How do we handle a situation when we buy subject-to, sell on a wrap, and then get hit with due-on-sale? What happens with us and the new buyer if this happens?
It's all bs. Laws need to change. It shouldn't be so hidden. Courthouses should handle this with one file, but it's America, so of course it's absurd.
If we are doing seller financing... Do we need to hire a closing agent or can we just work with a title company to handle all the documents the closing agent would handle ?

My concerns that I haven’t heard addressed by any videos: How do we protect ourselves from hyperinflation? We don’t want 6% in the future if cash becomes toilet paper. What if we only want to finance for no more than five years? How do we accomplish the paperwork? How do we screen buyers?

If people don't have money to afford their taxes, how are they expected to pay off these liens? Seems silly

I believe the main reason these things are changing is due to realtor organization lobying state governments. I spoke with a broker last week who was so glad these regulations were being passed. He told me that he believed any transaction that wasn't done on a TREC or TAR approved document, with a broker involved, was shady. I just laughed because we closed 15 properties in 2023 with contracts that were written by attorneys and no brokers in sight. They all closed, and nothing was the least bit shady. I say that being a member of a non government organization that wants to pass down rules and laws that only benefit its members is "shady." I'm talking to you, TAR...lol

There aren't enough "great" deals out there for all of the UA-cam real estate talking heads. Therefore, there aren't enough for everyone else. The reality is that even the UA-cam talking heads will be "shocked!" when they see where home prices end up in 2 years. The very best real estate strategy right now is to #Liquidate!! "If' you can find someone who is clueless enough to buy right now.
This is great, it's just as important to look out for your buyers as well as your sellers.
I am looking at buying a property with a wrap around. I ask to be able to pay the sellers mortgage and pay him the difference so I know the mortgage is being paid and they said no. How am I to be sure the seller is paying the original mortgage?

Market driven rates are almost at a top. Long bond tracker TLT will likely trade to about $80/sh so, getting close. Of course when "market driven" (not Fed manipulated rates to refund the banksters gambling accounts) start to drop it means the stock market is in full meltdown mode. So I'm currently in this situation. I sold to owner occupants through seller finance on a wrap. On the 10th day I hired a lawyer and letter of intent went out. My question is once they receive the letter and they decide to want to communicate, should I refer them to my lawyer or communicate with them? I would love to work something out but I also don't want to screw myself either by saying the wrong thing. They've made every excuse in the book on why it's my fault too just like you said they would. It's funny to me that everyone wants to play victim. They even hired and attorney with a letter I received with bogus lies that I can prove otherwise. At this point, I just want to get the house back and seller finance again or just get it out of my name completely by selling it for a little more than what I owe.

Great info, Scott - I have a question about a Solar note: can/should that be included with the new note, or assumed separately f/cash off the top? From what I understand solar is assumable at .99%, 59,343 w/~23yrs left, 1st is @184,850, 3.75% and also ~23yrs left. Zillow shows value@$475k.
