    The equation of who should look after the kids in my opinion is pretty simple. Whoever have more free time (subtracted from jobs and chores). And if both parents have an equal amount of free time, they split it equally, with one idea more attention from the mother if it's a daughter and one idea more attention from the father if it's a son.

    Finally a topic I can harp on😅 3 days of content to look forward to🙌🤞 I am not American but from what I’ve seen and read on their prenups they don’t seem to work very well because they can be challenged in various ways that can indirectly lead to the same financial penalties of just paying out. The justice system is slow and the lawyers are incentivised to prolong the process because it benefits them with the person losing the most being the most financially well off partner. I think a simpler fairer system would be for the only automatic legal entitlement recognised be the sharing of incomes (limited to 1 year after divorce) and shared expenses (including assets acquired together) which is where most of the tax benefits are and anything beyond that should be decided privately. Personally I think it’s ridiculous in today’s world for a partner (within progressive western cultures) to be entitled to half of someone else’s wealth especially if they weren’t involved in making it. It’s a forceful way to disrupt someone’s life in a punitively regressive, outdated and unfair way. In regards to kids both parents should have to take a minimum mandatory parental leave to make the career aspects equal and any decision to be a stay at home parent should be considered a personal choice that’s fairly compensated by the income split. The nature of work has changed to be a lot more flexible and being a stay at home parent is far from the sacrifice it once was. There’s often an argument from the feminist side about housework share (excluding early years childcare) but with modern comforts that’s largely a choice in that it’s not that hard in the smaller spaces anyone can afford nowadays but that it’s also now cheaper to use technology or pay someone to do it if it’s enough of a factor to be arguable in divorce court. There’s a fairly long but salient example on this topic you might find interesting: “Ben hart my conflict with my daughter why I went to jail”. There’s also a further follow up after that gives more details. It is I would hope a very unlikely outlier to base any conclusive thoughts on regarding divorce but given other correlating statistics I worry this just happens to be an outlier among many that’s been brought to the fore.

      Harp away, JLP, you are officially our family law expert! Lots to unpack here but let me try. Is it actually true, in reality, that the wife/partner with less funds gets half? I'm recalling a few high profile cases in the UK where that has never been the case so I'm guessing this would be the same scenario for the average person? Just to challenge your thoughts. You say "half of someone else's wealth", let's assume we're talking about wealth created in the marriage- isn't part of the marriage contract/relationship that "someone else" no longer exists but rather "us" does? Thank you for the detail and the Ben Hart reference, I'll check it out when I have a moment...

    • @JeanLooksPicard
      @JeanLooksPicard День тому

      @@thegirl150Ebisu Apologies for the essay😅 I was using the foundational assumption of 50/50 used in court as example but yes most cases don't result in a such a split but I am conversely challenging that basis on its entitlement aspect that doesn't fairly account for personal choices and responsibilities. I made the distinction on income and not wealth because its a much more nuanced issue on the latter and it would be hard to come up with clear laws on it that don't result in the same issues that exist now; income is a lot easier to divide fairly and its much more relevantly impactful on lifestyle. Under marriage at present you loose the autonomy to do anything separately in a way thats protected in the event of a divorce and bringing it up is a point of friction because at the moment its an entitlement to benefit from anything your partner does regardless of contribution: its paradoxical to be an "us" still entitled to be individuals acting in their own self interest whilst the repercussions as individuals are shared if that makes sense😅 for context here the comparison would be between a longterm unmarried couple vs a married couple; a place between both is the ideal situation where you get the benefits of marriage but that you also still have the elements of personal responsibilities that don't get abstracted away in court when you part. It's fine for either partner to choose to stay at home but both parties would be equally compensated financially regardless of the work arrangements or differences in income. If after shared expenses the household income is split equally then both parties are free to spend that income as they want independently and can't then later make claims on the partners share unless it generates anything taxable as income. The same strain on the men exists under the current system but men are still penalised more in divorce regardless of whether they are put into this position unfairly by a partners choices or spending. As a stay at home partner in this scenario it's also different because you can likely afford to offload most of the workload through technology, being organised or outsourcing. Division of wealth should directly correlate with participation in making it covering only the duration of the marriage and not be a default passive entitlement that can stretch beyond that period. In the past marriage was a lifetime commitment that the law and society helped enforce with balanced penalties so the default entitlement fit but now its only an ideal that doesn't merit its penalties at a time when fewer and fewer couples manage to live up to the commitments of it.

I wasn't aware of much of the info you talked about- I've never researched this stuff as I've not needed to. Perhaps a very naiive and simplistic answer to everything you've laid out but I think looking at a person's values, really delving into them, will stand people in good stead. There's some awkward fan interactions and interviews with women which raise some questions (that end up having mundane answers) but that's it. I think people are just running with the claims because most people preferred Kendrick's diss tracks and Drake poorly defended himself (he said he's too famous for it to be true)

    I think it all stems from the sexual liberation movement. The dynamics between men and women have just become disproportionately skewed because we've removed what were "natural " limiters that kept the balance both biologically and socially. At the same time we have laws governing relationships that haven't caught up to the current situation which is just adding to the tension between the sexes fuelled by the continued blurring particulary on the left of politics and ideology which makes it difficult to engage these issues in traditional normal public discourse. Red pill content creators are driven by money which factors into some of their antic but it isn't to say that they don't make a lot of valid observations albeit often communicated in a somewhat coarse manner but I agree some are funny to watch. I'd be curious what differences from your experiences there are as a passport sis vs the passport bro narratives.😅 lovely thoughtful and interesting vlog/video/diary as always😄

      Do you think so? I just don't remember it being like this for me and my generation and even now, it's not like this for us. I feel it's closer to being related to the introduction of dating apps/social media apps like TikTok, things that didn't exist back in the day. There's an aggression on these manosphere/femaleosphere videos that takes me aback. I think they're unhealthy with some dollops of usefulness. Haha! I was joking about the passport sis thing as my reasons are not to get away from anyone, more that I like to experience different cultures. But I might make a more detailed video about dating outside of your culture another time. Your paragraph starting, 'At the same time we have laws...', can you expand?

      @@thegirl150Ebisu I think we're of the same generation (90s) but from your videos you have far more worldly experiences than I do so I apologise if my points seem a bit immature. After thinking about it more I am not sure I even understand what point I was making with my earlier comment but I included my thought process and response below.😅 I agree the apps are largely at fault but at the same time they just amplify discourse that already exists like for example sexual content used to be taboo and segmented to its own spaces online and offline but its slowly progressed beyond that into more public spaces/forums like UA-cam inline with the discourses around sex and gender in the real world (I might be wrong in linking the two). Sex work always existed on the internet but it's gained a sense of legitimacy in part due to the blurred association with the (new) feminist movement which in the short term seems great for women's rights but I think its contributing to a wider breakdown in the relationships between the sexes in areas like divorce, population decline, hypergamy & single parent households etc. This isn’t to discount other more attributed factors like employment and others. On laws I was referring to areas like parental rights largely favouring women, laws around asset division and alimony now even more complex with the introduction of no fault divorce, laws around assault etc. Some of these aren't yet in the UK but the trend tends to move towards similar versions of them being adopted across the west. When reform around these laws happen they always seem to be in relation to or for women’s benefit when discussed whilst not addressing their potential impact on men furthering the divide between the two counter to the objective of the outcome equality. Even today there was a discussion on tv about the pill no longer requiring a doctors prescription in the UK and being available to buy for 16 year olds the consequences of which I am not sure will overall be positive in the longterm in regards to this issue amongst others. sorry its so long😅

      @@JeanLooksPicard 80s baby here, woop woop! That was an interesting read, thanks for taking the time to write out. I think you have a very sound (and mature) grasp of what's going on and this will set you in good stead. Perhaps you should be the one doling out advice to these younger men, rather than what's currently out there! On a serious note, I think younger men (and women) have to be hyper-alert and consult with their families before making major decisions (even around serious relationships). It could make all the difference.

      @@thegirl150Ebisu you look young for 80s😅 I am far from mature to be advising anyone but thanks for the kind words. For sure family advice is key but unfortunately it’s the implementation and conditions to apply it that are hard. Hopefully this as bad as it ever gets🤞

    I've heard you mention writing in the last couple of videos. Have you been writing a novel? Sorry if this is something you've talked about in detail somewhere. As we've only been friends for a little while here (kidding, of course) i haven't heard any specifics. I have a friend that's been writing an autobiography (he was a homeless wandering monk for many years in the US, but also spent time in monasteries in India and elsewhere), and i think it's been 20 years since he started. I know writing can be tough sometimes, particularly if there's something you really wanna get right and you can't quite find the beautiful words to describe the beautiful feelings you have. I also know it can be tough when you're just not feeling all that inspired. I guess that's true of a lot of things in life, huh? Anyway, hope you're making progress. And i hope your test results are good or at least enlightening.
