Such shabby oral submissions, and ludicrous admission by the judge himself in an open court, " yes police have made an error; but ..... ". But, what ? Doesn't the judge know, error is error, one has to pay the price for one's error. The defence advocate also I find, is not upto the mark, he ought to have laid emphasis on, " Acknowledgement of accused signature on copy of the notice and, I repeat and that it could have been procured backdated, while the alleged accused was in police custody". Further, about the defence advocate seeking permission to produce taped conversation, ridiculous, he can as of right rely on the recorded conversation, to make out a prima facie case, burden of proof will shift on to the police, by virtue of supreme court case law.
