This process is a tool of choice meant to allow corporate, or financial restructuring through a court application [Section 46 (3)]. In Zambia the applicable law is The Corporate Insolvency Act, No. 9 of 2017. Specifically provieed for under PART IV SCHEMES OF ARRANGEMENT AND COMPROMISE. The relevant Section(s) are as follows: 》S. 46 Compromise between Company, Creditors and Members (This includes specific classes of members and or creditors); 》S. 47 Effects of Compromise or Arrangement with creditors and members; and 》 S. 48 Reconstruction and amalgamation of companies. The effect of this financial restructuring tool of choice is that once it is applied it affects a class of creditors (remember that creditors may either be Secured or Un-secured) and members who should have consented to the company's proposal. It is a procedure agreed upon by the Members of a company, Shareholders and Creditors to forego some of their entitlements to enable the company to conduct business without worrying about their claims for a specified period. The "arrangement" refers to the reorganisation of the companies share capital as per Section 46 (1).

Companies are going to stop hiring...or only hire one gender or the other. As a small business owner, I can't risk hiring someone who might sue the company or have govt regulators constantly stopping my business to conduct investigations of one employee against another. It just isn't worth it. I can honestly say that this may well be the nail in the proverbial coffin for the careers of many.
