Its the coding... they only check who currently while the crash is happening drives the car. An empty car crashing into them means no target so no reaction. Last driven by won't be checked luckily... otherwise they could crash into an car u parked somewhere and u would gat wanted level while not being even in sight.

So actually in GTA 3 the npcs are supposed to loose the limb. So the blood fountain is not from the shoulder but the entire decapitation of the whole arm.
