured and elected. And also to show the deep connection between the judiciary and the legislative and executive powers that calls into question the independence of it.
I will try to source as much as possible.
The governing body of the spanish judiciary is the General Council of the Judiciary (CGPJ)
There are two pieces of legislation relevant to the composition and election of the CGPJ.

These establish it as such:
Article 122 Spanish Constitution
-Composed of 20 members plus the President of the Supreme Court who are appointed for 5 years.
-Twelve of these will be judges and magistrates of all judicial categories, in the terms established by the organic law
-Four at the proposal of the Congress of Deputies, and four at the proposal of the Senate, elected in both cases by a majority of three fifths of its members
-The above will be chosen from lawyers and other jurists, all of them with recognized competence and with more than fifteen years of practice in their profession.
Organic law 2/2001
Establishes a fairly complex and pointless election process for the twelve judges and magistrates
1. Candidates will be presented, up to a maximum 36, by professional associations of Judges and Magistrates or by a number of judges representing at least 2% of all those who are in active service.
There's a complex proportional system limiting the number of proposals that each proposing group can propose but we don't care about that. The only part we care about is that the way the candidates are chosen is left up to the groups which means hand picking.
2. Among the thirty-six candidates nominated, six members will be elected first by the House of Representatives by a majority of three fifths of their respective members, and once these six members have been elected, the Senate will elect the other six of the thirty candidates left by the same majority.
3. Both elections are done at the same time.
What we see from this is that the CGPJ is in the end chosen by the Senate and Congress with minimum imput by the judiciary.
You might be wondering why this matters now but stick with me because this is just the start.

The proposal for appointment (by the king) by a majority of three-fifths of:
-The President of the Supreme Court and magistrates of the Supreme Court.
-Two members of the Constitutional Court.
-Judges (through order) and magistrates (through royal decree) both who have previously passed a selection process which they also arbitrate.
Additionally:
-To be heard by the Government prior to the appointment of the State Attorney General.
-Very limited power over competences of the constitutional organs.
-Controls the training, destination, promotion and acts as administrative and disciplinary body for judges and magistrates.
-To exercise the high inspection of Courts, as well as the supervision and coordination of the ordinary inspection activity of the Presidents and Governing Chambers of the Courts.
-Provide instructions to the governing bodies of Courts and Tribunals on matters within their jurisdiction, as well as resolving appeals that are filed against any agreements in these bodies.
-Publish all sentences
-To regulate the structure and operation of the Judicial School, as well as to appoint its Director and its teachers.
-Regulate the structure and functioning of the Judicial Documentation Center, as well as appoint its Director and the rest of its staff.
-Appoint the Vice-President of the Supreme Court, the Promoter of Disciplinary Action and the Head of the Court Inspection.
-Appoint the Director of the Technical Office of the General Council of the Judiciary.
-To regulate and to call the competition of entrance in the Body of Lawyers of the General Council of the Judicial Power.
-Elaborate and execute its own budget, in the terms foreseen in this Organic Law.
-Receive complaints from citizens in matters related to the Justice administration.
-A bunch of busywork that isn't relevant
So we have a governing body that is appointed by the legislative power which has an almost absolute hold on how the judiciary behaves with no attempts to keep it independent since the members are appointed every electoral cycle.
To back this up I'll compare which party was in power to the presidency of the Supreme Court/CGPJ:
-Federico Carlos Sainz de Robles y Rodríguez (1980-1985) UCD until 82 then PSOE
-Antonio Hernández Gil (1985-1990) PSOE
-Pascual Sala Sánchez (1990-1996) PSOE First irregularity due to GAL case and governmental corruption. Later became the president of the Constitutional Court.
-Francisco Javier Delgado Barrio (1996-2001) PP A conservative, he considered it a priority to strengthen the independence of the Judiciary, to speed up the functioning of the Administration of Justice and was concerned about the increased discretionality of the government for reasons of public safety.
-Francisco José Hernando Santiago (2001-2008) PP until 2004 then PSOE Massive irregularity caused by political conflict, appointed as the sole candidate proposed so he was appointed with a lower requirement than the 3/5ths stated by the law, during the PSOE government he constantly acted with political motivations declaring the Constitutional Tribunal to be overreaching and calling into question the constitutionality of many parliamentary proposals with unrequested reports two cases stand out, the catalan estatute and gay marriage both part of the PP campaign. He was also outspokenly oppossed to Catalan culture and Catalan language. As of 2011 he's back as a magistrate.
-Carlos Dívar Blanco (2008- 2012) PSOE During his time the Council was divided in two along political lines, in the end he had to present his resignation after a long line of accusations due to a use of public funds to pay for luxurious vacations.
-Gonzalo Moliner Tamborero (2012-2013) PP An oddball, politically progessive he quickly made a lot of enemies by being okay with abortion and believing that the judiciary should be directly subjected to Parliament as opposed to PPs proposal which would go back to the 85 system in which the judges appointed a big part of the CGPJ leading to a supposed conservative bias.
-Carlos Lesmes Serrano (2013-) PP Part of the earlier PP government he's a deeply religious conservative and has little experience compared to the rest of candidates, he's described by those close to him as "ideological but technically minded". Currently he is the only prosecutor in the Council.
EU council's GRECO has also criticized it in the past:

The General Council of the Judiciary was the organ which handled in Spain such sensitive issues as disciplinary sanctions and professional promotions of judges. With this link so obviously being political, the General Council of the Judiciary could not guarantee the division of powers of the state. Rather to the contrary, its own configuration (being composed of judges and lawyers fully chosen by the political authorities) presented a potential threat to judicial independence."
"GRECO’s report recommended in the paragraph relating to the judges in Spain the following: to analyse the legislative framework governing the General Council of the Judiciary and its impact on the actual and perceived independence; to envisage in law objective criteria and assessment rules for appointments to senior positions in the judiciary. The Spanish authorities have not yet submitted to GRECO the measures taken to implement these recommendations. The Organic Law No. 7/2015 of 21 July 2015, in force since 1 October 2015, contained elements which would also appear to be contrary to judicial independence. The so-called reform provided a new way in which the President of the General Council of the Judiciary could give obligatory proposals to the Council, thereby weakening its nature and functions as a guarantor of judicial independence. The reform also had negative consequences for the workload of judges"
I believe I've made my case on this one at least.
Now let's move on to the judiciary proper, we'll deal with the Constitutional Court and Supreme Court.

The constitution establishes the Supreme Court as such:
1. The Supreme Court, with jurisdiction over the whole of Spain, is the highest judicial body in all branches of justice, except with regard to provisions concerning constitutional guarantees.
2. The President of the Supreme Court shall be appointed by the King, on the General Council of the Judicial Powers’ proposal in the manner to be laid down by the law.
To go further into it we have to go through multiple pieces of legislation.

The Organic law establishes the basic workings of the Court.
The Supreme Court will be composed of five main chambers:
-First Chamber, Civil matters
-Second Chamber, Penal matters
-Third Chamber, Litigation-administrative
-Fourth Chamber, Social matters
-Fifth Chamber, Military
Additionally there are four other special chambers:
Court of Jurisdiction (LOPJ, art. 38)
Jurisdiction Conflict Chamber (LOPJ, art. 39)
Competition Conflict Chamber (LOPJ, art. 42)
Special Chamber of Article 61 LOPJ
Each chamber will have a president and an amount of magistrates according to what the law determines for each chamber.
Now to sum it up quickly without spending an eternity on it we'll quickly skip to the relevant part.
Article 57 establishes the functions of the second chamber of particular interest are section 2 and 3:
2º. Of the investigation and prosecution of the cases against the President of the Government, Presidents of the Congress and of the Senate, President of the Supreme Court and of the General Council of the Judicial Power, President of the Constitutional Court, members of the Government, Deputies and Senators, Speakers(members) of the General Council of the Judicial Power, Judges of the Constitutional Court and Supreme Court, Presidents of the National Court and any of its Chambers and Superior Courts of Justice, State Attorney General, Room Prosecutors of the Supreme Court, President and Counselors of the Court of Accounts, President and Councilors of the Council of State and Ombudsman, as well as of the causes that, if appropriate, determine the Statutes of Autonomy.
3º. Of the investigation and prosecution of the cases against Magistrates of the National Court or of a Superior Court of Justice.
Additionally the constitution also establishes in article 71.3 the following:
In criminal proceedings brought against Members of Congress and Senators, the competent court shall be the Penal Chamber of the Supreme Court.
Keep in mind that 71.2 also says:
During the period of their mandate, the Deputies and Senators shall also enjoy immunity and may only be detained in case of flagrant crime. They can not be indicted or prosecuted without the prior authorization of the respective Chamber
For the way the magistrates and presidents are appointed we have to go back to the CGPJ
"The proposal for appointment (by the king) by a majority of three-fifths of:
-The President of the Supreme Court and magistrates of the Supreme Court."
Thus we are left with a problematic situation, the government elects the members of the CGPJ, they at the same time appoint the magistrated and judges. Thus the magistrates and judges of the second chamber of the Supreme Court are indirectly appointed by the government, these being the ones that will be in charge of any case against them this leading to not only a politicization of the system but a complete inutilization of it when it comes to checks and balances.
Now let's move on to the Constitutional Court

Article 159 establishes it as such:
1. The Constitutional Court consists of 12 members appointed by the King; of them, four at the proposal of Congress by a majority of three fifths of its members; four at the proposal of the Senate, with the same majority; two at the proposal of the Government, and two at the proposal of the General Council of the Judicial Power.
2. The members of the Constitutional Court shall be appointed between magistrates and prosecutors, university professors, public officials and lawyers, all of them jurists of recognized competence with more than fifteen years of professional practice.
3. The members of the Constitutional Court shall be appointed for a period of nine years and shall be renewed by thirds every three years.
4. Membership of the Constitutional Court is incompatible with any representative mandate; with political or administrative positions; with the performance of managerial functions in a political party or in a union and with the employment at the service of the same; with the exercise of judicial and fiscal careers, and with any professional or commercial activity.
5. The members of the Constitutional Court shall be independent and immovable in the exercise of their mandate.
Well with what we know by now I think you should be able to see the issues already, it is being proposed in parts by what is essentially the same organization meaning that is is a fully political body by nature, no matter what 5. says it is simply impossible for a body that is appointed by the political bodies to not be politically minded.
To that we have to add the way it is renewed, 1/3 every 3 years, meaning that after 6 years there'll be a majority that can push anything they wish to. Considering that governments tend to change every 8 years you can see how this is a big issue I am sure.
The functions of the Constitutional Court are as follows and are established in the constitution and organic law(which expands them massively).
It will rule on the following:
a) Appeal and the issue of unconstitutionality against laws, normative provisions or acts with force of law.
b) Appeal for violation of the rights and public freedoms listed in Article 53, 2 of the Constitution.
c) The constitutional conflicts of competence between the State and the Autonomous Communities or between them.
d) Conflicts between the constitutional organs of the State.
d) bis Conflicts in defense of local autonomy.
e) The declaration on the constitutionality of the International Treaties.
e) bis Preliminary control of unconstitutionality in the case provided for in article seventy-nine of this Law. (Organic Law 12/2015 in which it can now rule changes or projects of estatutes of autonomy unconstitutional)
f) The challenges provided for in number 2 of article 161 of the Constitution.
g) Verification of the appointments of the Judges of the Constitutional Court, to judge whether they meet the requirements required by the Constitution and this Law.
h) The other matters attributed to it by the Constitution and Organic Laws.
