Don’t Believe Rumors of Disagreement Between NAR and Your Regulators About the Antitrust Settlement
frascona.com/ - The plaintiffs in the settled antitrust lawsuits were sellers, not buyers. It is natural that regulators may not be keen on settlement terms that intend to help sells and may hurt buyers. Yet the Division is not stating that it will prosecute brokers for honestly complying with the Settlement Agreement. Colorado law does not prohibit the settlement’s terms requiring a written agreement between buyer-side brokers and buyers prior to a tour.     My fiances mom recently passed, and we discovered a deed that from my fiances grandfather towards my fiances mom. The deed stated that when he passed, she would get his land and rights to sell the oil on its property in Texas, and she gave him $10 in exchange. Unfortunately, my fiances mom and her grandfather had a falling out. She hadn't spoken to him in years. When we went to see on the property after she passed, we learned that he had passed some years earlier, and my fiances mom was never informed. After my fiances mom and her dad became estranged, a special warranty deed was created for a woman her grandfather was dating to get his land and oil with no exchange of funds involed and no notification to my fiances mom who had a deed prior to the special warranty deed. Which deed would hold up as the true deed in court?

    Mario, our firm used to have a minimum 2.8% required coop. I went home as a listing broker more than once with 1%. Advertising Costs were covered. No profit for my hard effort. Those rules are gone now. I will charge back for advertising now on propties separately from commissions. instead of comping it.

    Yes. We should get rid of NAR. Thankfully, my broker has a separate entity for "non-members", but of course I can't say I'm a Realtor, just a Real Estate Agent.

    This just happened to me and the seller agreed to return earnest money but refuses to reimburse inspection ($600) and appraisal ($700). Realtor suggested small claim court, so I need to hire a lawyer too? This is my first time buying a house and I am so bummed. Seller backed out a week before closing. Thank you!

    the wording on mine is: "The charge for this coverage is $25.00 per letter issued." That just sounds like it could turn into a lot. how many letters are issued?

    In my view, the crux of the matter lies in the "strict due on transfer" clause. Even "assumable" loans are difficult to actually assume., meaning parties are knowingly violating the loan covenants. Seems not smart. The seller will be liable if payments aren't made and was only used as a last resort among sinking ship owners in the great recession as a way to hopefully avoid foreclosure. From the "lender's" perspective (being that we have Fanny / Freddie loans bundled and securitized) the creditworthiness of borrower is the more salient matter, not the management of interest rate risk (that's for the bond holders to worry about). So, can't wait to hear your risk management strategies for the seller's who are willing to wrap their loan.

    Do you guys charge a buyer a fee if they default on a contract? For any reason that makes them the party to be at default... do you as a realtor charge something for your time and effort? or you have a representation agreement and they just choose to stop looking for homes weeks into it but by then you already spend time and travel expenses on visiting 20 some properties? just need some friendly advice.

    I don't understand the Termination and Objection deadline on the same day? How does the seller have a chance to resolve the objection after that date has passed? Does the contract terminate at midnite if there's no resolution by then? What am I not seeing?

    Hi, if a buyer realizes they are going to default on the contract for deed, and they apply for some type of bankruptcy, is there a potential for the judge to award title and full ownership to the home (perhaps under a homestead protection law) and for the seller to lose out on the remainder owed? This is in New Mexico.
