  • U.S. Supreme Court scores another victory for the 2nd amendment 14.06.2022
The U.S. Supreme Court has overturned the Trump-era ban on bump stocks, ruling 6-3 that the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) exceeded its authority. The court’s conservative majority found that a semi-automatic rifle with a bump stock is not a "machine gun" because it doesn’t fire automatically, despite the ATF’s previous ban after the 2017 Las Vegas shooting. Justice Clarence Thomas argued that the ban contradicted the ATF’s earlier position.
Justice Samuel Alito noted that Congress in 1986 likely saw bump stock-equipped rifles as similar to machine guns but stated that only Congress could enact such a ban. In dissent, Justice Sonia Sotomayor criticized the focus on the gun’s internal mechanics over its rapid-firing capability, using the analogy, “If it looks like a duck and quacks like a duck, it’s a duck.”
Gun control advocates, including Las Vegas shooting survivor Kari Kuefler, were disheartened, emphasizing the diminishing sense of safety. UCLA professor Adam Winkler saw the decision as part of the court's broader resistance to agency regulations, predicting that more gun control measures might face challenges.
Following the ruling, President Biden urged Congress to legislate a bump stock ban, but prospects remain uncertain due to political gridlock and the strong influence of the gun lobby, notably the NRA, which anticipated and strategized for this outcome.
