If a seriously injured victim needs to file a lawsuit against the at fault driver's insurance company arising out of the serious injuries they suffered in a motor vehicle accident, who are the potential defendants in the case and who is the injured victim supposed to sue? A lot of my clients ask me this question. They usually ask who are the defendants? Are we suing the at fault driver? Are we suing the insurance company? Are we suing some other corporate business? You name it.
And the simple answer is, you simply only sue the at fault driver. The at fault driver is the named defendant in the lawsuit that is filed with the court. What this means is that when the at fault driver is sued, the at fault driver's insurance company has an absolute and a 100% obligation to "indemnify the at fault driver." So what does this mean? The at fault driver's insurance company will be providing the defense. They'll be providing the at fault driver a lawyer, and they will obviously be paying out any settlement or trial judgment found against the at fault driver.
Now there are some circumstances where the at fault driver may have been working on behalf of a large company. Perhaps FedEx maybe M & T Bank, perhaps Amazon, you name it. If that's the case, the defendants will be also those named companies. So the defendants in a court filed lawsuit with the at fault driver and the major company whoever that driver was working on behalf of.

We had the question appear a few years ago and couldn't solve it. How can you actually buy liability insurance for somebody else's car. Somebody wanted to borrow my car but it had gotten to the point where I didn't want to pay the insurance rate increase because of how much he wanted to use it ... Basically both he and I agreed that insurance followed the car was bad; but his insurance company would disagree.

I unfortunately got into a car accident that was through no fault of my own, and I unfortunately am so unlucky to live in North Carolina, 1 of 4 states to still use Contributory Negligence for a complete defense for a defendant that would've been punished if it were Comparative Negligence. You want to know what the other side claimed? Of course, Contributory Negligence, oh but not like as in I did something wrong or didn't do the right thing, they claimed I couldn't articulate that I couldn't avoid the accident. I tried looking for my dashcam well before the accident, I even asked my parents where it was, they said they didn't know, and unfortunately the day I was going to buy a dashcam after work was the day I got seriously injured, and my medical bills are $300,000+, and the other side offered $150,000. Unfortunately, the crash severely impacted my memory, and without a dashcam, i'm basically screwed. This accident happened back in July 19th of 2021, and still to this day NC falls under Contributory Negligence, which is completely screwed up because it favors the defendant and insurance companies to deny claims and basically say oh the plaintiff should've been more careful, they're wasting everyone's time with this crap lawsuit! I sure hope one day Alabama, North Carolina, Maryland, Virginia, and Washington DC all get rid of Contributory Negligence, because it's not good for the victims, because it basically says you're not a victim and that you did it to yourself, it might as well say you was 100% at fault because you wind up paying 100% of it if you don't settle and you inevitably lose at trial.
I will be the first on here to genuinely say Thank you very much for this knowledge it gave me some more reassurance with my current case! I got hit after i COMPLETED y left turn and got hit from in my trunk from and driver who was speeding and had turn signal on like he was turning down same street I already had turned down! Police officer said i was at fault but we sent in wittness info that came forward that day and hoping this will change things!
@@UnitedProsperiety thanks very much for your comment. Always remember - eyewitness statement / testimony is evidence you can actually use in court, and police officer testimony / police reports is evidence you CANNOT use in court. You should certainly consult a lawyer about your accident case.

1. Call the Police, both drivers should wait for them to arrive and file the TA report. 2. Photograph the accident scene, damage to both cars, glass/debris fields. 3. Photograph the other driver and their D/L or ID, along with their insurance ppw. #3 is important because not everyone is honest, and some people will hand you another person's ID, or come up with some "alibi" saying they weren't even driving their car. A photo of both the driver and their D/L or ID is PROOF POSITIVE of who was actually driving and the ID they gave is legit or not. Or- you can wait till your insurance company comes back and says "the owner of that vehicle says someone stole their car, and they weren't the one driving" which immediately complicates the issue and makes it likely that the other driver's insurance will deny the claim. With no photo of who was driving you'd be SOL.

Man, I live in Virginia, but it seems 1 out of 10 cars on the road are Maryland drivers and they drive like shiiiiiiiiiiiiiiii- Like I get it, Virginia is speeding hell but man, Maryland drivers are another breed. You should frankly just walk into court and be like "Your honor, clearly it is not my client's fault because the car that hit him was a Maryland driver." The judge would practically be obligated to give you the win at that point.
Video Editing is too low 👎👎👎👎 Edit the video in a good style. Add nice b-roll animation when you are speaking or explaining something. This will increase visualization. Put proper subtitles, effects, transitions, and colors in the video. Insert the B-Roll (footage and animation) very well because it is absolutely low in your video. Do all this and then see how the video doesn't turn out good. ⛰️

23 year old girl hit me-100% her fault...my car was totaled. she had no insurance as it had lapsed. She told me that she had just moved here yesterday and just married yesterday and didn't know a stop sign was in that spot.. I told my agent that she had just got married the day before the accident and could her husband be in a grace period to add her under his policy and we checked we sure enough they paid me $4,480 for my totaled car under his policy. Arkansas... Had she not told me that, I would have not gotten paid under his policy, I would have had to of been paid under my own uninsured...

I just had an 80yr old man run a red light t-boning me from my green light going straight & right ahead of the intersection. There is another light that was green 20ft ahead of the intersection he hit me in.
