IN THIS VIDEO WE HAVE DISCUSSED ABOUT THE FAMOUS DOSSO CASE. State vs Dosso is a simple case of a murder committed by a person named, Dosso in Balochistan. He was convicted under the tribal system of justice by Loya Jirga as enumerated in FCR, but his relatives approached to the Lahore High court which repealed the decision of Loya Jirga, later on, on the appeal of Federal Government, Supreme court reversed the decision of Lahore High court. The case got prominence, because it indirectly questioned the legitimization of Martial law imposed by Iskandar Mirza on 7th Oct,1958.
The State vs Dosso & another is a most important case in the Constitutional history of Pakistan which was decided by the Supreme Court of Pakistan on October 27, 1958.
DISSENTING REMARKS OF JUSTICE CORNELIUS:
In the case of Dosso and Muhammad Khan, the position is materially different in so far as the trial and all proceedings up to the conviction were held in a "special area" over which the High Court had no jurisdiction.
It follows that the High Court had no authority to decide whether the trial and conviction were legal or otherwise.
The only matter of which they could be seized was whether these persons were properly held in custody by the Jailer at Machh.
Justice Cornelius argued that the military takeover was unconstitutional and therefore invalid. He contended that the military's assumption of power and the abrogation of the Constitution violated the principles of constitutional governance and the rule of law. According to him, the Constitution should have been upheld and respected, and any act contrary to the Constitution should be deemed illegal and void.
