    filling fees po, automatic po ba ang charges sa defendant? baka po kasi sa filling ay magsingil po agad bago i process ang complaint.

    Hi atty ask ko lang po after ng working day na 8-5pm pina standby/oncall 2:57 ka ng 5pm-8am nxt day pero pag walang tawag no pay legal po ba yun?

      Hello po. Under the Labor Code of the Philippines, when an employee is "on call" but is not required to be at the workplace, and is free to use their time for their purposes, these hours are generally **not considered working hours**. However, if the employee is called to work during this period, the time spent working is counted as work hours. **Stand By** If the employee is required to remain in or near the workplace, where they cannot freely use their time for their purposes, this time is generally **considered working hours**. The key factor is whether the employee's freedom is significantly restricted by the employer's requirement. In your case po, meron po ba kayong freedom to spend your standby hours for personal purposes? If yes, hindi po considered work hours so hindi po bayad yung oras.

      Yes po. Pwede po na gawin nyo syang authorized representative. Gumawa lang po kayo ng Special Power of Attorney.

    Hello po Ma'am, ask ko lang po sana ano yung minimum time after ng Regular Shift para ma consider na OT ka sa isang araw based on the Labor Code? For Example: 5PM actual end of shift ko, and I stayed for 10 mins to finish my task. (Considered po kaya as OT yung 10 mins na yun, or my required minimum time muna bago masabing OT ako?) Thank you po sa sagot.

      Wala pong minimum time. As long as nag-exceed na po ng regular 8 hours na work, considered na as overtime.

    Mam what if ang employer ganito ang ginagawa kasi. Ag naka 2.5 hours ako na ot my bayad po cxa na 75 pesos daw po . Ang pag naka 5 hours ka is 150. Pasok ba yun sa labor code ng mga employee ? Salamat po kung masasagot.

    Hello po attorny may mga compny po ba na hnd po allow mag bayad ng restday overtime sa mga empleyado kasi simula po na hire ako dito sa shwarma shack ayy hnd po nila kami binabayaran ng 7thday duty at hnd rin po sila sumusunod sa 6 working days tinatanong ko sila kong bakit po walang bayad ay hnd po nila masagot.     Good morning po, ask ko lang po about sa computation ng agency sa salary ng mister ko kapag holiday at overtime. Yung sa contract po kasi nila salary nya is 40,000 monthly, everyday ang pasok, 12hrs duty. Diba po yung basic pay is yung salary nya base sa contract? At yan yung basic pay na gagamitin sa pagcompute ng holiday at overtime? Tama po ba na kapag holiday 8hrs lang ang babayaran na may 200% at 610 lang bang ginawang basic pay? Ginawa po kc ng agency nila tuwing regular holiday 610x200% lang at ang Overtime is 610÷8hrs para makuha nila ang per hour sa Overtime which is 76.25 lang. Yan daw kasi ang sabi ng DOLE, yung 610 na yan eh yung standard minimun wage na binigay ng DOLE.. Tama po ba computation ng agency nila? 40K monthly nila di pa kasama cola or kahit anong dagdag sa sahod, hindi po ba dapat yung 40k ang magiging basis sa pagkuha nila ng daily rate, hourly rate, at basic pay for holiday at overtime computation? Bakit biglang naging 610 lang dahil daw yun sabi ng DOLE? Thank you po. Sana po matulungan po.

      Hello po. Kung may overtime sa regular holiday, yung 200% po dapat ang basehan sa overtime pay. Hindi yung basic pay lang

    hello po, isa po akong security guard, may time po na pinapasok po kami kahit nakasched kami as Day off for that day, maiaapply padin po ba yung additional 30% pag pumasok ka sa rest day kahit hindi po natapat ng sunday ang rest day? ang sabi po kasi pag natapat lng ng sunday ang rest day at pinag duty ka don lang maiapply ang additional 30%. salamat po sana po masagot para malinawan po ako.

      Hello po. Yes, applicable pa rin po. Kahit hindi holiday or Sunday, basta rest day po meron pa rin yang premium.
