      There is no practical mechanisms in India to pull the plug on judges and that gives them the audacity to do anything and everything. HC/SC judges can be impeached by parliament only. No action will be taken even if a complaint is registered against a judge to the HC/SC

    Divorce should be made easier, no fault divorce should be included in the law. You cannot force people to stay together it's just stupid, the sanctity of marriage isn't about keeping the marriage intact no matter what , make it easier for people to seperate irrespective of gender. Half of these problems will get resolved.

      There is no fault divorce available… mutually agreed divorce exists, one of my cousin divorced his wife in this manner only. And she was also happy to move on. MARRAIGE was not working for them….

      Well go and read the prenuptials in western countries. Are Indian men even ready to stay like that, independent from their parents?..? No.
      I also have a brother ( cousin) and he loves his parents a lot. Thankfully my sister in law always wanted a bigger family, but if not, he would have happily divorced her only to stay with the parents. My uncle,aunty are healthy fit fine and earning well for themselves and they don’t need a son constantly around, but he is raised so that he now cannot imagine staying away from them….

      Well most laws are misused, murder cases, all are not true…. That too first degree murder case. Then there is theft case, misused to, UAPA misused too… so will you repeal all of the law or just make teh system efficient, tech enabled, fast paced and accessible?…
      Atul faced a lot, but to be fair if this case would have been contested in e court and he would have had that option, I think his expenses would have reduced drastically, and so his stress.

    This is not the first case and won't be the last until law changes. Faye- appreciate you showing guts to cover this issue, although it's already a bit too late. Normally media outlets won't get any brownie points covering men's rights. Law is profiting women and incentivizing them to Divorce.

    Supreme court is also culpable in such cases.
    Just yesterday i saw video from lawyer amish aggrawal. There is a lady head of hr in her company earning 1.4 L per month. Divorced her first husband . Had a child from him . Took 40 L in alimony. Remarried. Left 2nd husband in less than a year . Dragged case for 9 years .
    High court has reduced alimony demand significantly. But lady challenged and the. Supreme court gave 2 cr + in alimony for a marriage which did not lasted a year.
    If supreme court itself is siding a serial fraud. Then what will lower courts do.
    My advice to next generation. Do not get married. This laddu u must avoid. Its poison

      After sections related to domestic violence (498A) came into force in the year 2007, the male suicides have started to drastically increase across the country.
      My question is simple - Why is media only talking about this today. Because today it is trending.
      Indian media houses have systematically avoided talking about men's rights all these years.

    It’s the judiciary that’s failed. Why does a divorce case take years? Dates upon dates are given for no reason or rhyme and then the abuse of laws begins

    This is absolutely tragic. But the reason for anti cruelty and DV laws is precisely because there are legitimate events where women are mistreated, assaulted, exploited in the confines of a "home" leaving them absolutely helpless to take any action. This is why we need stringent laws, that can be applied fast and effectively. Unfortunately, the system also registers an adverse inference against women of they don't pursue "all the remedies" under family laws, criminal laws and civil laws. So the practice of family disputes and DV cases have become a package deal where women without sufficient cause are made to, in some cases, to file these fake cases for leverage. Unfortunately, we also have judges who are corrupt. 3:49

    Faye this is not only women using this law in a wrong way but also judges also motivates the women . There is a chief justice named suryakant, I have seen me saying while hearing 498 A case to man’s lawyer that kya hogaya 1.50 cr. De diya to, ye enough hota hai . Please give some respectable amount. Now when you hear such comment from chief justice, where is the justice in this. The case I am talking about is being quashed by the high court. The lady appealed in Supreme Court and judge is actually fighting like a lawyer for lady and forcing man to give more money. If you want I can share you the video

    Alimony must be banned. If it not banned, dowry must be legalized as well. Amending the alimony law by implementing 8 factors is not good. Why not legalize dowry law and implement the 8 factors to determine how much dowry needs to be paid?

    Faye, what do you mean by "In India we don't have alimony?" Please check your facts and do some homework.
    Lakhs of Men are being harassed in the name of alimony. Most alimony demands are in crores.
    When I and my wife had approached a divorce lawyer, she asked me point blank "how much alimony are you willing to give to your wife, otherwise remember, she has 'rights'." (What she meant by rights is that my wife can lodge cases against me under many sections available to her)
    Please don't downplay the issues that men face.

      She did not change her career, I left my job and moved to her city.
      Thanks for exposing the mentality of a common woman these days. They think getting money is their right, and yet call themselves strong and independent. Are they handicapped? Can't they earn their own money if they are educated? Or is education just a Facade for them?
      These laws were made to protect dependent, illiterate women. But they are being used to the maximum by the most educated and smartest of women. What an irony.

    The law makers and the judiciary go totally mindless while framing laws or implementing them. I think they never think or worry about the repercussions their law or the judgement is going to have on the people concerned with the case. 498A is one such law. Normally, a person is considered innocent until proven guilty of a crime or even accused of terror action involving many deaths but some laws under which a person is arrested just based on some allegations, that person is considered guilty until proven innocent. That person spends years and years without a trial even and denied bail. 498A is such a draconian law that even if a person residing outside the country is completely unaware of a complaint filed by someone in this country, is dragged down and jailed. Many would consider such an action as the work of mad men or women.

    Courts need to understand middle class men are scared to even get married now because of these stringent and unreasonable laws. If these laws are not abolished a day is not far when only rich men will get married and the rest will remain single forever against their will.

    both husband and wife should be financially self sustainable. There should be nothing called dowry ,joint finances or alimony.
    Both of them should have the right to divorce unilaterally. Marriage should be a limited liablity contract. Rich man should be able marry a poor girl without any fear of financial exploitation and rich woman also should be able to marry a poor man without any fear of financial exploitation. Prenuptial contract should be made compulsory to reduce the burden on court.

    I can mention my personal experience. I had once reached a tough patch in my life and reached out to lawyer to enquire about divorce. The lawyer first few questions were deeply concerning, he said either I can prove infidelity or physical abuse. However, my case was different, he didn’t want to contribute emotionally or monetarily into the marriage. I reached out to 2 lawyers and both said it’s a tough one in my case. I opted for counselling. But if I was adamant to get a divorce, the options infront of me clearly were to damage him 100%.

      @ my suggestion to anyone getting married is…DO NOT MARRY, be it woman OR man. At 26, I had made a home, car, 25L, working. Life was great, I knew where I was going in life, enjoying it. I am 39 now, I am clueless. For society and parents, I have 2 kids, a married life decent money too. But I have no voice any more. My zeal for life is dead. I will give a simple example…On a hot day I felt thirsty and I was with my husband. Forgot my wallet in my car. I told him, can you please get me water. My ask was after I searched the wallet on me….dragging myself for hours staying mum. He said his office is nearby, can get the water thr its free. It happened 14 years also, and till now I cannot buy water without feeling the pain in my heart. Marriage is complicated.

    1 waited nearly 4 years for justice
    2 from his suicide video and few interview seen online he was calm , sorted person
    3 giving money to wife so that she can put pressure on him
    4 family of Subhash harrassment
    5 law which is a joke will help him to get just
    Average time to get divorce in this type of cases 10 years
    Time money self confidence all will be gone if you don't believe me it is upto you

    Why Supreme Court is not letting judges use these provisions?
    BNS Section 248 of the Bharatiya Nyaya Sanhita, 2024 (BNS) deals with the crime of falsely accusing someone of a crime with the intent to cause harm. The law aims to protect people from being maliciously involved in criminal proceedings.
    The punishment for this crime can include:
    Imprisonment for up to five years
    A fine of up to two lakh rupees
    Both imprisonment and a fine
    The punishment is more severe if the false accusation involves serious crimes, such as those punishable by death, life imprisonment, or long-term imprisonment.

    I am also going through the same type of false cases in Mumbai for the past 5 years and NO justice so far. The SCI are just become not interested to read the case. I have given up to get justice anymore. Laws are 100% pro women as they are vote bank. Today the SCI has awarded ₹5 Cr to a women. Nothing will change in the corrupt country 👎🏻🤬

    Considering how both the Government and the Opposition these days are focused only on ensuring they have the power with them and not thinking about the people of the country, I have almost no hope that anything meaningful will come out of this tragic incident.
    We need people within the Government as well as the Opposition to be empathetic towards the seriousness of such harassments which happen to all genders and revamp the laws which focus on providing justice irrespective of the gender.

    For most women, the fight for justice-whether against harassment, assault, or workplace discrimination-is long, expensive, and often insurmountable due to economic and social barriers. The world remains skewed in favor of men: they earn more, hold more power, and face fewer stigmas.
    Yes, there are instances of misuse of laws, but they should not overshadow the fact that most women still lack equality in society. They face daily harassment, violence, and systemic barriers. Before rushing to equalize systems or victimize men, let’s address the deep-rooted inequalities that make these systems necessary in the first place. True equality cannot exist when women remain unequal in almost every sphere of life.

      You have claimed lot of subjective claim with most women. Do you have hard facts for it.
      Supreme court and judges themselves say that 80 percent of 498a cases are false.
      There are videos of court room where judges have asked women to earn themselves that asking exhorbitant maintenance.

    Problem is not in the law. Its the corruption in judiciary. Even in atul's case, the first person he named as culprit was the judge. Had the judge been honest, it would not have come to this.
    We have seen a video of a judge asking the wife to earn herself if she wants 6 lakhs as maintenance. Judge also made a comment that just because the husband earns a lot, doesn't mean it should be given to divorced wife. I think it all comes down to judge and lawyers.

    It is sad that courts embolden women to go to any extreme because they enjoy an upper hand.What money do they want from a husband when the women is working and earning fatty amounts ?. Their high handedness starts after the women have a legitimate child !. She now plays victim as a single women raising her kids alone. There is no stigma for the child or the mother since the kid had a father !. This harassment has to stop and the courts need to act impartially. I know of many cases where the husbands are harassed to an unbearable extent so that these women can lead a lavish life without out any societal norms. If the man is with a govt job then his life turns for the worse.

    If we expect the law to change, we live in a dream world. Many of our current laws are rooted in emotions, vote banks, and social conditions from a century ago. What we need is a legal system that is free from biases based on religion, caste, or gender but such changes are unlikely soon.

    Lawyers call it a package of 5 for women .
    5 different cases will be filed and fought 498a just being one of them .
    The judge who laughed is a cancer to society.

    Faye, you need to improve the quality of your research. Alimony is very much a part of the Indian family law system, but its application is one sided (as usual in India) where the husband has to pay the wife.

      Because India is still a patriarchial society and many women either are not educated the same level as their brothers, or after marriage need to make sacrifices of their career and support husband's career instead. India is also not a welfare state so unemployed arent supported and neither is there any support after retirement including no healthcare. So Alimony makes sense. Its also easier for men to remarry, if Atul wanted to he could but wives with the children isnt so easy. Alimony stops once wife remarries but that hardly happens. Domestic violence disproportionately affects more women than men.

      @ spare me the sob story about India being a patriarchal society. In today’s India women have equal opportunities as men in every field, especially in tier 1 cities. You are confusing maintenance (which is monthly payment during litigation) and alimony (one time payment at the end of litigation). And why are women seeking maintenance in courts when they are well qualified, and have no children? Of course there are genuine cases where maintenance is justified, but when qualified and capable women seek maintenance, they are weaponising the system against men. And the sad part is that such abuse of the law severely affects the outcomes of genuine victims.

      @@Newman79-zg6yw Equal opportunity is only on paper, not societal practice. Atleast now husbands cant just throw their wives out like their some garbage onto the street and remarry. The same way some women are weaponizing the system, so are men including trying to hide their income to avoid paying any support, and in this case going to the extent of committing suicide. Divorce is not fun, there is alot of stress on both sides not just 1 side. Theres alot of emotions including revenge and getting back at the other party. The court isnt interested in who did what or what caused the divorce, but they now have to clean up the mess of both couples who likely shouldnt have gotten married in the first place. Women and children are still the most vulnerable part of society, but I dont expect you to understand that because you're a man who has been brought up in a patriarchial society.

    People are only targetting the wife & mil but not the lawyer & police who suggests filing 498 so that they get adequate alimony & child support.Indian men don't even want to give child support firget nominal alimony. This law seems to be the way women can get adequate alimony unfortunately.

      @@zahrabjinu Indian men are more than willing to pay for child support provided they get an opportunity to meet the child and spend time with him/her equally.
      What Indian men are opposing is the lump sum alimony to be paid to the wife, which is usually demanded in crores these days.
      What Indian men want to oppose is the hefty maintenance paid to the wife on a monthly basis.
