One of the biggest plot holes is the underage magic thing. If an underage wizard uses magic outside of Hogwarts, the ministry of magic immediately knows about it and sends a warning. When Dobby uses magic at Harry's uncle's house, Harry is accused. This is explained away in the book when Voldemort kills his parents and pins the murder on his uncle. Rowling says that the ministry can tell when an underage wizard is present, but not who actually cast the spell. Hence Dobby cast the spell and Harry got blamed, and Voldemort cast the spell and his uncle took the blame. Here is the plot hole. All underage wizards live outside of Hogwarts, some live amongst Mugols. Every time their parents or elder siblings legally perform magic the ministry of magic should send a warning.
