COMP Flash | Adoption of commitments in Apple Mobile Payments
The European Commission has accepted Apple’s commitments to allow rival mobile wallets to use the “tap and go” technology on iPhones for payments in shops.
As of now, competing wallets will be able to offer the same “tap and go” experience on iPhones that was so far reserved for Apple Pay. Consumers will benefit from more choice and new opportunities for innovation, while continuing to enjoy iPhone features and uncompromised security.
Explained by René Plank - Deputy Head of Unit for Antitrust Payments Systems.

    Seriously, you don't know how the economy works. This will only produce decay and less opportunities, not what you call "fair" market and innovation. How and why is someone supposed to innovate, when you regulate. Don't you see, it's literally the opposite side of innovation?😏

      Instead we should be letting monopolies collute and gatekeep others or buy them up and then either add it to their own or kill it when they own it? I'm not saying legislation is the answer but keeping things as they are is not the solution. Just look at the phone market with manufacturers en masse having non removable batteries. Consumers didn't ask for this. But will keep buying it because they got used to having smartphones in their live. Who would go back to devices that still have removable batteries but are worse and a lot less optimized for consumers?

    Yeah well everyone who heared about Meta's aquisition of Whatsapp for a staggering 18 billion does not understand the impact of this. I think the EU should go back and do something about this, they gained alot of metadata and other data from years of using Whatsapp to make the advertisement profiles more complete, and the rest they gladly sell to who ever wants it. If they can get a big fine for doing this then it is good for everyone!

    Well done! Great idea from DG COMP and very good execution from all four speaking here, both the moderator and the panelists! And I have a personal angle here - was in professor Whish's class at King's College many moons ago when he was at pains to make clear to us that it's guidance, not guidelines, on Art 102. And it was clear as day in the end :)

    Interesting debate. Thank you for organizing. And well done, Anneleen Straetemans, for bringing up the “polluter pays” principle in the discussion on “fair share to consumers”! Prof. Schinkel defended the idea that consumers affected by a sustainability agreement should be “fully compensated” for any costs they bear as a result of a sustainability agreement. But that is not what the EU Treaties say. First, Article 101(3) TFEU requires a “fair share”, not “full compensation”. What is a "fair share" should be determined in the light of Article 191(2) TFEU, which enshrines the “polluter pays” principle as a rule of constitutional importance. Ronald Coase would probably say that this reflects the allocation of property right on the basis of which market parties can and should bargain. If we consider greenhouse gas emissions as pollution, and apply the “polluter pays” principle enshrined in Article 191(2) TFEU, is it “fair” to allow producers and consumers to impose costs on those who do not consume, within and outside the EU? I submit not. The implication is that consumers need be compensated only for costs they bear, if any, as a result of a sustainability agreement *over and above the social cost of their consumption*. The EC and the CJEU are required by the treaties to take the “polluter pays” principle into account when applying competition law. All of that said, kudos to VP Vestager and her team for including guidance on Sustainability Agreements in the Horizontal Guidelines!

    This is much needed. The argument that a single AppStore provides security is false in its entirety since MacOS allows sideloading. Isn’t macOS safe? Also, many say that Google/Amazon etc will withdraw their apps and offer their own app stores. Again, this isn’t the case in android where all apps are available on the play store. Walled gardens are anticompetitive so people should get over their Stockholm syndrome, Apples only interested in keeping their 30% intact.

      I support 100% this act, waiting day when i really can own iPhone what i paid for. It should be al least optional and for example using Apple account to unlock sideloading permanently even if it means losing warranty, drm keys or whatever that i am willing to sacrifice.

      Stupid laws. Unlike Google and Microsoft, Apple isn't a monopoly in any of their markets. You're free to use any browser or message app you want. Why should Apple go out of their way to help their competitors who produce shoddy products?

      @@africa_explained_tv don't worry... if this act passes, apple users aren't forced to not use the AppStore. They will have a free choise (keep using the "secure" appstore or leave the cage as a free bird on their own will)

    Great, you’re allowing old people to get scammed now via encouraged downloads to app stores. This impacted Android users, and a specific case was COVID vaccines targeting those of advanced age and higher tech ignorance. They stole money from those people, but I guess it’s okay let’s ignore them and ignore people who bought into a ecosystem on purpose, knowing it was walled and more encrypted. Nintendo, Sony, and Microsoft consoles are now all open season to companies like Epic Games who demand profit above all else, and will move to create their own stores and remove their games from the default and secure stores that come with the device. Good job EU. Way to think this through. Furthermore, apples multidirectional cables predate the USBC format because they recognized a need for their users. There are also multiple specs within the USBC, and consumers on average don’t know that. Way to choose winners and losers. Just tax the companies and keep them from operating in vastly different spaces.
