This is an excellent interview! Nadia Chung is a great communicator and fun to listen to. The substance was excellent too. The interviewer, D. Schweitzer did a great job as well. He made her at ease so that she could be herself. Excellent! Both of you!

It’s pretty much accepted that in whichever state the member files/initiates the action, they’re implying consent by choosing the venue. The protection comes into place if the spouse initiates and it’s not the service-member’ state of legal residency. In that case, the member must immediately tell the court they don’t consent to the retirement portion; the rest of the divorce can happen but not the division of pension.

There is something so disingenuous when someone says, "That is a great question." It's almost like they do not believe it. I think I want to start saying that sarcastically. It is like when people say your name 3 times during a short interaction. It makes me think they are putting me on notice that they plan to report me, if I do not do what they demand. I have also noticed that people like to ask how my day is going. It is like they are trying to gauge a mental status before the exchange. Most of the time I do not respond to that question and just stare at them. I know they do not want to know just as much as I do not want to tell them. I do not know who is teaching these tips.

Latin is a dead language with stable definitions of words, so they can not be re interpreted by word benders. There is a passage in the bible about this, about paid lawyers who prevent the definition of words to achieve their dubious goals. That was one of the reasons Jesus did not like Pharisees and Scribes or aa he called them law sellers.

What about new kids with a new partner. I’m from Germany and there’s a rule, that the new kids as dependents always go first. There’s a threshold of a certain amount of money the parent is entitled to keep - let’s say 1,500€. Let’s say a kid needs 500 a month. If he makes 2,200€ - before he would have given his ex 500€. Now he keeps 1,500€ + 500€ for the new kid and the ex can only be granted 200€ (which isn’t enough to cover necessities. The state will cover the rest 300€ and will - take back the money from the father as soon as he has money available- sometimes they even seize it from pensions. My point is, don’t make more kids if you can’t afford them. The state (other tax payers) should not have to carry your burden. Is that the same in the US?

Hi, I am filing an ex parte. Unfortunately, I’ve been waiting for the 827 form through Cps and I have not received it. So it has been a wait. Can I still file the expert or do I have to do a modification? The transcript should be here within the next week and it is for her safety. I’m just not sure if there’s a time limit to file from the time with holding the child. also the father has not tried to contact or pick up the child

SEEK WORK orders lead to IMPUTING INCOME. Can a child support modification through child support services address SEEK WORK orders? Can they impute income from the primary caregiver when the other parent has neglected 100% of their stipulated custodial time of 20%? Can they impute income without requesting vocational training and providing support to do so? Can they impute income for not seeking work, during a “STAY AT HOME” order from the government due to a pandemic?

  • @shannonjamieson2873

This example is crazy! She sounds like a privileged example of when a SEEK WORK order would be advisable. My case is quite different and was used as a form of financial abuse. Child support modification commissioner was absolutely fraudulent in my case!

I am confused... Hopkin's character is not yet convicted as I understood it at that part of the movie.. Yet she calls him a "criminal".. Am I stupid or is that not actually a really, REALLY bad thing to happen? If he is not convicted for the alleged crimes they say he did.. He should NOT be labeled as a criminal.. Attorney's should know this.

The very idea that Court reporters would be the place to cut costs is MIND BLOWING. I don’t understand how on earth this was even a conversation. There needs to be more recruiting for the professional court reporters, both machine and voice writers. Both are highly trained and an invaluable part of our judicial system. Digital court reporters and AI of kind will never be a replacement for stenographers. The legal profession needs to raise awareness and their concerns about this. It will comprise the integrity of the judicial system. That is a scary thought indeed.

I live in California and I am low income. I made $38k last year for a family of 5. We have 2 children from the Marriage and 1 that is the youngest she had from an extra marital affair for a total of 3 kids. My wife wasn’t working because she was carrying for the youngest child and is also a full time college student. She is 29yo. She filled for divorce and we came to a “50/50” child custody agreement.(I have the 2 kids from the marriage an extra day). She is seeking child support and alimony. We were married 10 years and out of that time 3 of those years I was a single parent without any financial support from my wife even though she was earning about 40% more a year than I was. I don’t have a lawyer as I cannot afford one. I am in the extremely low income bracket per family size, I receive food stamps and am in sec 8 housing. She has moved out to her parents house. I will try and ask the judge for a seek to work order and or imputed income. I have submitted my income declaration form and some most months I’ve had to put the extra expenses onto a credit card. I believe that her not working creates a bigger expense to the state as we now are both on separate food stamps and will soon both be in separate section 8 housing. She has applied to over 80 jobs and has not gotten hired however I believe the jobs she has applied to she is not qualified for. She could apply to in-n-out and make close to the same pay I am making. Honestly she doesn’t even have the proper space for the kids. I really should have the kids 80% of the time. My kids have lived with me all of their lives and call me saying they want to come home.

I am not an attorney, but I was on juries in traffic and criminal court in Houston, TX and on a civil court jury and a federal grand jury in Oklahoma City. I know poor old Nunnally was grieving, but even a grieving police officer should know to walk out of a scene as soon as he realizes he knows any of the people involved and he knows not to be involved in any part of it, except as a possible witness. As for Willie, what DA would go to court without reading the arresting officers account of the crime scene, where he would have known that the perp and the officer both put their guns down.
