What Are 10 Year Charges On A Trust?
nice and simple ,, well done
Great episode - would love to see more long form content. Wouldn’t alphabet shares, especially with the growth going to a trust serious limit your choice of lenders? Lenders prefer vanilla circumstances. Also, if this becomes common practice, you can bet your bottom dollar the government will change the rules
Any trust or just irrevocable trust?
I’m not gifting my home to my kids, I’ve given them both deposits and furniture for there own homes. I’m selling my home and enjoying spending it on myself. A house is bricks and mortar, you can’t take it with you when you die. Enjoy your life before you die, I might go rent in Spain. 🤣🇬🇧
This is extremely risky advice and people should be very careful going down this route. The potential downside to these trusts from a CGT and IHT perspective is very large, and people should research this carefully for themselves before being gulled into going down this route.
Great Comment! As far as CGT goes on a main residence - not sure if you are aware there is no CGT (s223 or s225 relief). For IHT, there several strategies for reducing or eliminating IHT altogether. As commented: make sure your adviser knows what the heck they're doing! Mike
What if I put my house in a trust and later want to sell it and move? Am I stuck living in the same home for life? Also can my trustees sell it out from under me if the relationship goes bad?
Great Q's! A1: You can sell it as you should be a trustee. A2: No A3: No, as a Settlor you can have overriding powers.
Does it have to be parents to children, can it be between adult siblings?
Adult siblings are fine.
Was always led to believe trusts help avoid paying iht. Maybe this used to be the case but not anymore. Dealt with two "specialists" now on these matters and still cannot understand the actual benefit of a trust other then some protection ie marriage, care home fees, probate. But you can put things in place to offset these things ie hire private care instead of placing you loved one into a home it would be much cheaper especially if they already have their own home. Marriage is not for everybody. Probate savings are swallowed up from ongoing trust fees over time. Am I only one missing the point here? Surely if you want to avoid iht simply move to another country that isn't so greedy and pay nothing. Job done
Great comment, thanks for sharing. Not sure about ongoing trust fees - there are none when the family are the trustees. The point of Trusts is to stop the family from losing everything - having some legal protections in place.
Second properties should be illegal. A house to own a live in.
If a property is gifted to the children and the half way through the 7-year period (say 2 years), if the parent needs to go to carehome, would the gift still stand? Or the gift is cancelled and the council takes charge of the property. I understand the gift becomes less effective if the parent passes away before 7-year period. Just wondering what happens if the parent goes carehome?
The 7 Year Taper Relief is about IHT planning, not Care Fees planning. If Care is a concern, we recommend settling a Trust as far in advance of Care as possible. Time is the secret ingredient. For Tax planning the first 3 years offer 0% relief, after 36 months the taper starts. It ends after 84 months (7 years).
@@MPEstatePlanningUK I understand Trust is the best option for Care Fees planning. My question is once gifted, can it be recalled for Care Fees? Or once gifted, it can never be reversed?
When does mortgage payments go down Mortgage interest always goes up and property prices goes up too
Not sure I would trust an estate planner who doesn't know simple maths.
Me too! 😄
I have been contemplating a trust for my child but I can’t get my head round the face that there must be a caveat…why aren’t everyone creating trusts if it was so easy. I’m horrible at admin does it require a lot of accounting work on a yearly basis?
Two Q's in one; here we go: 1) 53% of adults in the UK will die without even a basic will - people don't use trusts because they don't want to learn/know/talk about this stuff(?) 2) There should be ZERO annual fees or additinal costs if you place your family home into a family home protection trust, and you and your partner (and adult chidlren are the trustees). How was that? Mike
6.30 - DISCRETIONARY Trust. Trustees can also be Beneficiaries. 7.30 - Consult an Estate Planner
How old can your children be when adding them into the trust ?
18 to act as Trustees. They can be added as beneficiaries at any age - but would only receive the benefit at the age of 18.
@MPEstatePlanningUK can you have your home in a trust if it's your main residence
@@ellissmith5520 Absolutely. The family home is normally the largest asset most folks own. This is our core focus. Mike
ive been on disability for 10yrs, now 42. Nan is likely to pass within ten years. There is hope, but no guarantee i can work someday. So chatGPT suggested i set up a discretionary trustfund (for myself) with the portion of the inheritance that will end with me, if im still disabled when she passes, so i can protect it from income tax and protect my disability benefit, and grow it via investing with view to buying a home. I found this to be a good intro video, thank you
What would it cost for this lifetime trust
It depends on the size of the estate and how much work is required. We publish a detailed price list on our website mpestateplanning.uk/ and a detailed price video on UA-cam ua-cam.com/video/H1XTaQQyGf0/v-deo.html
Thank you
I am a single parent to two adult children. If I leave my home in a discretionary trust, I was shocked to learn they’ll still have to pay 40% IHT on the amount above £335k and the £175k allowances. I thought trusts eliminated the beneficiaries, in this case my children, paying taxes?
Trusts CAN help protect assets above £500k from IHT - BUT you will need some tax planning in addition to the trusts. We do this everyday of the week (did two more today). Speak with a professional estate planner or give us a call. Mike
If I put my house into a trust today (to avoid IHT) would I be able to sell it in the future if I wanted to move home?
Yes. it's the same form with HMLR whether there's a Trust or no Trust. Easy peasy. Mike
Sadly, this comes too late for me. My mum had a fall in mid-April this year, spent 3 1/2 months in hospital and is now permanently bed-bound and living with me. It wasn't practical to let her return to her home because she would have been alone for long periods each day and night with no-one around - she had to be rushed back into hospital a week later in the early hours of the morning because she couldn't breathe, so would probably have died. She thought she'd done the right thing back in the 1990s, when she made a will, but the solicitors never mentioned putting the house into trust and she wouldn't have known, she just thought that making a will would mean everything she left would come to me. Now she has 2 carers coming in four times a day, but will need to go into a care home before much longer because I can't do alone what it takes two trained people to do, and I feel she needs more care than I can provide in between those visits, especially at night. Of course, the local county council were rubbing their hands together thinking they could put her into a home and put a charge on the house, something she doesn't want and neither do I, so we have cut them out of the picture and she will be completely self-funded. We will have to sell her bungalow and invest the money to make sure we can cover the costs (we have financial and health LPAs) and I just have to hope there will be something left. She is 88 and both her parents died in their 90th year so, if she follows suit, with the care home I've picked out the annual cost of around £65,000 (at the moment!) should leave me with something, but I shouldn't have to think that the sooner my mum dies the better it will be for me. It might be the truth, but it's not right and it makes me very uncomfortable to know that. It shouldn't be necessary. She worked all her life and because of that she gets no help until it's nearly all gone. I look at her now and I know that could be me in 20 years' time. It won't be, I'll make sure of that one way or another.
What if one starts a property company and make the children as directors and shareholders of A and B Shares. Would that be as good as Trusts and less expensive?
This can work. Taxes on businesses change every budget. Taxes on trusts change once a generation or so. Trusts normally win out over time, and are less expensive in the main.
In the UK, inheritances are usually not considered matrimonial property by the Court. So it doesn't happen 'all the time'. This is scaremongering. Also CGT is chargeable on trust assets once sold by beneficiaries.
Can I still live in my house if I put it in a trust , what if I have to go into care would the council say it is deprivation of assets
You can live in the house. The Care Act 2014 states as long as there is "no foreseeable need for care or support" you whould be fine with the local authority. The key here is to do it as far in advance as possible. Mike
@ 👍 Thanks
@@MrTpain1945 Welcome
Is it possible to put the children on the deeds and take myself off ? Would this avoid care home fees ?
Maybe? but you'd 100% trigger a Capital Gains Tax wouldn't you? (Disposal of the prop...) There are better legal ways - just hire a smart estate planner - they're insured. M
What about the accountancy fees of filing tax returns every year of a trust, as all trusts have to be registered? Are there any other costs involved if I set up a trust? Thanks, Sue.
If you put your home into Trust, there is no income. Ergo, no filing and no accountancy fees. If there is income - mandate it out to a bene that discharges it through their self assesment. There should a ZERO annual cost for MOST people - unless you've got an unusually large or complex situation. Mike
*What (if anything) can we Voters ACTUALLY DO to stop the £££ Corrupt/Evil Liebour Govt???????????????????????????..... :)
Sooooo how much does it cost to set up. Ball park figure
Really depends on what you need. We are the only(?) company that fully publishes all of our prices. Both on our website and YT. ua-cam.com/video/H1XTaQQyGf0/v-deo.html
A solicitor in the UK will quote you a fee if you ask.
My friends parents house was in trust but the local authority used the clause Appropriation of Assets. They can go through your bank accounts up to 10 years and if you have moved your property into a trust they will go after the trustees for care fees as it is deemed that it was to deliberately moved to avoid care fees. The same applies if you gift your property. Most people will end up paying care fees if you own a property and councils brought in this Clause in the last few years.
Great comment! With the autumn budget moving pensions back into IHT, this means that more and more people can plan for IHT based solutions - proving this is not solely for Care Fees. Care protection is always an additional benefit. NEVER the main or sole reason for the planning.
Theft
Do you have to wait till house is fully paid before a trust can be set up? Still have a few years remaining on mortgage till paid off. Thank you.
You can place a trust on a property with a mortgage. Here's how: ua-cam.com/video/gVrIfZZC3GM/v-deo.html
Our governments make migrants all English are migrants 8n the first place you are from Europe and Mongolia mixed with French German and Dutch all Romans who invaded Britain stayed and had kids all you mixed bred s called English are just European Asian mixes
Property theft....
Defense: Military industrial complex. Education: political indoctrination. Healthcare: Pharmaceutical industrial complex. Great society, eh ?
It seems like the complexity increases daily. Thankfully Trusts have been around for over 800 years. Stuff that doesn't work doesn't last. End of.
Can you put your house in trust before you have paid off the mortgage?
Yes. Over 60% of the properties we protect for families have mortgages. Here's a 30 second vid that explains: ua-cam.com/video/R5Jqh3uDIww/v-deo.html
I have power of attorney because my mother has dementia I want to sell her house to build a home for her
Sounds like a plan.
We kept a small plot of land when we moved can I get planning permission to build the house for my mother to live so I can care for her
Caring for your mother is the best of all ideas. Pls allow me to say "Good Man". Best health outcomes by far for Mum and good for you too.
Have house worth around 500.000 i have two autistic adults which are my children how can i put house in trust for them
Why should home owners have to sell their properties for care home fees when ILLEGAL IMMIGRANTS (so called 'migrants') get hotel accommodstion, free food, central heating, no council tax etc etc? Why both political parties shaked their heads as to solve the problem. DEPORT THEM. TO QUOTE TRADES UNIONS "ONE OUT ALL OUT"!
Why is not even mention about the possibility of child take care of parent him/her self?
Best outcome! Parents do v well with the attention of the family/children. It's even better when you can leave them some money - it helps. M
IHT is a tax paid by those who detest their heirs more than the taxman'
My mum wants to do this for me, she's single with just me, owns her home with no mortgage

My Mum's 58 now with no health problems, I'm her only son and she wants to make sure the house never gets sold to pay for care fees. So is a trust the best bet? and is time the main protector of assets?
Yes and Yes. The further in advance the better. In the MP Estate Protection Plan we document 9 reasons for the planning - none of which have anything to do with Care - all of which are 100% correct use cases of the planning.
Over 40 years ago, working full time, I also had a p.t. bar job on a Saturday night where one of the other staff was on benefits, working not declaring and no intention of finding a job. One customer said to me "You two will probably end up in the same care home when you're old, the difference is the government will pay for her care, but they'll take your house off you to pay for yours." Wasn't wrong, was he?

I can't see anywhere online that you're not allowed to apply for probate until 3 months after the death. I applied at about 1.5 months and received the grant 6 weeks later, and only due to my not sending the will immediately. It was a simple estate. Can you say more about not applying for probate for 3 months after the death?
How about if its a foreign trust? Also it will be taxed after expenses? TIA
