I had no idea who's add I copied because the facebook profile was discreet with a random profile photo. The add was amazing so I copied what works.. Would you remove or keep the add up after being approached this way?
As if you had no idea who it was . You started the video with everything you knew about the guys as if you didn't know his name on Facebook....
Copyright laws dictate that whoever took the photo owns the photo. Even if you're simply using it on your Instagram, Facebook the person who took the photo has the right to sue you if they wish. Therefore, explicit permission is required to avoid any issues.
You can't download and use images you find on Facebook without the permission of the photographer (or other copyright owner).
If i was you id pull the video down before he takes legal action also slander .

I copied an add that many resellers are using. Had no idea it was his til he approached me. His Facebook profile photo doesn’t show who he is so ‘potential buyers’ won’t know when responding to his add either. Took me back with his approach because if he’d actually explained the situation I’d have removed it because I’ve known him for 20 years. Wouldn’t have even copied it if I knew it was his because of knowing him. It is what it is now 😎
I used to be a fan but stealing his ad is a real dog move. And the defamation of the guy in this video, I hope he sues your ass. Your true colours are on show for everyone to see here

I agree as soon as you said public it was like you had a right to his photos/ad which brings out the arrogance considering he probably didn't know he was being recorded so therefor making you less credible in a sense and you bang on about community

Being on the internet makes things easy to access but you can’t take them. If I saw a Nike ad I can’t just download and say it’s my own because it’s on the internet
As far as I knew the photos were from google images. Multiple wanted to buy adds are using them. The first I heard of them being someones personal pics was in this video.. I just copied the add because it was good.
So you can't use other people's intellectual property for commercial gain. If he took the pics or made the ad, thrn he owns the pics/ad. Has the right to lawyer up. I wouldn't recommend his approach, but the first step is to request them taken off. No need for the nastiness, but maybe that does show his frustration of the theft of his property (photos/ad). The stealer of the pics/ad has also indicated much revenue due to the theft (not very clever). The person has commited and admitted to copyright infringement. However, there's no need to line lawyer pockets as everyone loses except lawyers... do better, be better and create your own.
Thankyou for showing Hahndorf swapmeet. I was considering going ,but that stupid bike race and the heat ruined my other plans . As a regular swap meeter I like to leave meat on the bone , it's good business as it supports the event and the business contacts and friends moving forward are essential. Some of the hungry dealers are just rude arrogant tools. My prices go up if they don't network with me or mates. It's not that hard to be courteous it usually leads to better deals.
One thing that spun me out was I used to sell lots of heat shrink $2 /m it helped my manufacturing keeping turn over volumes and product fresh , so I sold it $1 over cost. It was a good barometer of economy of a swap meet they all had a $2 bargin . It also said nearly time to pack up. After a few yrs selling many other regular sellers became copy cats selling alibaba heat shrink. I just laughed until amonth ago I had to pay retail for 2 little pks .

Hey mate, I wheel and deal here In perth wa, and I agree to work with other resellers. However people are naturally greedy unfortunately. I believe there is so much to go around, and its fun when you win with another person and share the reward. My business is all about relationships and my reputation. Sorry Danny but under intellectual copy right you can’t do what you did. Regardless of if it is in the public domain or not. He has the copyright. As with photos unless they are 100 years old they remain copyrighted to the person who took them.

Just because something's publically available doesn't mean you can take it and claim it as your own. That's plagiarism. I'm sure you could have taken your own photos and adapted the text to make it yours, but if it's a straight up cut and paste job of the original ad then the other guy has a fair point.
He certainly doesn't seem like the nicest person based on what you've said and some of his behaviour in the video, but that doesn't justify plagiarism either.

Resellers behaving like they have secrets and that what they do is novel is bizarre. The whole industry is built upon rinsing and repeating. Unless his face was in the photos, if they are just items photographed a particular way or words arranged in a particular order, there's no protection. But he said it best "it's not fair". There is no fairness in reselling, but there is courtesy and if he had asked nicely I'd have considered making changes to the ad.

You said that as far as you were concerned it was public domain (which is basically telling him to get stuffed). You had no intention of taking it down and you're simply blame shifting. You take zero accountability for your actions and are trying to make out that you're simply a victim, which is also not true.
By your reasoning (and I paraphrase), "I can steal anything I see on the internet and claim it as mine". (Which a lot of people do). The reason why many people refrain from that behaviour is that 1/ It's not Ethical. 2/ You lose credibility when people find out 3/ It shows that you lack common decency and respect for others.
He simply reacted to what you said. He also went on to say that he had lost most of his business because of what you had done and you laughed in his face boasting how much trade it had afforded you. Which is ironic because you said "there's plenty of trade going around" for everyone. If that's the case, why do you find it necessary to steal his advertisement? He did ask you nicely to remove it and you gave him a smart a$$ reply. I would have used the "c" word on you myself.

He had every right to react emotionally. You had the opportunity to be a gentleman and you refused to back down. Your true colours showing here - all you care about is going viral it seems. You're in the wrong. It's the guys photo's it's their copyright. If you're using them in an ad, he can sue you for damages.

That's incorrect. Due to Section 32 of the Copyright Act 1968 (Cth) copyright automatically applies to original literary, dramatic, musical or artistic work. The argument that there's no copyright protection if there's no copyright notice is incorrect. Section 10 of the above Act explicitly includes photographs within the definition of 'artistic work'.

You might need to be careful Danny. Unauthorised reproduction of his creative work may be infringement of his copyright under the Copyright Act 1968 (Cth). You wouldn't want him to sue you.

First of all, Public domain refers to works that are no longer protected by copyright, eg the time period has expired so that statement is already wrong.
Under australian law, the original creator of a photo owns the copyright to it. posting it online does not waive these rights.
Commercial use, as is what has happened here is a copyright infringement.
