    I have several “Us Dept Of Ed” loans that were defaulted 7 years ago. Will the default negative remark be removed from my credit report after 7 years of non-payment? I understand the money is forever owed and will continue to add interest etc. I am specifically concerned with my credit at this time. Also, if it has been more than 7 years since the default (assuming it would have been falling off soon due to the elapsed time) and it's still on my report, and I pay it in full before September 29, will this new payment cause the remark to stay on my report for another 7 years? Even though it will show payment in full. Thank you 🙏

    Stopped paying my student loans over 7 years ago. They used to garnish my tax refunds then stopped 4-5 years ago. I haven’t seen any loan defaults on my credit reports and that included when getting a mortgage loan. I just got emailed today about fresh start, found my old login to my student aid portal, and saw that I still have an 8K balance. If I don’t take care of this and enroll before sept 30, would that mean it could show up on my credit report again?

    Can you refer me to someone on the west Coast? I was on IDR and was on SAVE and consolidated before june 30 to get the the idr adjustment credit. I had a zero dollar payment and now i received a payment almost 3k. I thought i was on save but even though they have my idr application before June 30 they won't process my application. Is there any way to get forgiveness i have no way these would ever be paid back.

      The IDR Audit is supposed to occur by the end of this month (to give you IDR credit). In the meantime, you can ask to be placed on forbearance. That was supposed to happen during this litigation. This forbearance may not count toward IDR though, we don't know on that yet. You can search for someone on the west coast here: studentloanhelpoptions.com/. I'd recommend Eric Ridley in Calif - there were three attorneys in Calif on this list.

      We are hearing that ED intends to have them done by 9/30. But that goalpost has moved so many times it seems to be on wheels.

    There is no such thing as student loan forgiveness. All we do is change WHO pays for it. I am all for making the loans easier for them to repay, as long as it stays with THEM.

      @@ArkovichLaw As long as that fixing leaves the debt with the person that took out the loan, I'm a supporter. If it doesn't, then I'd prefer elimination over repair. Its why I dislike the term loan forgiveness. It's a false label. Unless of course it's the bank itself forgiving the loan without public recompense. Unfortunately, often times politicians are more than happy to play loose and fast with the public treasury to pander votes.

    The one time I my life I did not procrastinate back in 2001 just before rates started to dive . I am stuck with 7% on $150,000 and compounding . Owe more than I took out . Life and health intervened after going back to school later in life so that’s how I wound up inI this mess . I wish they would just lower that interest rate to give me and likely others too a fighting chance . Not asking for a write off of the loans just to lower that rate that I called them for years begging them to lower it . Why not have one rate for direct loans for all student loans is beyond me . Some people are at 2 or 3 % and others 6-8%. I’ll be dead before these are ever paid off. The interest is astronomical

      If federal loans yes. If private loans probably not. I knew of one atty in Tennessee doing these, but he is no longer handling student loan matters.

    President Barack Obama was the one who said all young Americans have a right to go to College and the government will provide and guarantee this money for each student. I am old and had gone to collage but did not finish, I worked until the age of 72. When I was young not all students that had gone to collage finished for one reason or another. I also believe not all people have the ability and aptitude for a 4 year degree. I also think that many men would be better off learning a trade and if you are skilled and willing to stay the course and also willing to learn work hard learn your trade the pay can be very good. I blame President Barack Obama for trapping America's youth with these staggering bills because with the government guaranteeing this money the collages increased the coast for collage substantially and I believe these students did not really understand what they were getting into.

      I have 3 too. I think I'm going to consolidate 2 then consolidate that one with the other one .

      Our process has changed a bit. Since Aidvantage is doing all consolidations now for all federal loan servicers, we do half with Aidvantage and once that's done in 45 days, we do the other half with Aidvantage. All by paper applications as the online system is halted now. Then when the second half is done, we recombine all in a final consolidation paper app with Aidvantage. The reason we do half at a time, is so that Aidvantage doesn't put them altogether. I don't know of any way to separate them if that accidently or purposely happens so we want to avoid the possibility. We like Nelent, but I don't believe they are processing any consolidations now and we don't want to wait.

      I don't know of any way to undo a consolidation - there is a brief time to cancel it while it's being processed is all. If you had another Direct loan, it may be possible to combine it in another consolidation - then the PP loans would undergo a "double". It would need to be a degree seeking course for that other loan I've heard.

    I have submitted paper applications to 2 different servers. I have heard from 1 and nothing from the other. Has Nelnet stopped doing loans consolidations?

      I believe Nelnet has stopped doing consolidations. It really sucks because I was going to use them as my final servicer

      Yes, only Aidvantage is processing consolidations now. Maybe try resubmitting the second half with Aidvantage by paper - online is all frozen for now. Then recombine them all using Aidvantage again by paper. I hope Nelnet starts again soon, I'll try to do a video short, long or blog when they do.

    Can you help me understand why Aidvantage will not release my consolidated loans to MOHELA as I requested for my final consolidation in the loophole process? they are keeping the loans, and will not acknowledge the SAVE request from early June. I was very clear that I wanted my service or to be MOHELA for the final consolidation. Aidvantage also kept my loans in the previous step when I chose Edfinancial as my servicer. Any idea why this is happening and why they do not honor my request for processor?

      We have heard that Aidvantage is the only servicer processing consolidations now - they are doing them for themselves and all other companies. I would imagine that they would complete the consolidation and then turn over servicing to whomever you choose. The system is a mess right now though. Since everyone has or is supposed to be placed on forbearance for federal Direct loans right now, maybe they have a halt on transferring too. IDRs aren't being processed right now either. You could try to use a paper request, the online systems are all frozen.

      We're wondering that too. We're focused on the things that still work for now. TPD, bankruptcy discharge using the attestation process, IDR audit, Fresh Start 9/30 deadline.

    Could a Trump administration change the clasification of the consolidated parent plus loans to not be eligible for SAVE after they were admiited to that program?

      We don't really know. Arguably the Chevron decision out of the U.S. Supreme Court should stop executive action by administrative agencies where an act of Congress should be required. But presidential executive orders should still be allowed. These regs though, have been passed following a lengthy process, you would think the same process would have to be passed to cancel them. But if they were determined to be unconstitutional from the start? We really don't know. Right now, the regs allowing double consolidation for other IDRs for anyone doing a double before July 2025 is the law. The IDR may turn out to be IBR or Repaye if SAVE doesn't survive. Still much better than ICR.

    Question, we have one parent plus loan for our son and our son has 2 direct loans. Would I submit one direct consolidation form for the parent plus loan and another one for the 2 direct loans then combine the 3 together so our son can get the save program? Can we consolidate since the parent plus loan is in our name and the direct loans are in his name. Thank you.

    Bumping my question up because I've been searching for an answer to this for over a year with little reassurances. Do any of you have any reliable info on this? See @schmactor below. Basically I'm worried I made a mistake by consolidating my graduate loans which I had already put 20 years of payments towards hoping for a 25 year forgiveness. Please read my other post.     Great video Christie, I’m glad you explained what to do, I’m in PSLF currently with 91 credits in the SAVE Plan. I’m waiting for the IDR waiver adjustment & if I reach 120 with that adjustment from what I’m hearing from your video I would need to change from Save to another Income Driven plan in order to apply for my loan forgiveness. So I appreciate this video, thank you 😄

      Approx 30 credits short. That's over 2 yrs. You could wait and stay in forbearance now OR if you think SAVE will crash and burn, you could switch to IBR or the 10 year standard payment and get IDR credit running again. We're hearing that this forbearance will not be counted for PSLF. The problem you may have is that you HAVE to remain employed by the gov't/non-profit while your discharge PSLF app is pending. You can't retire or move to private until the discharge is granted. If you do the standard payment, make sure it's the 10 year one, not 30 years. Only the 10 yr will count toward PSLF.     But if the Supreme Court reject's, wouldn't that mean the WHOLE save plan is gone? Even the provisions (such as the already 5% payments) already approved? I think Missouri is going for abolishing the whole SAVE PLAN becasue it harms MOHELA and their payments. Or is the lawsuite just for the forgiveness protion of the plan? Can you explain?

    Thank you so much for these clear and concise videos! Can you explain what it means that the forgiveness aspect of SAVE is being debated? Does this mean the 20 or 25 year path to forgiveness which has been a huge part of IBR plans for decades is in danger? I consolidated my graduate loans after 20 years of payments because I was told it was the only way to be eligible for the recalculation of qualified payment months that has been promised for almost 2 years now. Am I in danger of losing those 20 years towards my forgiveness?

      The other IDR plans are not being challenged (IBR, Paye, Repaye, ICR etc.), and have been approved by Congress. It's SAVE that is in danger. The IDR audit to give you credit for times that may not be counted such as extended forbearances is supposed to occur by the end of September. Your prior consolidation for the IDR audit if you applied before 6/30 or up until everything was paused in July, should not cause waiver of any prior IDR time you'd accumulated. I should probably do another video on this aspect. The IDR audit hasn't been challenged in court, BUT the goalposts of completing those has moved several times since Dec 2023. It's been extended several times, but has been working really well with monthly reviews taking place and forgiveness. I hope it hasn't been halted internally - I haven't heard that so please don't be worried about that. Please look into Paye for grad loans. If your loans fit the date requirements, PAYE has a 20 year IDR term, not 25 for grad loans.

    I am very frustrated with the process advantage which is my service, sir since I consolidate my loans for defense will not send over my brow, defense discharge paperwork as I was granted 100% discharge they will not send it to debt resolution management to release the money that I paid on my loans, even though I’m a part of the suite versus Cardona lawsuit and have 100% discharge do you have any thought of what I could do to receive my money they’re saying they don’t owe any refund

    Hello I have federal student loans. I have not been able to work consistently and in any significant manner for variety of reasons for five years . I also have credit card debt I use in order to survive I'm technically homeless Can I file bankruptcy what are the chances of discharge. I've never been able to pay on these loans. Some are from 2004

      Sounds like your chances are pretty good. If undergrad loans though, and Direct, you might wait to see how much IDR credit you'll get in September during the IDR recount/audit. If most of that time counts, and if you've consolidated before June 30 so the earliest loan repayment date counts for all - you may have reached the 20 year mark for forgiveness for undergrad loans already. But a bankruptcy would be very promising for both student loans under the new Attestation rules and credit cards.

      ​@@ArkovichLawI only have one undergrad from 2004 but went back for a master's in 2006 and then back in 2013 for pharmacy so they have not been in repayment this whole time. I consolidated but I'm not sure it was a good idebut haven't really able to work much. Does it matter if the loans never have been paid for all these years. I need a consult because if I file bankruptcy I will never get a place to live

    I'd like to comment as a constitutional libertarian who is also a consumer protectionist. I think regulation is needed against bigger parties that may file into a qualified party rule under things like a contract of adhesion, like employers and Banks. The student loans still qualifies for this. While I am not sure actually discharging debts is constitutional, things like all aspects of the SAVE plan actually are. I'm so glad for your work, and others, to defend this because at is root, if we shouldn't have been providing these loans we shouldn't require them to be paid back.

    I have 3 PPL for one child which are now coming up for repayment. I am not sure how that will work. I consolidate 2 with one servicer . Then consolidate that one with the 1 other one? Will that still qualify for SAVE?

    I got the recent TPD discharge from Biden (3year review ssa) . NOW I am getting a review and they likely are trying to cut me off. It is likely many other people are getting review notices now. I felt this would happen because it seemed like a political ploy. . I been on ssdi for a few years. I have a severe condition wherein i can barely stand, sit or walk, have extreme pain , desite opioid prescription, and other symptoms ( extreme fatigue, headaches, sleep issues...) that impact my ability to work a full time job. Some mornings i don't have energy to t even get out of bed. My pt job raised daily pay and i wish i could work everyday but my body and mind cant do it. I wouldnt be able to survive without ssdi, as i will be homeless unable to pay for housing and my medical expenses because i cant work enough. This is causing me sooo much stress which impacts my condition as well.

    Are u sure this is accurate - a number of other lawyers have agreed that only the early specific SAVE forgiveness (low original borrowing amounts) and the 5% calculation drop are actually being challenged - not the other regulations. Can u explain why you think all the July 1 regulations will be affected? It is difficult to find those specific scenarios in the rulings.

      The 10th circuit just stayed one of the cases. So some of the regs will go into effect. Can’t go into details right now, no time. It’s definitely confusing.

    Help! I divided my PLUS loans held by Nelnet and sent two paper apps to Edfinancial and one to Aidvantage. Aidvantage processed one sent to them. Then Aidvantage processed the other two sent to Edfinancial, but kept those two instead of sending to Edfinancial, so I now have two separate loans with Aidvantage. Can I still combine these two loans for the double consolidation loophole in six months?

      As long as they are separate loans yes. We only recommend two servicers to ensure they are separate but sounds like yours are. Now pick your final servicer and combine them. Send in a paper IDR app asking for SAVE. SAVE won’t be available online.

Aidvantage is keeping them and will not honor the SAVE application sent to Aidvantage in early June. Any thoughts on how I get them to honor my final consolidation request??? My SAVE request and application was sent to MOHELA for this final step in June.

    I recently submitted the initial paper Consolidation applications with Aidvantage and Mohela. Was this a bad idea? The loans were initially with Aidvantage as Direct Parent Plus Loans.

    We currently have (1) Direct Consolidated Loan (formally several Parent Plus loans, so it still has the Parent PLUS tag), and (1) Undergraduate Direct Loan Unsubsidized. Can I just consolidate those two together? Or do I first need to consolidate the Undergraduate Direct Loan and then double-consolidate that with the Consolidated Parent Plus loan?

      You should be able to just consolidate them together now. The Parent Plus loans will be going thru two consolidations which is the key. Send a paper IDR app asking for SAVE.

    Hi just wanted to no l have been paying my parents plus loan for over two years. I ask for student forgiveness due to working with the VA hospital as a RN. I am in the driven income plan. I sign all papers and after they said l qualified l had to call multiple times they told me l didn't qualify because the a can't give them mi información to prove l work 19years. What can l do since l am 71 years old. Us one of my son's when into the military for six years and he had to pay 20 thousands dollars which Sally Mae refused to deduct they told him that he took this loan o. His own which l had to take the loan under parents plus loan.He was I under age. It started with Sally Mae then to great lakes and now to Nelnet. Please see if you can help me with this problem 😊
