Do all the math you like, it's easier than that, take units off the market, the demand for the available units goes up, up goes the prices. As the prices go up, tourists go elsewhere. It's the small local businesses that hurt most. When we visit Maui, we go shop local exclusively. The prices where we stay (in the hotel/condo zone) has tripled. Sadly, may be time to go elsewhere.

I don’t have a Maui property though…yet…maybe someday…I almost bought a home in Houston Texas in June but I couldn’t handle the high temperatures near 100* no matter where you are. Than after I canceled (I was the 3rd buyer to do so) the neighborhood got hit with a hurricane and some of the beautiful tall pines fell through 2 homes and 2 women in 2 separate homes unfortunately died. I loved staying in Kapalua villas but it would take everything I have to buy one at 65 years of age. Maybe someday…I’m also thinking of Central Europe now too though…Keep the listings coming! My Buyer's Agent found a home listed in the newspaper and decided not to show it to me because it was a FSBO, and the owner was not offering a commission. I also found that home in the newspaper and asked my Buyer's Agent about it. Long story short, I bought that home and directly paid my Buyer's Agent. I will never again use agents. It was in the year 2000 for $215000 in Longmont Colorado, when interest rates were 7.25%. Now, it's worth about $500000 and I recently paid it off completely after cash-out refinancing it several times.

The small income we were making is supplementing our Social Security income. This is a family heirloom in our family. The market has dropped so much because of this that we are now going backwards because no one is coming to the island for vacation. What can we do? We can’t sell it as it is a family heirloom. Plus it isn’t going to sell because of what’s going on. We can’t wait along time for the economy to change. We will go bankrupt at this rate.

You didn't even address the likely financial outcome for many of these units. For example my son owns a 460 sq ft studio condo in a west Maui building that is almost all short term rentals. The current HOA fees are $1250 per month. Current taxes are $665 per month (assessed valuation is about $640,000) and insurance is about $100 per month. That adds up to about $2015 per month. In addition he pays a management company to handle the leasing, cleaning, etc. that takes about 25% of what he receives in room charges. The most net income he ever got in a year was about $50,000 (about 7.8% return) and he's owned the unit through Covid and the aftermath of the fires where he had all the same expenses and no money coming in. As a long term rental the taxes would drop to about $160 for a total cost of about $1510. He doesn't have a mortgage. Long term rents for units this size seem to be about $2300 per month. He would have to hire a management company to manage the property at about 10% of the rent ($230). So he would end up with total costs of about $1740 per month for rent of $2300 and a gross profit of $560 per month or about $6720 per year on a property worth $640,000. That's a profit of about 1%. He'd be better off putting the money in a savings account. Most owners have a mortgage on their properties so they have a much higher cost and would be losing a substantial amount of money each month. Obviously no one can afford to own this property under these conditions. In addition the building is over 50 years old and will be in need of a number of expensive repairs in the next few years so the owner's costs will go higher. Let's say the value of these properties collapse and now a "lucky" Maui resident can buy it for the new bargain price of $350,000 with a 6% mortgage for 80% of the sales price. They somehow come up with $70,000 down payment and then have a monthly payment of about $1675 per month, plus the HOA fees of $1250 plus the $100 insurance and their new cost is $3000 per month for that same 460 sq ft condo. The condo has only one small closet since it was designed for long term living. And as the building continues to age the upkeep costs will increase and the condo resident owners will have pay for all those increased costs. But at least they have a place to call their own right? Since the costs to live there are so high they will struggle to be able to meet those costs and the units are likely to fall into disrepair. And those people who have worked hard for years and had already were able to buy a place of their own may find that the value of their home has dropped to less than they paid for it. Of course that assumes that they didn't have a job that relied on tourism so they didn't lose their job or have their hours reduced because their boss lost business. And assumes the increase in tax rates that are inevitable for the lost tax revenues from the STR properties. And this also assumes that the STR owners aren't able to get a restraining order to stop the new regulations while they fight it in court for many years. Meanwhile the FEMA leases expire and they are right back in the same place they were after the fire, because the county STILL hasn't done anything real to build more affordable housing.

If you remember Mayor Bissen’s campaign for Mayor during the last election, I don’t believe he ever said he was running for all the people on Maui, but for the Kanaka Māori, and you aren’t included in that group, as well as most owners of STR properties.

Just wondering, what happens if the tenant improves their income do they get evicted after they have been a good tenant?

Short term rentals have driven up the cost real estate on Maui. Residents are competing against entrepreneurs that that see residential properties as a business proposition.

This is first time I'm speaking out... And I'm all about providing homes for the local residents!!! We came from Virginia where they provided much housing being a "commonwealth state" it's very interesting how everyone is coming out of the woodwork about losing money in their vacation rentals all about prophet but what about the housing that was never available even for us when we first moved here!! We rented from a realtor at at a higher cost than a mortgage would be. I have 3 graduates from Maui high They will never be able to afford a house here... I see all the new developments from the developer town we had to wait... Through five or six lotteries to be chosen to get a house in Wailuku where you have many VIP s like the police Chief from Vegas getting the most expensive home with best view over 1.4 million!! Maui real estate and development is absolutely so unfair and it's corrupt!!! The local residents should be looked after and also be able to afford after living here and working all their life!!! It's absolutely disgusting!! So now all the Realtors including Eric West.. . You are all speaking out because it's your bottom dollar it's not about the local residents affording decent homes or EVEN rentals!!! Think about it!!! Climate Change is making weather events more extreme. This will impact the worlds food supply. Floods, droughts, fires, excessive heat, snow storms and low water levels in reservoirs and in ground water storage are becoming more common. We must stop adding more fossil fuels to the climate fire. Stop building and financing more coal fossil fuels power plants. Time to go all in on wind and solar energy, battery storage and electric vehicles. Fossil fuels are a bad investment for people and the planet. The cost of dealing with the impact of climate change will be greater than the cost of reducing the impact.

Maui has figured out the perfect system to stymie all development (aside from luxury housing) while pretending to support affordable housing. They have'nt developed water delivery systems, they don't turn government-owned, entitled property over to developers to build affordable housing, and those affordable housing developers that have tried have been burned by our County, losing hundreds of thousands of dollars. If you're wondering why the housing project for West Maui fire victims went to felon Paul Cheng ($68 million) instead of an honest developer, it's because the good ones have all left the room. Including one born and raised here, that develops affordable housing on the Mainland, but not here.

Tom, in addition to owning a home in Kai Malu, we also own an STR at Maui Kamaole. I am not in favor of converting Maui Kamaole to a condotel or any other use. As LegalTyranny stated, below, the Constitution is on our side. Let's not negotiate against ourselves. There is no compromise. We will win in court, if it ever got that far.
