What Miriam is trying to point out here is that the Constitution is an instrument that limits the powers of any government official so as not to abuse their positions. She specifically wants to highlight how, in the view of the Ombudsman, his/her office could just go about circumvent any other laws passed by the Congress, in this case bypassing or overriding the laws on bank secrecy deposits specifically foreign deposits and even a landmark SC decision on the Eugenio case. The law clearly says AMLA has the sole power to determine if any probable cause was warranted for an examination of a foreign bank deposit, then until such time can the Ombudsman file a complaint. But in this case the Ombudsman didn't even wait for the AMLA to pass their judgment and went ahead with opening the foreign bank deposits of the Chief Justice. It's a dangerous precedent 'cause she clearly can do, in her view, whatever she wants as long as she says that a probable cause is imminent. Her actions (Conchita) were unconstitutional in and of itself. That's the groundwork Miriam was trying to bring to light under such time constraint, and Conchita clearly knows it but was still beating around the bush. Conchita's intentions were brilliantly exposed by Miriam, the intentions being to aid in the impeachment of an incumbent Chief Justice, no matter the cost or the laws being broken. Miriam was merely trying to protect the office of the Chief Justice as the adjudicator of codified law, i. e. the Constitution itself. Because impeachment of such office would set a dangerous legal precedent by disturbing the very delicate equilibrium of the checks and balance of the three equal powers of state: executive, judiciary and legislative.

I miss those heated exchange of intelligent ideas and opinions…back then, senators were mostly lawyers who are knowledgeable of our Constitution and existing laws. Ngayon? Mapapa-hay naku na lang tayo! Yung mga iba natin mga senador ngayon, either sikat lang o anak ng sikat or pinatakbo ng among feeling magaling and sikat! Ganoon po iyan kapag may Senate hearings or preliminaries investigations na dapat lahat sagutin mo lahat ng tinatanong sa iyo ng Judges or Lawmakers, puwera na lang kung papayagan ka nila magsalita or mag-rebutt. They're both experts of law sir. They're once colleague, both Ramon Magsaysay Awardee. Conchita was only careful with her statement, she does not intend to act haughty before senator judge because that's the correct attitude of any lawyer facing the judge. When it comes to knowledge, they both excell, only is that one of them is at position to question and that the other is to answer. If Conchita was the senator judge it would be a different outcome. Don't underestimate Conchita just because she is demure at seat. She's as competent as Miriam. They once worked together. Ladies of different position will never be equal, but disregarding all that and looking to their qualifications alone they're both standout, almost few senators can achieve, not Bato, Tulfo, etc.
The current senators now, some, doesn't hold a single molecule of brilliance compared to the past senators like these ladies.
Now, all they have is greed. Nothing more.

I remember that I was still your while watching these two intellectual women and I was very amazed. So sad that the Philippine TV only focus on the “funny” part of the legislation during prime time news.
Philippines needs to raise its bar high by setting standards & have more intelligent, well-versed in constitution like late Sen. Santiago be seated in the senate.
Am fanboying the two women. Conchita stood her ground against one of the best lawyers anywhere of all time. If you notice she was flustered and in real time she switched into cold-heartedness. And Miriam was an unstoppable force. A force to be reckoned with. I didn't appreciate this lineup back then... Even Enrile was checking his notes. Three legendary legal minds in one chamber.
