    If the tenants regularly pay the rent late, like on the eighteenth or twentieth of the month instead of the the seventh of the month as the lease agreement states, how long must I as the landlord give them time to pay if it's a month to month agreement?

      Hi. There is no obligation on you to wait for payment. In your case the tenant is in breach. The question is whether you want to terminate the lease or not.

    The tenants payed regularly for 20 years. Late payments started in July thus year. Now their one month late again.

      Hi Trish. I believe that this may be an American concept. A similar concept in South Africa would be First Home Finance. & Subsidy Asistance. In the latter instance, yes, one would still be able to estate plan.

    Thanks for your answer, Bronu. The tenants have been livivg in my house for 20 years and are retyred. I can't do the pie in the face of the landlord thing. Little change of success. Will have to get access application and sell the place at a reduced price, as a investment property.

    So, if you just not pay, it's spolation too? Some landlords have lost properties when the rates and taxes mounted and tenants don't pay anything.

    Just watched a public hearing in the S.A. Parliament where the Superior Logic and Natural Intelligence of the ANC and EFF is on full display, repeating their demands to expropriate land from all whites. This just proves the incompetence and bad faith of the EFF and ANC on land rights. At this stage, the Government should buy all the land from the whites and hand it over to the blacks. Then, everyone will see that it will all go to rot and the none of the land will be made productive. These crazies deserve what they get and it's the whites and poor blacks who suffer!

    If the tenant doesn't pay the landlord continues to pay rates and taxes. It's even worse in complexes where you have to pay a levy too. Your asset then becomes a loss making millstone, dragging you down.

      In Ohio, in a m2m at least 30 days notice is required unless the contract in effect calls for something different. Not an atty, just a LL.

    You can't call yourself an executor until you have been given the letters of executor ship by the master of the high court.

      That is correct. Only once the Master authorizes your appointment will you have authority to act as executor.

      Only 1 time I dumped a jug of old Pepsi in the sink and it got plugged up. So I got my plugger and got it unplugged myself last year.

      @@brunosimaoattorneys1469 Tell others managers and owners that if you plugged up your sinks and tub drain get a plugged at CUB FOODS areas of laundry soap on the shelves with the plails brooms, which is helpful to pay it yourselves and then if it still doesn't work on unplugged it to call the rental office staff know and get a work order for it.

      If a former tenant was living here in st.paul Minnesota apt ames lake apts where she was living here in the same unit as me and all the things I got blamed for it is not me who did it only 2 hing in a cabinet, hinge loss and drawer fell off. Otherwise I would have to clean out my tub that had her black hair in the tub drain I took out not the cleaners. Other was pee of her cat and few were mine but I clean up it myself. No holes in the walls. I was told by ucare that she will pay it off. I hope so too.

      Hi Sally. Interestingly, the concept of an automatic 'grace' period is a myth. Rent is payable on the agreed date. If the tenant fails to pay, a letter of demand can be sent affording the tenant 20 business days (according to law) to remedy, after which the landlord may cancel and proceed to evict (through the Court).

    Another question, what is the law if you purchase property in personal name and married in community of property, can partner claim 50% of property if they never contrabuting financially for the property?

      Although certain circumstances exist where the spouse cannot claim (certain divorces, for example), the rule of thumb is that the estate is a joint one and that upon divorce or death, it is simply split down the middle.

      Hi Kerri. The short answer is that the cousin had no consent from the owner to take occupation and is there unlawfully from the outset, therefore entitling you to their eviction.

    My case has going for 7 years already and all is stuck at the masters office. It's really draining year after year no change in the situation. My lawyer always says there is a backlog at the masters office and they are moving slow

      Hi Matshidiso. Unfortunately, the Office of the Master of the High Court is notoriously back-logged. That being said, 7 years does seem a little long but it's difficult to comment unless we peruse your matter and provide you with advice. It's possible that it's a very complex estate subject to litigation, which is why it is taking so long.

    Enlightening, thank you very much. I have a question. As I plan to on sell this property that I currently have to end buyer, the end buyer is not a cash buyer, she is financed by a bank, her loan has already been approved. I just needed to know with a B2B deal is there a specific agreement/contract for people looking to purchase a property through bank financing, a loan? And lastly sir, when signing both sales agreement with the seller and an end buyer, do we have to be physically present at the the same time? Since the transaction has to take place the same at the deeds office? Thank you.

      Hi Donovan, We are so happy that you found value in the video. To answer your questions: 1) An on-sale agreement has certain special provisions, such as a condition making it subject to the first sale, the exclusion of the warranty of current ownership, etc. Whether the purchaser is taking a loan from the bank is only important insofar as it is important to have the right disclosures in the agreement. 2) No one needs to be present at the same time, nor do the agreements even have to be signed on the same day. Ideally you'd want to conclude the first sale and then the second, but each person can sign and the deliver the documents (especially in the midst of COVID).
