The lady is struggling to answer the friendly evidence leader. She will collapse under the robust cross examination of Adv. Sikhakhane SC. She is labouring under the false impression that the presiding judge will be disgusted by the nudes and explicit photos. The presiding judge is a seasoned legal practitioner who has seen all. He understands that explicit photos are taken by human beings and are sent to other human beings. There is absolutely nothing wrong in asking a consenting adult to send you an explicit photo on a private platform as opposed to a public platform. That is neither immoral nor disgusting, especially to a person who is playing along. Women send explicit photos to their husbands and boyfriends everyday and there is absolutely nothing wrong with that. The JP is not her employer nor is he her immediate supervisor. They are both employees of the Department of Justice and their work relationship is tenuous to say the least.
"Hayini" in this context means that the author is shocked and therefore "uyakhuza"

Sometimes, I fear that the interpreters interpretation may amount to giving evidence that might need to be tested later. If the complainant later refutes a particular interpretation as having not been hers, evidence will have to led in that respect. However, she is to be commanded for her genuine attempt.

Yesterday the Chairman said he usually requests that the respondent sits next to his attorney. After today where it's alleged the JP whisper was heard, why isn't he moved next to Adv Sekekane. After all it is intimidating for him to sit so close to the complainant

Adv Sekekane is too happy that his client is not sitting next to him, his job is to create reasonable doubt and looking at procedural errors as anyone with one brain cell knows the JP is guilty.

It’s not flirting. There is a power imbalance between the perpetrator and the victim. It’s sexual harassment.
The power balance between the judge president who is a direct senior and a secretary in his department should not be overlooked. It can never be a relationship between equals.

I suspect if this lady took this issue to human resources maybe she didn't get any help since the other person is a powerful person who is the head of that whole Eastern Cape region, so maybe HR were intimidated and they referred it to a higher structure

“Hayhini!!” Is an expression that would b used in Xhosa to express elements of shock. It does not mean NO, especially in the context at which it was used in these chats. A language expert may need to be brought to testify here. To even add, why would Stop be accompanied by emojis like “😂🙈😝”. If it was stop then these emojis would have been applicable “🛑✋🏿😡”. The complainant contends that she was annoyed and used these emojis throughout 😂🙈😝.

Evidence will tell. If he is not wrong, God be with him. We cannot shy away from incidences of this nature at workplaces. The same strength of empathy should go to the complainant in the event she does show a good case. I do feel for the judge, but nativity to incidences of this nature kills the society. Sadly, right or wrong, the JPs image will be forever furnished despite the outcome. So sad.

Justice MR Madlanga is from my Al Mater and m so proud of him, he distinguished himself everywhere as a jurist of highest order in terms of legal acumen, knowledge and application of law....He alawys makes sense in court more especially when he engages counsels, he will be wearing a "smile" but hurting the counsel with his searching questions....I salute you Sir...4/1/2025

I appeared infront of the JP (D Mlambo) I think 04 times...I must confess I was a bit scared the first time, 25 September 2018, he asked searching questions which at times I was unable to respond meaningfully but overall he struck me as a Judge who could summarize the issues in few sentences and ask the counsel to respond or address him on those narrow issues and he would then keep quiet...The subsequent times I appeared infront of him I had learned his trait and became comfortable...Note made on 3/1/2025
