    It'll cost me $1,000 to get out of my listing agreement. But I'm curious, what if you just change your mind and don't want to sell your house and take it off the market? How does that work?

      That's a really good question. Again it all gets down to conversation and relationship. If you decided not to sell your house anymore, you would ask for them to cancel the listing withdraw the listing if you want to come back at it later or change the expiration date of the listing contract, and again the contract is terminated as far as the $1000 that you were charged there are cost involved with us as listing agents to get that home ready and on the market several hours of our time as well as our listing photography that we've paid for ahead of time so I understand the $1000 fee to cover some of the cost of what we've already invested into the listing. I would say the answer to your question depends on the brokerage the listing agent and the communication and conversation that you have. I know that's not a straightforward answer but I'm so grateful that you are doing the research and you found the video to be of some value to you.       Simple supply and demand comes into play for sure with low inventory. Our market is less and 2 months inventory.

    We are looking for a rental and signed a contract with an in training agent. She isnt that great and is often confused, unorganized and slow to communicate. For some reason we put the dates in the contract one month out. Does that make the contract null and void if it was signed using the wrong dates? Not sure how we missed that. Not sure if I even signed it because it seems odd that I would sign a contract with the wrong dates.

      Hi Dustybanditrepllant, first thanks for watching. I am not a lawyer so my reply is simply my own opinion and not legal advice. Are you referring to a leasing agent contract or the rental contract? I might agree with you the dates should be correct and since they are incorrect it may not be valid. I encourage you to contact your agents managing broker and explain the issues you are having and ask for a more experienced agent or at least for her to get support and assistance from one. Or ask to terminate anything you signed and put that in writing to the brokerage. Hope that helps some. Wishing you success in finding a rental soon and settling in.

    What do you think about DPA Programs? It worked for me and I was grateful it got my foot into the door of homeownership. BTW at the time my interest rate was 6.75% and I thought that was a great rate it is about what current interest rates are today.

    You do mean at the end of the year return the security deposit to the tenant only if they are moving out right?

      Hi @nellielee2915 I think you're asking when the security deposit is returned and yes at the end of the lease or after the termination of the lease. I believe I was discussing the fact that you can't commingle any security deposit with your own person funds. Keeping a separate bank account for the rental property use only.       Hi @alelr24 good question, from what I understand if the hotels are full and you find temp lodging for instance with an Airbnb or VRBO you can pay and submit for reimbursement if they approve it first.     Hello , if I bought the house for 150k 40 years ago, and now I start renting it out and now the house value is at 950K? Do I use the current value of 950K or150K for depreciation when filing tax? I have never done depreciation on the house when I lived there. Thanks so much for your help.

Unfortunately I can't give legal advice, I too operate with an LLC , in this video I was referring to an ethical standard of practice that I am held to and educated myself on to execute within my business practices with the public as a REALTOR. At the end of the day ethical behavior is always a choice. What type of business entity you have and how you behave are choices. Perhaps contact your better business bureau in your area about registration with them? I hope that helps.

    Hey, thank you for your expertise. purchased a new build that will not be ready for six months. I asked my agent to look over the contract and to let us know if there is any clause or disclosures that we should know in case of paying more for labor and material at close and he said no. But with further review of the builders contract it was listed and much more. He just hasn’t been helpful, informative nor responsive. I did not sign a buyers/agents contract with him. Can I fire him and hire someone else at this point?

      First thank you for watching and asking your question. While I'm not a lawyer and can't give legal advice, we are discussing contracts which are legal issues. I will say builder contracts are more pro builder always. I'm glad you've read it now. As for the buyer agency, I would say it depends on the state that you're in every state is different. is there a document in your builder contract that is identifying your buyers agent? Reread your builder contract with regards to the relationship with your current real estate agent. While I don't know the legalities of your state, without a buyer agency I don't think they have any recourse. They technically are not working on your behalf if there's no contract indicating that. But since I don't know what state you're in and it is a builder contract, which is not a state contract. I would refer you back to your builder contract to read through it. I would suggest getting legal advice though also. At the end of the day, this buyer agent may still have the ability to be paid from the builder.

    Home Partners is a scam! Do not do it! I live in one of their properties and have been living with water intrusion for almost 2 years! Not to mention black Mold! And sewage backups/black flows! I have been fighting with these clowns for all this time to get it fixed and am nowhere closer to having the leaks repaired than I was the first time it happened. Any realtor recommending this company should be ashamed of themselves! I implore anyone considering HPA to do as research as you can and I promise you will find tons of residents dealing with the same issues or worse. Just do not do it! Had I known then what I know now, when Home Partners was introduced to me, I would've run away screaming! That's a fact!

    I feel I was coerced into signing an agreement!The agent...I was sending her the houses I wanted to see,she would say she set up appointments for the next day not tell me the time then not get back to me,we only saw 8 houses & she's saying she showed me all these houses,she didn't inform me of a bad area that a couple houses were located in then when we got there I told her I felt uncomfortable but she said we're here let's go see the houses! After our second time out,after she had not let me know the time we were getting together a few days before,I felt this wasn't going to work!She kept harping on the agreement,made it up without any discussion between us for me to have any input,dated it for six months ahead,and insinuated tthat if I didn't sign she would no longer take me out knowing I was desperate because of my time limit! She won't let me out of the agreement! What can I do? I'm by myself & this is my first & only home! Can you help me please?

      Hi Kathiejohns1418 first I’m sorry that you’re having a bad experience. What state are you in because the contract does vary by state. The first thing I think you should do is read your contract and look at the areas that discuss your ability to terminate. Start there and then reach out to the managing or employing broker of the agent that you’re working with, and see if you could explain the issues that you’re having, and if they would reassign you to another agent. There is a reason why we ask you to sign a contract because we don’t get paid until we close the transaction. all of the work we do preparing your showings, property information, so you can make a good decision about any offers that you may be making, and all of the gas for driving around town for all of the showings. Realtors are independent contractors even though we hang our license at a brokerage, we do not get paid until a transaction closes. It’s important to understand that the brokerage we work for does not pay us unless we bring a commission check in from a closed sale or purchase. Any time gasoline driving around and everything that we do to expand time. We never capture back if we do not close a transaction so it cost us money. But it is important that we have a good working relationship with our client and if it is not a good fit for you and you are not under contract. I highly suggest that read your contract clearly, and then speak to the managing broker and tell them your situation, and then you’d like to terminate the contract. Feel free to call me if you have any additional questions. And again I hope that you are able to find the right REALTOR and achieve your goal of home ownership.

    My brother n law and his mom are on the mortgage and deed, she’s 86 and wants to be removed from the deed for financial reasons. Would a quit claim be best to remove her from title?

      Hi Yvettebucio I would say talk to a title company or if you're in a state where it's an escrow state or an attorney state talk to one of them first to get the best advice. A quick claim deed does remove somebody from the title, but it doesn't remove them from the loan that has her name on it. She would still be responsible for the loan if she was on it. I can't give legal advice, but I can say that a quick claim deed does remove somebody from the title. But there are tax implications, so I can't really tell you what is best.     What if I need to move out of state for work ? can I rent both primary and secondary properties?

      Good question, So again you can look at your loan terms for each of the properties and see what they require for the length of time you must occupy the property before renting it out. If you just bought the primary home it is likely they would require typically 1-2 years of owner occupancy. If you have already been renting the secondary property and met the loan requirements or you purchased or refinanced it into a non-owner occupied loan, that should not be an issue.       Hi Juan Jones, there's two different loan transactions that you're referring to. You would be refinancing the home to achieve the cash out to buy the next home with a new loan. The refinance won't have a down payment required. It will just have a certain loan to value required. The purchase home will have a down payment and that will depend on the loan program that you're choosing to purchase the second home with. Feel free to call me if you have additional questions.     One of the reasons why it was so hard for me to switch schools from Colorado to Hawaii was that the move took place in the middle of the school year for me and I was in 3rd grade at the time of the move and I missed 2 months of school when that happened. Although moving schools from Hawaii to Maryland was easier. Originally I was supposed to move to Maryland in April 2009 but my dad filed an extension to stay in Hawaii until June so I could finish school in Hawaii before attending Middle school in Maryland.

I work with many military families making a move here to Colorado Springs and strive to help in any way I can. I do video tours for those who have to buy sight unseen, which is stressful and they must trust me.     I have done moving with my parents when I was younger and my Dad was active duty. I will say switching schools was not easy at first for me when I moved out of Colorado to Hawaii. I was in 3rd grade at the time of this move. It also can be hard to leave friends behind from one base or post to the next when you move. In fact I recently had been thinking about my neighbors that I had in Hawaii and how they are doing now from time to time. Also moving houses from Kiele Place and Gemini Avenue in Hawaii was hard for my parents because they had to move everything themselves from house to house which was a huge mistake for them as some stuff was too heavy for them to carry themselves.

    Pet rent is a scam and I'm sure your pet deposit is outrageous too.

      Most landlords charge pet rent to cover the additional costs of damages that often happen with animals living in a home. Home Partners is not the only one that charges pet rent and larger deposits. Owning. home allows a person to do as they wish with animals, but leaving/renting a home means it is someone else's investment and they will have to repair any damages an animal does to a home, often it is very costly. Sound like saving to buy your own home might be a great thing for you Dale. Wishing you all the best. BTW I am not part of HPA I simply did a video about the program.

    So if I'm planning to live on the 2nd home and rent out my 1st (won't refinance the 1st) would i need to pay 20% down on the 2nd one still even tho I'd be living in it?

      Hi Andres, that’s a good question. It really depends on which loan program you choose. If you have cash in the bank to put 20% down on the next home without refinancing for the cash for the next homes downpayment you can certainly do that it gives you different loan programs that you can use. Often times people use and FHA loan program that only requires 3.5% down payment. There are some conventional 3% down payments. Those are typically used with the first home purchase. But that’s not the only way to purchase a home, it all depends on how much money you have saved or if you needed the money from the Equity of the First Home to purchase the second. Some people do a refinance to pull the cash out to put a down payment on the next house. I think a common misconception is that an FHA loan is only for first time homebuyers, and that’s not true. I hope that answers your question. Edit… I just saw a Lender post that to use the rental income from the first home you may have to use 5% down or more.

    Can friends qualify for 3.5% down or are they required to put more money down?

      Hi Yuridia, Great questions. You would be applying for a loan for the home and that one loan, I believe you are referencing would be an FHA 3.5% downpayment, will have two applicants or however many will be buying the home. Only one loan so only one downpayment and closing costs and earnest money etc. What is more important when buying a home with a friend or family is how title will be held. I am a LO and I remember reading an article that referenced friends applying for a mortgage are required to put 20% DP than your typical couple or individual applying with a family member. My client is buying a home with her best friend, and I wanted to double check this won't be an issue since they only have about 3.5%. Sorry, I myself am still learning everyday. :)

      Hi John B. I am not a CPA or Loan Officer, however what I believe you are describing n has to do with the type of loan you are purchasing the home with. If you are using an owner occupied loan product and will be living in it as the primary entity that is less expensive regarding your interest rates anyway. You can own a property in a trust, estate and a variety of way. If you are trying to use a loan product for income property, where interest rates and down payments requirements are usually higher, then I am not sure why you would use that type of loan product anyway if you will be living in it.       @@LauraGallantRealtor Hello, It would be a cash transaction and I lets say I purchase under land trust and beneficial of the land trust will be my LLC

      @@johnb9710 I suggest you talk with your CPA and see what they suggest. I know there are new requirements for cash transactions in the name of LLC's over $300K purchase price. I called my title person and a lender and they also suggested you talk with your CPA. I hope you find the answer to your question. Love to hear what you learn if you consider sharing.
