    Here is a question , I put an offer on a house with a 48 ir. Now they are telling me to resubmit my offers as they are looking to review offers the next day (bidding war)? What happens if I don’t get a response , don’t they have 48 hours to answer me?

      Hey @alansnobl4059, thanks for the question! Hopefully I understand what you're getting at, but if I'm not answering what you're asking feel free to clarify in the comments and I'll do my best. In short, the only thing that the irrevocable deadline on an Agreement of Purchase and Sale means is that it's the deadline for the receiving party (the Seller in your example) to ACCEPT the offer. If accepting your offer, the Seller would need to sign AND communicate the signed and accepted offer back to you within that deadline. They aren't technically required to answer you within that deadline if they decide not to accept your offer, or make a counter-offer. In fact, in your example a Seller would be able to consider other offers during the irrevocable period of your offer, so long as they have not yet accepted yours. In your example where the Sellers are asking you to resubmit your offer so that they can review other offers the next day, it is either because they have, anticipate, or are posturing that they will have multiple offers to review. In this case, I would suggest asking the Seller directly to confirm whether they do indeed have other written offers in hand, and that if not then remind the Seller's Realtor that you would like to be informed when they do receive other offers, so that you can decide at that time whether you would like to put in a "best and final" offer.

      @@nick.fundytus they do in fact have other offers. Hence this is why they are holding. But I’ve allowed the 48 ir which sellers requested , made a strong offer and no response other than telling me to resubmit my offer which I am not doing . I want to know if they legally have to answer before it runs out . The listing should have said they were holding offers until Monday , this just said allow for 48 hr irrevocable which i did . My offer does die at midnight which i dont believe I am going to get a response.

    Great video - you didn't touch on the time stamp thought. In your example, your condition expired at 9pm - Does both the buyer's time stamp AND the acknowledgement have to be before 9pm or does just the buyer's time stamp have to be before 9pm? Thanks in advance

      Great question. I'm not a lawyer, so verify this one with yours (and I'll do the same if I remember to do so in the morning), but my understanding is that the Notice of Fulfillment needs to be be conveyed and received by the recipient (in my example, the Buyer needs to send to the Seller) by the irrevocable deadline, but the acknowledgement might be stamped after the conditional deadline has passed. The reason that this can happen is because the document is considered "received" by the Seller as soon as the document is conveyed over an official channel, such as the listing agent's email or via the fax machine to their office. As long as that conveyance happens prior to the conditional deadline, the Notice of Fulfillment is valid.

    Is it true if more than one condition is being fulfilled, a separate form would be required for each one unless they are fulfilled at the same time?

      That's true sometimes. In many (I would even say most) cases, Realtors write conditions so that they expire on the same day, and they are fulfilled at the same time once the Buyer has done all of their due diligence. It's perfectly legal to fulfill multiple conditions using a single form. Occasionally, a one or more conditions may need to be fulfilled at different deadlines. For example, a Buyer's financing condition is due within one week of an offer, but the review of status certificate on a condo purchase might be two weeks. In that case, it's important to be aware of, and meet the different deadlines.

      Hey Chris, It’ll depend upon the specific wording of your agreement. Did the area in the form specify only the property that you offered on, or something more broad like the whole city?

      There's definitely a cost-of-living crisis happening in Ontario - we agree! There's too much demand and not enough housing supply. A Realtor can help you compare the cost of a home with its true value, and a good one will show how that price was decided.

    great nachos. i just wished ottawa didn't have the same ol menu of previous restaurants. nacho's, taco's,enchiladas. chalupas,birria, burritos and so forth. i'd love a restaurant that would have other things besides the cliched menu items. the place is good though.

      As a tourist, your best bet for inexpensive accommodations would be couch-surfing (there's a few sites, including Airbnb that offer this as an option) or a hostel, such as the old jail downtown. It's well-located and an interesting location for a hostel!

      jvolstad, you can, but make sure that you’re doing your homework when choosing who to work with. One of the things that I mention in the video is to get a referral from someone whose opinion you respect and trust. Realtors, like most commissioned salespeople, value repeat and referral clients and will go out of their way to give an especially high level of service to someone who has been referred to them.
