By Attorney Maria C. Baler
Under federal law your estate will not pay an estate tax when you die unless the assets you own at the time of your death (your so-called “taxable estate”) are valued at more than $13.6 million (in 2024). This is a big number, and most people don’t come close to having to pay a federal estate tax at death. But here in Massachusetts, we have a separate state estate tax with a much lower $2 million exemption amount for those whose deaths occur on or after January 1, 2023 ($1 million prior to that date). Given the value of our real estate and many people’s growing 401k accounts, it is not hard to get to a $2 million taxable estate if you are a Massachusetts resident. What this means is that your estate will pay estate tax at your death, or if you are married at the death of the surviving spouse, unless you undertake planning to reduce or eliminate the tax.
One of the assets people own that drives up the value of their taxable estate at death is life insurance. Although life insurance proceeds are not income taxable to the recipient of the death benefit, if you own a life insurance policy insuring your own life, the death benefit of that policy will count toward the value of your taxable estate at your death and will be subject to estate tax. It is not uncommon for parents of young children, business owners, or those with sizeable estates or large mortgages to own a life insurance policy with a death benefit of $1 million or more, to provide an influx of cash at death. These funds may be earmarked to help pay living expenses for their survivors, education expenses for children, to pay off a mortgage, or to provide cash to pay estate tax at death.

    Hey Ms. Baler, regarding a trust.. (can one just add the would be beneficiary as a joint account holder to say ones own savings /checking account.. to avoid being taxed as well and have immediate access to those monies, if one passed away.)....???? I do understand now.. The trust allows one to get public benefits.. if needed. Thanks for explaining that.

    Good video. If a spouse owns the home all by themselves (including on deed) and then does a Will giving it to a cousin or friend, does anything in the Homestead Law say the surviving spouse or children to 21 get it. I know they are protected against creditors, but do they get to own or use the house if the owner didn't Will it to them? I am excluding whether the Elective Share law may let spouse use the real estate. So, does spouse or children ALWAYS get to use the Homestead????? In Mass. Mass law is confusing .

    Medicaid and Nursing Homes have a 5 year look back policy for what they call asset recovery. They can put a lean on your home for reimbursement of payments for your long term care and health expenses even if you transfer the title to someone else, (like a family member), or put your home in a revocable trust. Placing your home in a trust at least 6 years Before the need for Nursing Home placement can help to prevent such leans. Setting up an Irrevocable Trust Fund for nursing home and long term care can also help prevent having a Government or nursing home lean on your house.

    Many, many years ago, before I was born, my aunt and uncle were killed in an accident. My uncle either died at the scene or shortly after he arrived at the hospital. He had a will that left everything to my aunt but made no provisions for his underaged children. She died 3 days later without a will and with 5 minor children, the youngest of whom was only 2 or 3. That meant that estate couldn't be settled until he turned 21. Basically they couldn't use any of ny aunt and uncle's money and had to go on welfare plus contributions from the extended family. My parents' wills always included the requirement that the beneficiary must survive them by 30 days, else there was another beneficiary, plus providing a guardian for me. Other people's parents threw big parties or bought them a new car when they turned 21. My parents took me to the lawyer to write my will. They also had to redo theirs to reflect that I was of age and didn't need a guardian. And please go to a lawyer to draw up your will. Don't do it yourself or use one of those will kits you see online. You have no idea how much money lawyers make fighting those wills in court. Many of them don't even meet the most minimal legal standards for a valid will.

    • @TheK9Shepherd
      @TheK9Shepherd 5 місяців тому

      Honestly, creating a trust is not that bad or hard. The lawyers do everything. The initial cost will sting. It could cost between $5000 to 10,000. Depending on the complexity. The cost definitely outweighs needing to go to probate. Because that could be a very lengthy process. Even if there’s no family turmoil and maybe you’re single or maybe have a couple siblings. Having everything in the trust is so much easier to liquidate then going to court and proving everything is passed down to you. The trust and a death certificate that’s literally all you need when needing to work with the bank, the town, realtor, etc. We kind of dealt with this when my wife’s brother passed away. He died intestate which means no will or trust, but his assets were below $186,000 (which is the limit in our state before you have to go to probate). It was so much easier closing his bank accounts re-registering his car. No court involved at all

    This video on last-minute gifting and estate taxes was super informative! It's a confusing topic, so I appreciate you breaking it down so clearly. For someone like me who isn't a legal expert, are there any red flags to watch out for that might indicate needing to speak with an estate planning attorney? I run a dream interpretation channel, and I'm always curious about how people deal with anxieties around the future in their dreams. Do you think there's a connection between people's financial worries and the types of dreams they have? This is exactly the kind of practical legal advice video I've been looking for. Great job! @@TrustVictims And it's not so much fraud or a scam. It's just that when you refinance, for whatever reason the house gets pulled out of the trust. I am sure it was on the up and up however with a 70yo mother in law, I am not sure she fully understood the ramifications. Or if there is even a choice to opt out to pull the house out. Anyways, just FYI if you refinance with a house in a trust 🙂

    Regarding what you found about Lincoln declaring Thanksgiving a national holiday: This was, as I understand it, an action full of significance. 1863 was in the midst of the Civil War. Thanksgiving was celebrated in many localities at that time, but there was no sense of it being a a national ritual. Lincoln hoped that by declaring it a national holiday, it would provide a little bit of a sense that "we all do this together, North and South," a glue that might do its small part in binding the nation together.

    It sounds like Massachusetts has it right. It would de-incentivize people to murder their families and friends. Besides first-degree murder is the most serious crime one can commit and usually is punishable by life in prison or execution which would render they're goods useless because if you're in prison you cannot go to the bank and more than likely they will not come to you. So 👍 Massachusetts
