Please note I don’t agree with you, we have an epidemic of selective enforcement. I am working with Legislation as I am the Florida Chair for the National HOA Reform and a victim. Sadly, CAÍ/ HOA Attorneys have used the law to enrich themselves with the suffering of homeowners specifically seniors. We are going to continue the reform to protect homeowners. Hello, and thank you for your info… My Winter Springs Florida community has ‘two’ separate Declarations of same Plat Book and Pages and neither has Kaufman Language. Original was created in July of 1973 and second was in Sept. 1973 by same Developer but neither addresses the other’s existence. Original was never ‘preserved’ but second was preserved. Also, developer never gave enforcement powers to any HOA in the Original Declaration. As I understand, Florida is a ‘Notice’ state, meaning first to record in County wins. So… As per contract doctrine, should the original Declaration be needing revitalization and followed since the HOA is only following the second Declaration rather than the Original?

For HOA Community can you nominate yourself off the floor on the Zoom annual meeting and s rren share your proxies you have to run for the board position? Also, if only 3 homeowners are running for the board position and their are 5 seats according to your by-laws. Will the 3 automatically get elected if they meet all the board member requirements?
