I think that this series needs to be followed up with a post-script because the legal fallout from the lock-down has not concluded for those caught up in it. You noted the failure to consider Maori and the Treaty of Waitangi. One element of this consideration was the ban on hunting and the gathering of food resources. Although if is often pointed out that Maori are predominantly living in urban areas today, this overlooks the fact that Maori are significantly over-represented in minor urban areas and in many cases still call rural areas home. The issue of hunting also applied to the wider rural sector, with Federated Farmers advising members they could engage in pest control on their property when the Prime Minister was saying hunting was banned. This confusion has led to real-world consequences with people losing their firearms licences and having a permanent stain on their record as a result. There will also be the issue of losses incurred during the lock-down and also issues around liquidation and recovery of debts. As you point out the picture away from Lampton Quay is very different, the legal fallout for some sections of our community will continue for much longer than some other sections.

I guess I had a different expectation going into this mock arbitration. I thought that the arbitrator was going to hear the conflict, and arbitrate. Instead this sounded like an argument over the arbitration itself. This just doesn't sound right. I think the arbitration itself is adversarial--but the agreement to use arbitration has to be consensual. So that part of the process was (I expected, naive me) "negotiation", not argumentation.

I don't get it--why does someone have to go into arbitration when one does not like the arbitrators? Isn't there some process for that? Can't the party just walk out of the arbitration at the beginning, since it has not really even started yet?

Gee...I would hate to go into arbitration, and immediately find myself in a conflict about the arbitration itself. If I were the other party, I would say "shall we just forget this, and try again later in some other venue?"

WAIT! So the parties agreed to binding arbitration--and THEN they decided that the arbitrators are not partial? Then why are they doing arbitration?
