Arbitrator who is appointed by the institition will give Awards in favour of the institution only. Therefore, if I am unable to find arbitrator for me, in such a case the Award will be passed against me. So what should I do? Please guide.

However, an arbitrator should have at least 10 years of experience in a relevant field such as law, commerce, engineering, or construction. An advocate who is not enrolled or registered under the Arbitration Tribunal may still have to comply with the rules and regulations of the Bar Council of India, which governs the conduct and ethics of Advocates in India. In answer to you first question: The arbitral tribunal can proceed ex-parte if the party fails to communicate or appear, unless there is a good reason. However, the tribunal cannot pass an ex-parte ad interim order without notice and hearing, as it is against natural justice and law. Your second query: Well, the answer depends on the terms of the arbitration agreement between the parties. If the agreement specifies the place of arbitration, then the parties are bound by it and cannot change it without mutual consent. However, if the agreement does not mention the place of arbitration, then the parties can request the arbitral tribunal to decide the place of arbitration, taking into account the convenience of the parties and the circumstances of the case. The arbitral tribunal has the power to determine the place of arbitration under Section 20 of the Arbitration and Conciliation Act, 1996. I hope this helps you.
