Thank you so much 💛 For better understanding you can refer crpc bare act, let me explain.... Section 29(2) talking about session judge determining by order in writting whereas in section 29(3) cjm and dm as the case may be determining by order in writting that who will be the successor in office.... If there is the case of additional and assistant session judge and there is confusion about who will be successor in office the authority is session judge ... If there is any other magistrate than authority is cjm and dm who will clear this by order in writting... Old and new law will run hand in hand.... Mostly there are many cases in courts ,so powers generally delegates to assistant and additional session judges for better enforcement of justice... If there is any doubt left you can put it here I'll clear it, let me know everything is clear or not.

See section 24 of bnss proviso says that not in excess of the powers of magistrate under section 23 , this things is talking about imprisonment in lieu of fine .... don't confuse it with main imprisonment.... imprisonment in lieu of fine is always in addition to main sentence but additional imprisonment should not be more than 7years...

Hey, sorry for the late response, you are right about section 3 that there they are talking about judicial magistrate (jmfc,jmsc) .... But for section 24 it is little different like there they are talking about "court of magistrate may award such term of imprisonment in default of fine as is authorised by law" court of session is also authorised by law to imposed imprisonment or fine on accused , just assume if accused will not pay fine what will you do than.... that is why we can construed that in the word of 'court of magistrate' court of session is also included , it is implied..... And about section 3 if " magistrate" word is used some where so if he is doing administrative work than he is executive magistrate, if he is doing judicial work than he is judicial magistrate.... and than judicial magistrate also bifurcated in jmfc and jmsc....
