As a student of law myself, I find it absolutely baffling how some of my colleagues have used the Art 14 argument to oppose the CAA. One can be ignorant of historical facts & current realities, and thereby make a flawed argument against the CAA based on the 'non-persecution' of minorities in these countries. However, the fact that most of the supposed arguments against this Act stem from a plea for 'equality'- clearly indicates the failure of our higher education system in inculcating a spirit of basic critical thinking.

The home ministry deals with the matters pertaining to internal security and law and order. And it is doing its job quite nicely. These protests were nothing but trigger of the Muslim community which has been hightened by instigating messages in WhatsApp. They have been instigated using the Ayodhya verdict, article 370 abrogation and triple talaq issue. AISA and SFI has given these "protests" an artistic touch and PFI used the matter to vandalise temples and to riot.

It is up to the government which countries to include, previously India has given citizenship to Srilankan Hindus only. India had built the housed for Tamils in Srilanka but that not possible in Pakistan, Bangladesh, Afghanistan. 2. This law targets religious persecution, not sectarian persecution. Even Rohingyas are present in Bangladesh's island and India is not a 'Dharmsala'. 3. How Jews can be present in Islamic countries and Israel is ready to take them. But Christians are present in some amount that's why they included. 4. India has given citizenship to SriLankan Hindus previously but not given citizenship to Hindus from these countries. It is possible for Christians to persecute in Bhutan? 5. They can apply for citizenship in another way and ask for asylum as given to Tasleema Nasreen, Shri Dalai lama, etc.
This applies to people of these faiths present in India before 2015 and there are only around 33000 or so present in the country as of now. But govt is still in full capacity to give citizenship to these people even without this perticular article. Also this completely excludes minorities currently present in those particular countries whether or not they are facing persecution. Further govt could have mentioned religious minorities in the bill instead of naming out and still it won't apply to Ahmedias and all as they are sects and not different religion. Hence It is just a unwarranted political stunt to unnecessarily create divide. Further govt gives no guarantee, or bill is in scope to prohibit itself from being wrongly exploited when and if combined with NRC. I am no constitutional expert but I can say the motive of the bill is not good.

CAA is not about Exclusion, It's about Inclusion. It is about giving Expedited Citizenship to the classified group of Persecuted and marginalised communities from three neighbouring Islamic countries, which came to India before Dec 2014 and currently living in statelessness. The Rationale for the classified group is that they have no other place to go except India because of their Indic Origin. CAA does not target Indian Muslims nor does it discriminate against Indian citizens. CAA focuses on discriminated against and persecuted Non-Muslim minority immigrants. The government has the right to determine who should become citizens and who should not. It is a matter of policy and nothing to do with the Indian constitution. India is facing a threat of terrorism and giving citizenship to Muslims from these countries is dangerous. This is nothing about religion but it is about the SECURITY of the country.
Tamil Hindus don't fall under a separate religion, they're Tamil and Hindus. So that way, the religious side of the law doesn't apply to them, the sectarian part is clearly explained in the video. Also, SL Tamils Hindus have been given refugee status for a very long time, but it was being given under a different legislature/executive decision

Nepal, Bhutan, China, Myanmar, Sri Lanka do have religious persecution, but circumstantial and not a state policy. Q2: "Why has it identified only six religious groups - Hindus, Sikhs, Buddhists, Jains, Parsis, and Christians - and left out others like Ahmadiyyas, Rohingyas and Hazaras?" A: Because Rohingyas and Hazaras are ethnic groups and not religious groups, this amendment addresses only religious persecution and not other types. However things will pan out very differently on the ground level and the intentions are something else, this everyone knows and that is why the protests. Issue is not CAB but issue is the combination of CAB and NRC that is quite efficiently skipped here and also by the govt. The Assam NRC brought out 14L hindus of those who could not prove citizenship and many of them are migrant poor laborers from UP and Bihar who could not produce enough docs even though they or their forefather never left India. After spending thousands of crore of rupees and expecting millions of illegal muslim people identified, this result has shocked the ruling party and the govt. They want to get around this issue of delegitimizing of their core vote bank so this amendment will legitimize them Now they are shouting on top their lungs that this will not affect who are currently Indian citizens. But what will happen once NRC will be done across India, of 130 crore people how many will be able to furnish docs and proofs of their or their ancestors proof of residence before 1971. Even in this age, we know the state of documentation of the India govt and then you expect people to get documentation of their family's existence in India before 50 years?!!! What will happen to those who cannot furnish the proof? As per the CAB amendment, the Hindus will be automatically in and Muslims will not be. They will be stripped of their rights, land holdings and jobs and they have to fight long legal battles and stay in the detention camps??? Think if same thing happens to the Hindus settled in other countries!!! 1: What govt plan to do with 14L hindus identified in Assam NRC, do they want to give them citizenship via this backdoor amendment, that will be direct violation of Assam Accord. Deafning silence on this 2: WIll you deport illegal Bangladesi migrants back to Bangladesh? A clear answer on that? So all their lifelong they must be supported by the tax payers money as legally they cannot work. Who will foot this bill in the end? Historically whenever Islam has taken over a nation, all secularism, kindness, compassion go out the window to be replaced only by Islam and anyone who isn't following it is persecuted. This has happened in Iran, Iraq, Afghanistan, Syria, Egypt etc where previous civilizations, cultures and languages existed but were wiped out by Arab and Islamic invaders by force. A similar thing has also happened in Kashmir already. There have been 7 brutal exoduses over the centuries of Mughal rule, and the last one in 1990 of the Kashmiri pandits and minorities. Islam isn't secular by nature, Hinduism is. There's nothing wrong with wanting to protect our civilizational identity as this is the only country with a true Hindu majority. Moreover our civilizational identity also includes people of all faiths. The problem arises when they refuse to identify as Indians first. I live in the Middle-East and know the people/culture here first-hand. Iran is very different from Saudi even in the way they practice Islam because there is the civilizational influence of their Zoroastrian culture. A similar thing applies to Indian Muslims or Indians of any faith, the civilizational identity is the most integral. There are 50+ Islamic countries, and they have a lot of sectarianism within themselves, especially Shias and Sunnis. Question shouldn't be why India isn't helping out Islamic countries like Pakistan and Bangladesh with sectarian problems. Questions should be, why do they have a problem there in the first place, and why aren't all the Islamic countries helping each other out? Islamic countries don't even take in refugees from other Islamic nations, like Syrian refugees. All the refugees flee to predominantly Christian countries or India. Worth thinking about why that is. Baffling is when they flee these places and then want to establish the same regime and Sharia in the countries that gave them shelter, freedom and opportunities.

Good and crisp analysis. You could also have stated that a person outside Indian territory can’t claim protection of Art 14. Someone in India cannot claim violation of right to equality on behalf of persons who can’t claim such right. Second point is Citizenship Rules also requires maintenance of NRC. Actually, CAA is seen as a carved out exception to NRC done in Assam, which has excludes very large number of Hindus.
I do not fear the Muslims protesting this Bill. I fear the Hindus and feel sad for the Christians as they can't see the persecution that the people of their community face in Pakistan.

-"Why has it identified only six religious groups - Hindus, Sikhs, Buddhists, Jains, Parsis, and Christians - and left out others like Ahmadiyyas, Rohingyas, and Hazaras?"

My answers-
1. It is up to the government which countries to include, previously India has given citizenship to Srilankan Hindus only. India had built the housed for Tamils in Srilanka but that not possible in Pakistan, Bangladesh, Afghanistan.
2. This law targets religious persecution, not sectarian persecution. Even Rohingyas are present in Bangladesh's island and India is not a 'Dharmsala'.
3. How Jews can be present in Islamic countries and Israel is ready to take them. But Christians are present in some amount that's why they included.
4. India has given citizenship to SriLankan Hindus previously but not given citizenship to Hindus from these countries. It is possible for Christians to persecute in Bhutan?
5. They can apply for citizenship in another way and ask for asylum as given to Tasleema Nasreen, Shri Dalai lama, etc.
This applies to people of these faiths present in India before 2015 and there are only around 33000 or so present in the country as of now. But govt is still in full capacity to give citizenship to these people even without this perticular article. Also this completely excludes minorities currently present in those particular countries whether or not they are facing persecution.
Further govt could have mentioned religious minorities in the bill instead of naming out and still it won't apply to Ahmedias and all as they are sects and not different religion.
Hence It is just a unwarranted political stunt to unnecessarily create divide. Further govt gives no guarantee, or bill is in scope to prohibit itself from being wrongly exploited when and if combined with NRC.
I am no constitutional expert but I can say the motive of the bill is not good.

It is about giving Expedited Citizenship to the classified group of Persecuted and marginalised communities from three neighbouring Islamic countries, which came to India before Dec 2014 and currently living in statelessness. The Rationale for the classified group is that they have no other place to go except India because of their Indic Origin. CAA does not target Indian Muslims nor does it discriminate against Indian citizens. CAA focuses on discriminated against and persecuted Non-Muslim minority immigrants. The government has the right to determine who should become citizens and who should not. It is a matter of policy and nothing to do with the Indian constitution. A: Because Afghanistan, Pakistan and Bangladesh are the only countries with contiguous borders which have religious discrimination institutionalized in the state, their constitution.
Nepal, Bhutan, China, Myanmar, Sri Lanka do have religious persecution, but circumstantial and not a state policy.

If India includes them in this list, then it means India is also declaring them as not-Muslim.

Congress can still demand other persecutions to be addressed by this government or can capture power and do something in the future.

Do you see Ahmadiya refugees in Delhi or Jaisalmer? Why not? Because they are small well-off group. Nice technical explanation of the law and the amendment. However things will pan out very differently on the ground level and the intentions are something else, this everyone knows and that is why the protests.
Issue is not CAB but issue is the combination of CAB and NRC that is quite efficiently skipped here and also by the govt. The Assam NRC brought out 14L hindus of those who could not prove citizenship and many of them are migrant poor laborers from UP and Bihar who could not produce enough docs even though they or their forefather never left India.
After spending thousands of crore of rupees and expecting millions of illegal muslim people identified, this result has shocked the ruling party and the govt. They want to get around this issue of delegitimizing of their core vote bank so this amendment will legitimize them
Now they are shouting on top their lungs that this will not affect who are currently Indian citizens.
But what will happen once NRC will be done across India, of 130 crore people how many will be able to furnish docs and proofs of their or their ancestors proof of residence before 1971.
Even in this age, we know the state of documentation of the India govt and then you expect people to get documentation of their family's existence in India before 50 years?!!!
What will happen to those who cannot furnish the proof? As per the CAB amendment, the Hindus will be automatically in and Muslims will not be.
They will be stripped of their rights, land holdings and jobs and they have to fight long legal battles and stay in the detention camps???

3: You are building detention centres across India (reminds one of Nazi era) and then you have to host and take of the people who will be labelled as non citizens after nationwide NRC, you cannot deport them anywhere its clear. So all their lifelong they must be supported by the tax payers money as legally they cannot work. Who will foot this bill in the end?

4: Even if you will succeed with bringing people to the detention center, you will be under hard scrunity of the international watch dogs and you need to provide people with basically good amenities (not as in jails) Here India has slipped to shameful low in the hunger index even below Pakistan and you will have provide proper living conditions for FREE to these people. Historically whenever Islam has taken over a nation, all secularism, kindness, compassion go out the window to be replaced only by Islam and anyone who isn't following it is persecuted.
This has happened in Iran, Iraq, Afghanistan, Syria, Egypt etc where previous civilizations, cultures and languages existed but were wiped out by Arab and Islamic invaders by force. A similar thing has also happened in Kashmir already. There have been 7 brutal exoduses over the centuries of Mughal rule, and the last one in 1990 of the Kashmiri pandits and minorities.
Islam isn't secular by nature, Hinduism is. There's nothing wrong with wanting to protect our civilizational identity as this is the only country with a true Hindu majority. Moreover our civilizational identity also includes people of all faiths. The problem arises when they refuse to identify as Indians first. I live in the Middle-East and know the people/culture here first-hand. Iran is very different from Saudi even in the way they practice Islam because there is the civilizational influence of their Zoroastrian culture. A similar thing applies to Indian Muslims or Indians of any faith, the civilizational identity is the most integral.
There are 50+ Islamic countries, and they have a lot of sectarianism within themselves, especially Shias and Sunnis. Question shouldn't be why India isn't helping out Islamic countries like Pakistan and Bangladesh with sectarian problems. Questions should be, why do they have a problem there in the first place, and why aren't all the Islamic countries helping each other out?
Islamic countries don't even take in refugees from other Islamic nations, like Syrian refugees. All the refugees flee to predominantly Christian countries or India. Worth thinking about why that is. Baffling is when they flee these places and then want to establish the same regime and Sharia in the countries that gave them shelter, freedom and opportunities.

Good and crisp analysis. You could also have stated that a person outside Indian territory can’t claim protection of Art 14. Someone in India cannot claim violation of right to equality on behalf of persons who can’t claim such right. Second point is Citizenship Rules also requires maintenance of NRC. Actually, CAA is seen as a carved out exception to NRC done in Assam, which has excludes very large number of Hindus.
