I guess im not understanding something... The seller cant contact the lender prior to going into a land contract to see if theres not an issue with going into land contract? Why did it sound like land cintract is pulling the wool over the lenders eyes? Doesnt permission have to be granted to enter into land contract?

What is missing from this discussion is the effect these new rules have on a buyer. The buyer Does Not in any manner benefit from now being required to shoulder tens of thousands [or more] of up-front money to purchase a home that was perfectly available under the previous policy of allowing the seller to simply include the cost of a commission into the asking price, which is generally part of a buyer's financing. All of this was 'baked into' the value, sales and purchase of a property. It is hardly imaginable that a realtor on either side of the transaction was in any way being 'short-changed' by agreeing to either a 2% or 3% split of a 6% commission with the listing agent. This lawsuit had absolutely NO benefit to a buyer - in fact, it harmed the buyer by requiring that one enter into a commission specific agreement [generally] before even seeing a home that one may be interested in. A Seller is Not Going to lower his price below market value simply because he is no longer required to pay a full 6% commission - suggesting that as a possible benefit to this application of this new approach is simply ridiculous and untrue. They should have simply left well enough alone - it has worked fine for decades!

It’s true that buyers may now have to budget for agent commissions upfront, which can be a big challenge. That said, the goal of these changes is to create more transparency in how agents are paid. Whether this actually helps buyers in practice is still up for debate. I really appreciate your perspective-it’s an important part of this conversation!
But the real estate agent's cut is THE SAME! This is a scam as far as I am, a seller, concerned.
This is interesting. Our bank recently turned us down for a home load saying our DTI Ratio was not good. When I used an online calculator it was perfectly fine, even really low...in the green. I notice here she uses per month income, not gross income like the calculator used. Maybe that made the difference?

my wife signed off on our property when I found out she had been getting credit cards and maxing them out in the amount of 30,000 dollars so I took a mortgage out on my home which the mortgage company had her sign off on the deed. since then we have divorced and she has passed away trying to refi and they are saying she is still on the deed if that is so how come I got a mortgage without her name on it
I recommend reviewing both the deed history and your divorce decree to establish a timeline. If there are two mortgages, she may have been on the deed for the first mortgage and wasn’t removed before the second $30,000 lien. The lender should be able to provide the deed history. Also, ensure the lender is aware the divorce occurred before her passing; if the divorce decree awarded you the house, it could strengthen your case in discussions with them.

How can a lender just call a loan due when you have a 30 year contract ?
A lender can demand full repayment of a loan if the mortgage documents or deed of trust include a "due-on-sale" clause, which is triggered when the property is sold or transferred without the lender's consent.

Cities and counties are biggest conveyors of deed fraud with their creation of "tax deeds" on private homes because of the misapplication of the revenue laws. Constructive fraud and conversion and you are none the wiser.

Not sure if you’d see this but my spouse isn’t on the loan but is on the deed. Why do I have to refi or buy him out - get a second loan on my house just to use my equity
Thank you for your question! If your spouse is on the deed but not on the loan, they still have a legal ownership interest in the property. When tapping into your home equity, lenders typically require all owners to be included in the refinancing or equity loan process to protect their interest. That’s why you might need to refinance or buy out their share to access the equity.

Surely this needs to structured such that a performance deed is signed by both parties and retained by the seller's atty, to be used in the event that the buyer is in default, so the seller gets their property back automatically. Obviously the buyer forfeits any upfront monies or equity they may have in the property....... Patrick?
Response from Patrick: I know that a lot of people use performance deeds or pre-executed deeds in lieu of foreclosure. But, these ultimately eliminate certain rights/remedies available to a borrower (like notice rights and the right to reinstate or the right to redeem a loan). So, they may be unenforceable if a borrower sought to challenge their use.

How many of these transactions have you done? After Lender calls a mortgage due and payable because we're doing so close all you have to do is give the property back to the seller put the property back in his name and then I have a lease with option to buy that solves the problem
The concern with turning things into a lease option is that the “owner” (i.e., the buyer in the subject to transaction) of the property is no longer the owner. They are now a tenant and they no longer have a deed to the property. Owners and tenants have different rights under the laws of most states. Not something we really recommend.
These are all great topics to shed light on, even the smallest risks need to be brought to the forefront so that the serious investors can continue to innovate and work out the kinks regarding these transactions.

Can this be done on a property if a deceased person who has no beneficiaries? I would never steal from anyone but are there circumstances where it’s legal and ethical? For example: if a person died in 1999, no one claimed it, no family members can be found, the city lost or mishandled the files or something happened where the city didn’t acquire the property… can a person legally and ethically claim or possess the vacant property/ land?

IMPORTANT! I am a New Subscriber.. my wife and me divorced. With a son, 2-5 months after the divorce, she was being forclosed. She was behind 3-4 months.. she said to me,I don’t want to pay this house anymore, I will not pay it no more; so if you want to keep it try to save it from the bank and keep it. I will move in with mom that has cancer. 2 months after she is attack by a fulminant cancer and passed after only 8 months which I spend each day of them with her. When the judge ask her on the divorce; Do you two have any assets or properties to divide, she said no. All o want is my single last name back. Judge said okay you could leave yous have been legally divorced. When she died I were closing a sale on the house when my attorney said to me me: your son appears like owner of half because his mother which you divorced from passed so the 50% is his. I ask and got the living recording of the divorce case in preceded by the Judge. But my attorney saids that it is not valid so I had to back off the deal and still as a disabled senior paying with a SSA check a higher payment. My question; I have a live recording of her answering the judge questions as if we had any property or house to divide ; she expressed NO!!why my attorney saids that with the live recording and judge and witnesses in court names, legitimately presented.. why they will not honor the verdict?
