  • democracynow.org - All eyes are on the Supreme Court nomination of Neil Gorsuch, who is facing his second day of confirmation hearings. But Trump has 123 other federal judgeships to fill, because Senate Republicans blocked many of Obama’s nominees. We take a look at how the top official at the Federalist Society, named Leonard Leo, is playing a key role in helping Trump reshape the nation’s judicial landscape from behind the scenes. We speak with Pulitzer Prize-winning journalist Eric Lipton of The New York Times. He recently co-wrote a piece headlined "In Gorsuch, Conservative Activist Sees Test Case for Reshaping the Judiciary."

Dems should use the "Biden Rule" as well. It's just that simple. Biden is quoted as saying that there should be no confirmation hearings once the campaign season has started. Trump filed for re-election on inauguration day. Since then he's had at least two rallies paid for by his re-election campaign. Has the 2020 campaign season not been started by Trump? Does the "Biden Rule" not apply now?

It doesn't matter, Senate majority leader Mitch McConnell has already made it clear that the Senate will continue confirming judges regardless of the campaign season.

The Federalists look to the Federalist papers for aid in interpreting law, as if the founders never said a thing or never had a thought later than when the Federalist papers were written. And why do they maintain that position? Because, it is the only way to justify their conservative positions. It is a very dishonest approach to legal scholarship. It's morally bankrupt, because the founders said a whole lot more than what they put into the Federalist papers, and those conservative voices that have that legal perspective, KNOW that there are other thoughts than what is in the Federalist papers and they deliberately ignore them.

Hamilton and Madison were the principal authors of those papers...both wanted strong centralized government ...so i find it amusing that they say they are not.
      Classic .propaganda.....
Unless you take it for what its goals really are.... Freedom for the 1% with a strong government to keep anyone from changing that

@@robkitchen5344 I’m sure if Hamilton and Madison were alive today they would be appalled by the size of the federal government of today. Back then they weren’t having the debates that we have today like welfare and gun control. It’s a totally dishonest argument in my opinion.

Money outguns justice without fear or favor. Citizens United case helped billionaires swill money through non profits to buy American judicial rights and regulatory policy. Money -> non profits -> Wellspring -> Judicial Crisis Network -> donations to buy judges selected by fundraiser Leonard Leo

Those judges can't be impartial .... Can't be honest if they can't even see they are compromised ...
    ..
Humans don't ruled. that other humans as being. "property" of another human unless they are compromised by growing up. In a slave owning family. And.your family still owns slaves and by ruling correctly that family would have to work themselves instead of buying a slave....the slave owner judge is going to rule slavery owning is fine and dandy. those common decency dictates is wrong
So belonging to this Society of intellectual corrupt lawyers and judges compromises impartiality

It is not. We now have the most illegitimate politically driven activist court. Captured by special interests, eroding the rule of law and constitutional protections such as the civil jury.

From their website: "Founded in 1982, the Federalist Society for Law and Public Policy Studies is a group of conservatives and libertarians dedicated to reforming the current legal order. We are committed to the principles that the state exists to preserve freedom, that the separation of governmental powers is central to our Constitution, and that it is emphatically the province and duty of the judiciary to say what the law is, not what it should be. The Society seeks to promote awareness of these principles and to further their application through its activities." " We have fostered a greater appreciation for the role of separation of powers; federalism; limited, constitutional government; and the rule of law in protecting individual freedom and traditional values."

Our founders saw the civil jury as essential to the rule of law. The Constitution , when examined through your beloved originalism, provides no rights or even mentions corporations. Yet this court chose to ignore briefs warning of the impending corruption, and grant corporations a constitutional right to free speech. This ruling has resulted in disastrous effects for the nation, but significantly boosted the ability of special interests and corporate America to manipulate the electorate and the courts to carry out agendas that do not benefit Americans.
