When Dealing with MNC's, Why doesn't Government Take into Consideration the Matter then When it Asks or Demands something, the reverse can also be true? My View. Any Retrospective Amendments must be made with keeping people and Bilateral ties into consideration. It's a controversial Thing to Do. 2)Also when approaching this kind of Companys why can't we take help from the Countries of Origin of these companies? You are weak and have to think twice before allowing foreign entities to enter India. You may retain prospective amendments. These cases reveal that government is not fair, so they have to suffer for their acts.

I think indian govt did benefit a little while putting a fight (1.1B$ held for 7 yrs does yield something), but to cheek out at end citing it was always incorrect is unbecoming. Also lost battles are also alright. However retrospective amendment anywhere in world appears shady. At same time, difference between tax planning vs tax avoidance can be argued. Tax laws should be simplifed so that middle class do not get ripped off paying 30% above 15Lacs and incur GST during expense and India should also lower IT taxation to have lower incentive to evade/avoid. Due to inflationary nature of currency IT can perhaps be abolished. Tax burden should be spread in proportion to accumulation of wealth.

Sir, You are absolutely right if any such malpractices takes place in future then India wouldn't be able to recover tax and if every country has right to exercise this power then why not India. Income tax department should not feel pressurised and take it's own stand. Department had right to do so and it did there was nothing wrong. Hence retrospective amendment provision should always be there.

In my opinion not opting retrospective ammendment of Act is good steps. Because more and more entity will explore loopholes and latter on government can remove all the identified loopholes prospectively so that there will be no loophole at all.

1. One question: what is your answer to government saying - the matter was sub judice in other courts thus the amendment was proposed now? 2. Every government pursues the cases till the last mile and portrays as if they are doing a favour to people while amending it. NDA has not done otherwise. I dont know about foreign governments, but do share a precedent if you have 3. The statement made by government is also political in nature 4. It will help in boosting investor confidence as at last the government has taken the apt action. The government has also taken action to stop MNCs exploiting tax system by introducing and further amending equilisation levy. Would like to listen to people’s views including yours sir. Sir, you are a great CA and I enjoy and appreciate your videos. You are a brilliant professional. One point what you said I agree with you. What kind of legal advice the NDA govt got that they lost in SC and also PCA. Those legal advisors should be sacked. If I were the legal counsel, I would have told NDA on day one, do not pursue, You have no case. We have to remember that the legal counsel for the govt is with decades of legal experience how can they not see the point that that NDA has no case, in the event the foreign entity take it to PCA, assuming that the Govt wins in SC too. PCA is the elephant in the room in this case involving a foreign entity. How can the Govt win? The source of this debacle is horrible legal advice the Govt got. (I am not a lawyer but understands legality well and have appeared personally in Singapore High Court for my case involving a property) But you are missing to think from the political angle. In the real world everything is just a talk; so do not be worried about what the govt said in Aug 2021 that "We will not amend retrospectively etc". You are also incorrect to say that Govt has said that India will never use retrospective amendment because with Investment treaty with almost all major countries, the retrospective amendment is not possible and hence saying as such is not wrong. It is not that India came under pressure. Not correct. You mentioned that USA, UK still do that. I doubt very much it is possible in the current times. Thanks for your time and the info. Sir, You are absolutely right if any such malpractices takes place in future then India wouldn't be able to recover tax and if every country has right to exercise this power then why not India. Income tax department should not feel pressurised and take it's own stand. Department had right to do so and it did there was nothing wrong. Hence retrospective amendment provision should always be there.

In my opinion not opting retrospective ammendment of Act is good steps.
Because more and more entity will explore loopholes and latter on government can remove all the identified loopholes prospectively so that there will be no loophole at all.

1. One question: what is your answer to government saying - the matter was sub judice in other courts thus the amendment was proposed now?
2. Every government pursues the cases till the last mile and portrays as if they are doing a favour to people while amending it. NDA has not done otherwise. I dont know about foreign governments, but do share a precedent if you have
3. The statement made by government is also political in nature
4. It will help in boosting investor confidence as at last the government has taken the apt action. The government has also taken action to stop MNCs exploiting tax system by introducing and further amending equilisation levy.
Would like to listen to people’s views including yours sir.

Just a Small Doubt in Case of Cairn Group Case,There was Transfer of Asset in which Tranferee is Subsidiary Company and Transfer of Asset from Holding to 100% Subsidiary (in which Transferee is Indian Company) is Regarded as Exempt Transfer and No Tax arises as there is No Capital Gain
So why was it Treated as Tranfer

What kind of legal advice the NDA govt got that they lost in SC and also PCA.
Those legal advisors should be sacked. If I were the legal counsel, I would have told
NDA on day one, do not pursue, You have no case. We have to remember that the legal
counsel for the govt is with decades of legal experience how can they not see
the point that that NDA has no case, in the event the foreign entity take it to PCA, assuming
that the Govt wins in SC too. PCA is the elephant in the room in this case involving
a foreign entity. How can the Govt win?
The source of this debacle is horrible legal advice the Govt got.
(I am not a lawyer but understands legality well and have appeared personally in Singapore High Court for my case involving a property)
But you are missing to think from the political angle. In the real world everything is just a talk; so do not be worried about what the govt said in Aug 2021 that "We will not amend retrospectively etc".
You are also incorrect to say that Govt has said that India will never use retrospective amendment because with Investment treaty with almost all major countries, the retrospective amendment is not possible and hence saying as such is not wrong. It is not that India came under pressure. Not correct. You mentioned that USA, UK still do that. I doubt very much it is possible in the current times.
