Michael Kirby on ACT Same-Sex Marriage case

We spoke to the Honourable Michael Kirby who outlines the High Court's decision in Commonwealth v ACT (2013) 250 CLR 441, which reaffirmed that only the Federal Parliament had the power to enact a federal gay marriage law.
The former High Court Justice also gives his view on whether marriage equality in Australia should be determined by a referendum.
