    DWI has to do with being intoxicated with a drug or alcohol illicit or not. A DUI has to do with being sober, but having hallucinations caused by a mental health disorder caused by brain damage from doing drugs or alcohol at an earlier time. Smoking/ Hypoxia, Sugar, Medications, and noises can create a DUI situation. A DUI is usually caused by Schizophrenia a result of being bitten or stung by a venomous or poisonous animal or food as in a puffer fish or bad water. A DUI takes a mental health evaluation regarding schizophrenia or Bipolar disorder. If you have a DWI you can go through driving school 5 years later to get your licensee, you are allowed to use a bicycle during the time that your license is suspended. If you have A mental health disorder that impairs your ability to drive you are never able to reinstate your licensee.

    I really need a contingency fee attorney for a legitimate claim against a credit card company that has maliciously defrauded me and I have filed a complaint with the BBB and cfpb. Suing for conspiracy to defraud & Mal. Intent Was approved for unsecured CC.Aug. 3, 2024. Called to verify validity of approval. Was confirmed approved was given my account number and told I should receive card in 7-10 days. Enrolled on their download app.that day and Verified myself. Then 10 days later Aug. 12, 2024 the CC Co told me my account was closed.with no explanation.Asjed to speak with Supervisor and was denied.Pleaded to please give me a chance to even begin my account.as they never sent my card. Then appeared a $99 annual fee on online app same day they told me it was closed. They said to disregard it because it will be taken off and my account is officially closed. Checked Experian credit monitoring website and discovered they put the annual fee on there($99) on all 3 credit bureaus as an active and open account, complete with a cc# and available credit of $800 with payment due on September 11, 2024. Shocked, I filed a complaint with BBB and CCPB. because I tried calling the CC Co but was put on hold for 23 min. Then it hung up on me. I went on to state in my complaint, the facts and settlement demand for damages and compensation for this blatantly fraudulent account that appears on my credit report as an open account. I certainly believe Vive Financial never intended to send me any card in mail, even as a dead card, because the CCard send out date (should've been on Aug 5, 2024 and I should've received it by the 15, or 16th. Instead I receive a bill/ statement in mail dated Aug 12 with a $99 balance on there. I want to sue them for all and any damages, mainly punitive and compensatory, that their predatory tactics have or will do to ruin my credit standing because of the balance placed there with the $99 they told me to disregard. They made it an officially opened account within the credit bureaus which have all the potentially damaging consequences if left unpaid. An intentionally vicious way to close ones account done solely for their benefit. I just need representation to achieve complete closure and a settlement. I have proof of screenshotted files, approval screen, credit report with their information and open status, a statement/ bill, and 3 total complaints that I filed entailing everything they did . I don't have any money but need an experienced lawyer for a percentage of any potential money awarded.

    I have a civil case and I was about.to request to transfer the final order and an sapcr case to florida and when I called the colling county Court, the clerk said the case was sealed. The judge signed the order to transfer and why did they seal it, or who sealed it while I was getting it transfered and already send the MO for transfer.

    If you have PTIP for a first time DWI - Have a in-home unit have to sample your breath 3 times a day.. let’s say you miss some samples/blow a fail but blow again and it passes as 0.01 or 0.00 (mouthwash mistake).. one time was after eating an orange didn’t know that was possible. My question is would you find out at your last court date if you have successfully completed the program or would they convict you then and it doesn’t get dismissed? Sorry if I’m all over the place like if you messed up at all during the time they gave you, for example a year they would stop the PTP program right then and there or would they wait until the actual last hearing?

      Don't keep calling - send them multiple Emails so your requests are documented. Just in case you need to file a legal malpractice case against your current attorney! Hopefully, it's not that serious. Attroneys always read their Emails!!!

    I have a question. So I had a misdemeanor DV charge years ago (shoved past her during a fight didn’t hit anyone just lost my cool and left forcefully) went through PTD. Can I still purchase and own firearms in the state of indiana? (This was years ago so I’ve since completed my PTD and had no charges what so ever) however I don’t think the petition to expunge happened.

    This was super easy to file by myself here in Denton county. The state did not disapprove, I didn’t have to submit any work information, and no hearing was requested. This was very cheap and fast, 1 month total process, and only cost me $350 out of pocket to file.

Texas law help is where I got all my info, they led me to a website that helped me digitally fill out my forms for free, then I just printed them out and took them to the county clerk. Filing fee was $350, I never paid a penny more and the courts were very eager. They told me their judge looks at easy small orders like that between his more serious cases and wants them off the record as quick as possible

      @@HTX-713_ I don’t know if my last reply went through but it was a B misdemeanor. Texas Law Help was a website I used to look up info on a petition of nondisclosure. They then linked me to a website that asked a bunch of questions and pre filled a digital copy of what I needed for free, and I just had to print it out and file with the county clerk. The filing fee was the only money I had to pay, and I can pass any background check again.

      It’s different in that it ends with a dismissal of the case, whereas deferred probation simply means that there will be no final conviction on your record. The charge isn’t dismissed.

    When it comes to divorce attorneys, remember these are The attorneys who graduated in the bottom 50 % of their class. Right there that shows they are LAZY. If you are concerned that something is not right, and your attorney says this is normal. If you don’t reconcile your concern, you are going to be upset forever with the results. Get another opinion and or approach that feels right. Another thing, divorce attorneys are notoriously poor at accounting. See my comment above about their academic efforts. All divorce attorneys are good at figuring their legal bill however. So that makes it incongruous with their ability to add subtract and preform other arithmetic functions. Amazing! Get an attorney that is direct complete and economically effective with your legal fees. Don’t talk or complain with them do that with someone else. Insist on milestone performance without a lot of letter writing (legal billing time).

    Brother, the reality is, is that’s lawyer talk. There are definitely a ton of cases in which the client is clueless & has unrealistic expectations, especially in personal injury (i.e. they want their case settled in 1-5 month; they’re not getting a call once a week, etc). On the hand, there are a ton of lawyers who know, even before they passed the BAR, that they’re not going to trial! Those are the settlement mills (aka: scam artists). Yes, many cases don’t require trial, but when the client is truly injured & has dotted all I’s / Crossed the T’s and the insurance is low-balling, that case requires an assassin. When that settlement mill guy tries (and most of the time succeeds because of the client’s ignorance and/or poor quality of life) to point out all of the negatives in the case and blames the victim-it’s time to fire that crook or crooks. It doesn’t look good and the client will get a bad reputation, but that bastard lawyer won’t get his chump change and you won’t sign your injuries away for nothing without a fight: money won’t bring back your health, regardless. Some of those lawyers are also vindictive and continue to procrastinate with your files, withdrawals, lying, etc. Experience is the primary teacher.

    My assailant beat me to a pulp breaking 10 bones etc. on 9/22/21. She had broken probation for shooting a cat in a public park intoxicated. The delays were suspicious and coincidentally she got into diversion after successfully timing out getting other charges reduced. Cheers.

      Also, the type of Assault you’re describing here would be filed as a Felony Aggravated Assault in Texas, because of the extent of your injuries. Rightfully so, these are not considered for PTD in Denton County or any other county that I’m aware of. The defendant would generally have to accept a plea bargain or set the case for trial. Regarding Assault cases, PTD is generally only available where there were no serious injuries. I’m very sorry this happened to you.

      You would speak to your lawyer about being considered for the PTD program long before you ever consider entering a plea of guilty. With PTD, you never actually go to Court and plead.

      At least for me it was cheaper using the public defender and doing diversion compared to paying a lawyer I saved a lot more but pleading guilty makes you feel powerless ngl I just hate that part but trying to fight the case would have been more time consuming only had to do 50 hrs community service and 1250 restitution

    The system makes me sick! I was assaulted and beat by a nurse in the ER while having a miscarriage and I was the the one arrested and charged. The cops were against me immediately because it would be easier to side with the nurse. The government is not here to protect anyone! Fucking pathetic the cops set people up and their word is power over everything. Not right at all.
