    I have a question about COO. Just imagine there is a warehouse at FTZ and they imported different parts from different countries, example: windows, windshield from Poland, Tires from China, engines from Japan and body car from Malasia. and they build a vehicle with those parts, and I have to fill out the form 7501 for import from FTZ, the merchandise is a vehicle, What is the Country of Origin of the vehicle that was assembled in the FTZ?

    why is it important to liquidate import duties?

      Liquidation of duties is an important part of the import process. It can be correlated to receiving a receipt of payment. In this case, the payment is for the duties owed for the imported merchandise which is tendered to Customs and Border Protection. An importer should be familiar with this process and reference the Code of Federal Regulations Title 19 Part 159 (CFR19 Part 159) for complete details on liquidation of duties.

    So who actually fills out the entry? The importer or customs agent, right? Within 24 hrs of arrival to the port, right? Once the shipper and freighter have supplied their required completed forms (including the commercial invoice, bill of lading, and ocean cargo manifest), right?

      Customs entries can be completed by an Importer if they are authorized to self file or the Customs Broker operating under power of attorney on behalf of the Importer. Ocean freight entries can be filed prior to arrival at the port. Best practice would be to file at least 5 days prior to estimated arrival which allows Customs and Border Protection to accept the filing. An entry can be filed after arrival but is not considered best practice and can result in other storage charges. Imported merchandise should be cleared within 15 days after arrival to avoid General Order.

    I have a question: What if you buy your own materials overseas and want to send them here? It's an import here, right? So computed value would be best, right? Because you can deduct all your costs including ocean shipping.

      Bringing materials that will be brought to the US would typically result in an import or declaration. There are other methods to bring products inbound for further processing as well. Typically, transaction value is used as the first option of valuation. However, if there is a reason that this is not available or logical, there are other valuation methods that can be used. It’s important to consult with a trade professional on the best method to manage your import declarations if it is not clear. We would need a few more facts to answer your specific question!     I think what you're saying is that Foreign Inland Freight cannot be deducted from the Transaction Value when it (the F.I.F.) is "bundled" (paid to the shipper on commercial invoice) along with the ocean transportation charges.

      Thank you for the comment, Chris! To answer your question, under Transaction Value, origin inland freight can only be deducted if it is included in a through Bill of Lading (an Ocean Bill of Lading that includes inland freight at origin). Otherwise, origin inland freight is included in the Transaction Value. You can find out more about this in the Customs Regulations, 19 CFR 152.103(a)(5).     You mentioned many times in this and previous videos about having "procedures in place...". What is that supposed to look like in the real world? Does that mean the broker should have brochures or maybe e-docs with government links that inform their clients of where they can read up on any topic of interest to them which then have a place for them to sign at the bottom signifying that they have been made aware of resources that they can access to know first hand what is expected of them and what options they have? What about "procedures in place" that are for acquiring and documenting details like place of origin, whether a foreign company utilizes foreign contractors, child/slave labor, etc? How is one supposed to go about asking or discovering or documenting stuff like that?

      Whereas Customs Brokers are invaluable resources, they are not ultimately responsible for your imports. The “procedures in place” are owned by the importer. In the real world however, many small importers place significant reliance on their broker, and should expect that their broker provides information and Custom’s requirements regarding the importer’s products. There is, however, certain risks the importer undertakes by doing this. One of the points of emphasis from this UA-cam video, as well as other videos in this series, is that the importer may need to engage experts to assist them to ensure compliance with Customs and Other Government Agency regulations. The real world for larger importers is one in which they have this expertise inside their company. Similar, but not necessarily the same as Customs’ requirements, are the questions you raise regarding sourcing of products from international origins. This is no different than a “know your supplier” program one would conduct in the United States, just vastly more complicated. Laws here in the US dictate to suppliers how they can and do conduct business, which grants certain assurances to buyers . Unfortunately, there are many countries whose laws are less strict or run contrary to US law. Depending on the level of complexity of products, geography, and supply chain again suggests experts may be needed to assist. There are companies which specialize in this type of initial review of foreign suppliers, and ongoing inspections of these suppliers. As previously noted, “procedures in place” are yours as the importer/buyer. These are very important to ensure repeatable compliance as they outline who does what to all involved in your supply chain, as well as your employees. They should be realistic and sustainable. Procedures put in place prior to beginning an import program or as your import program grows is time well spent. Please let us know if you have any other questions!
